    That you CBS Denver for running this story. People work so hard to buy a home for their family and there should be no law for a HOA to foreclose their houses like that.

    The News service needs to dig deeper into this story. There is no reason to put a ton of people out on the street because of fines. Add to that fines that are being levied with no answer as to why?

      The goal is the move in gentrifiers that have like minds. Then the new gentrifiers will vote for more harsher ordinances to get the rest of the minorities out and then you have successfully gentrified the community. In the meantime the HOA pocketed the stolen equity in the homes to fatten their account. Notice how many of the hard working people that loss their home was not behind on their mortgage. The crooked HOA constantly administers fraudulent fines to force the takeovers. It's a racket.

    GVR homeowners should have the HOA Articles of Incorporation. Check those out most HOAs should state that any rule can be changed by a 50% vote of homeowners. They could vote to forgive fines and eliminate future ones. Hope this helps

    The green valley ranch residents should be packing those hoa board meetings demanding a vote on a new board or for the abolition of the board. I think the sign in the video said 6 pm March 16th and March 21st. Make the HOA regret ever existing.

    I had to pay $26.8k to Denver Sheriff to give to the Westwork Management for my one year lapse of HOA fee ($3600) during pandemic 2020-2021. My Park Hill Condo Association 2021 Finance summary did not show that $26.8kin our financial statement from the Westwork HOA management though. Tax Fraud. Denver Attorney General, IRS, please look into the matter.

    in my state, you are entitled to a hearing with the board before the fine is assessed, but usually they fine without a hearing

    It sounds like the HOA is sending fines intentionally to drive some owners into foreclosure. The board members need to be investigated for criminal activity. Why are these owners worried about keeping their equity? There is NO WAY THAT THE HOA can keep their equity legally. The owners should also have been given a choice of action before foreclosure. They can simply sell at a discount to new buyer who will agree to pay with sale discount or they can take out a home equity loan. But the REAL ISSUE is the excessive and maybe illegal fines the HOA is sending to these owners. Who is monitoring the HOA and how are they accountable? You cannot bombard homeowners with unreasonable fines.

    The state created HOA's so they don't have to follow up on residential issues. They are content with abuse of this kind as long as property values go up and they get their tax money. I understand we need to keep our areas maintained but this is flat out abuse of the HOA policies/power. If the state does not backup these homeowners then the rest of the homeowners are on notice they are next.

    I've been on the board of directors of two HOAs where I've lived in the past. One was small (52 homes and the other bigger 263 homes). The boards were always comprised of homeowners and we were concerned with the neighborhood and always worked with homeowners to resolve any issues. We weren't bullies that didn't communicate with homeowners. There's something wrong with this HOA board if these homeowners are not aware of fines and fees until it's too late.
    On the flip side, when you buy into an HOA neighborhood you must be aware that there is this extra layer of "governance" over your property and you need to be involved and knowledgeable of what's going on in your HOA. Going to HOA meetings (which usually are once per month) is a good way to keep abreast of how your HOA is running.

      I guess you missed the residents stating the HOAs Don't communicate with them. I'm sure if the Hoa was playing fair, they wouldn't have a room full of folks some whom are nurses, Dr's etc. who would like others want to keep their home their paying their mortgage on. I wouldn't be a armchair quarterback on someone else's situation until I knew all the facts. You never know when your going to be in a messed up situation and then others make dumb comments without knowing all the facts!

    Everyone's quick to blame the board but there's not a lot of conversation about what the bylaws or the ccrs are saying. When you move in you're given a copy of the bylaws or the CCRs depending on your community. The rules and regulations are also something else that you're given which usually explain what are things that can be fined for. The board is only enforcing what those items are. But it does sound like they are excessive and inappropriate.... But it is the board's responsibility to have those documents that are legally filed with the state upholded. I agree with other comments if you don't like it show up at a board meeting. And if it's important enough to you you'll get off of work even if it means taking a vacation day because that's a lot of money to not make it a priority.

    The HOA board is just neighbors who volunteered to be on the HOA board. Vote out the HOA board. Fire the property management company. The HOA board and residents who live in the community to fire the property management company and hire a new property management company.
    This definitely might be discrimination. Base on fair housing laws, these residents have a case that they can file in court for fair housing discrimination. The sue HOA board members individually and the property management company separately.

    Foreclosure from this HOA is wrong and should never have been in the “Covenants”. The City of Denver should standardize local HOA Covenants to be fair but forceful.

    So how does this work? If you have a mortgage on the home the first lien holder is the mortgage company. The HOA would become the second Lien holder. How can they foreclose on a house which may still have a mortgage of 300,000 when their lien is only say 8,000

      They would pay the mortgage company with the new buyers mortgage , it is all money transfer stuff , your mortgage company don't care about nothing as long as they get their money , the foreclosed owner is the biggest looser at the end because they could lose some or all of their equity money including the down payment.

    Demand an audit! If memory serves correct, if 1/3 of the residents demand it and the HOA takes in $250,000 annually, they have to comply. Band together and get a consultation with an attorney or a CPA that can guide you. Vote against ridiculous fines and having them cause homeowners to go into foreclosure.

    HOAs should be abolished, but barring that, they should not have the power to foreclose. Perhaps placing a lien if fines are *legitimately* owed, but not foreclosure. But before a lien could be placed, there should be an independent third-party arbitrator that a homeowner can appeal to who would make a final determination.

    You need to get a group of your angry men and women together and have them show up armed with rifles and shotguns to that HOA office. These are your homes.     Dismantle hoa across untied states. If I buy a house, my name is on the deed not the hoa. A lot of people may not have a choice when buying a house, but to me an hoa is not one of them.

    Something sure sounds fishy if 1/3 of HOA foreclosures are coming from one community. I joined the board of our HOA because I wanted to know first hand the decisions being made. Now I'm the President by default because there are only 4 active members and that is a shame. Since Covid all of our meetings are by Zoom. We send newsletters with the information, but homeowners still don't participate. Our HOA dues are only $82.00 and have been that way for many years. There has been talk of raising the dues to increase the reserve. IF they are raised, I want to make sure it's nominal. But homeowners should be active and aware. They can't get made when/if they do go up.

    HOA not communicating with them. LOL. Sounds familiar. Our HOA president accused me of causing problems when I call out the board because I could see cause and effect problems for the board's decisions down the road. I sold that place before the HOA financial problems started. Don't buy into one. Chance's are high that you'll regret it and it can cost you a lot of money and headaches. An HOA is regulated by state law not city township or county. These people are barking up the wrong tree. Besides, if the HOA isn't breaking state law there's nothing they can do to stop the foreclosures except work with the HOA.

    I've been on both sides -- a part of the HOA and a grumpy homeowner about an arrogant HOA. I did learn while on an HOA that homeowners like to whine and make excuses, but generally deserved the fines.
