Sir, I took land loan 2013 sundaram finance as 10.5% interest for 10 years. But due to not building home in 3 years they turned into mortgage loan interest rate increased to 16%. Now 11 years completed but still 4 years I need to pay. Can I go legally to get justice. Pls help me sir
You could have tried with other banks for housing loan at that point of time. Now it is too late. Conversion as mortgage loan may be in your original loan agreement and they may claim that they are right in converting the loan as mortgage loan. Your have now limited options. You can talk to them and get extension of repayment period. They may not have any problem in extending loan. Or get this loan transferred to another bank. Take over of loans by other financial institutions is permitted Legal remedy by going to the court is not advisable as it involves time, cost and mental tension. The financial company may have well drafted agreement, which you might have signed at the time of taking loan without reading a word. Hence your chance for success at legal proceedings is almost nil. Better discuss with company officials.

I hope the concept of mortgage has not been understood correctly. There maybe loan with security or without security. A lender may give loan without security. For example you may give loan to your friend without security. But a money lender will require security. If an interest in the property is transferred then it is mortgage and the loan is "loan secured by mortgage" . The answer to your question is any person can give a loan to anybody. Whether it should be secured to a mortgage depends upon the lender and borrower. If it is secured by mortgage, then it becomes loan against mortgage.

It is possible. You can transfer your loan account to another bank and also the mortgage.
