That is absolutely false. Desertion in a time of war is stiffer but nailed to the cross for UA/AWOL not likely. I think the max punishment is 60 days restriction with 1/2 pay for 2 months and a grade or two reduction. I don’t recall and for all I know the regulations changed in the last decade.

Not necessarily. If someone is threatening you with a court date and you say arrest me then, and they do, then you win and are proved innocent, the unlawful arrest will work in your favour. Many people have accepted arrest but pleaded innocence.
