- Supreme Court has upheld the 2010 Delhi High Court Verdict and ruled that the office of Chief Justice of India is a public authority under the right to information Act .
The five judge bench led by Chief Justice of India highlighted the importance of transparency in the judiciary and said right to privacy and confidentiality is an important aspect . Apex court also held that judicial independence jas to be kept in mind while dealing with transparency .

I would like to raise a concern regarding the debates on Big Picture.
Most of the panelist in this debate mentioned that since the judgement is not uploaded we can not comment on judiciary's stance.
It would have made more sense to have hosted this discussion tomorrow or a day after so that a holistic coverage of the topic is done.
I get it that the broadcaster wants to remain relevant and discuss current issues, but it must be kept in mind that justice is done to the topic being discussed. I have been a regular viewer of RSTV for more than a year now, and i have realised the fact the discussions usually tend to miss some major chunk of the topic because they are recorded too early. On the other hand newspaper editorials which evolve throughout the week cover the topic more holistically.
It would be better if you could host debates once the dust settles and holistic interaction takes place.
The dust will never settle, some subjects are very fluid. Let us at least appreciate their initiative even though it's premature. It's providing a rich content vis a' vis any other privately held channel I have seen so far!

Now cji office as a public authority under RTI act, is welcome judgement but comes with if and but. Transperancy of courts can't undermine at the name of independence of judiciary bcoz judges also have accountability to the public, they don't constitute a separate elite class, we are living in modern democratic world, not in the medivial world where aristocratic people have extra privilege.
Very good explained main things is public domain me koi bhi cases ho o sab public domain me public karna chahihey. Kis base's ke upper judgment diya. Usaka sabhi documents ke saat dena chahiye by digital information any body can accuses it. Aisa huva to hamara desh ka court transference hai karke Mann sakte.

Test of Proportionality was used in Aadhar case under Triple Test , where it was meant to decide upon the dilemma of Benefits of Aadhar vs Potential threat it carries to Fundamental Right to Privacy.
Here in CJI RTI case ToP will mean : Judicial Independence/autonomy vs protection of Right to Information.

UPSC IS COVERED UNDER RTI.
This step by honourable supreme court seems to be done after the RTI amendment act 2019 , it has already been diluted, now the office of RTI is not that much strong. Independence of judiciary is still there. The transparency is now in the hand of RTI officer whether to provide info or not. Which is indirectly now controlled by central government

What exactly is doctrine of proportionality?
It means the balancing of the purported benefits of bringing the transparency and the potential threat it carries to the fundamental right to privacy.
The section of Right to Information Act which defines public authority is 2 (j) and not 2 (h)
Section 2(j) in The Right To Information Act, 2005
(j) “right to information” means the right to information accessible under this Act which is held by or under the control of any public authority and includes the right to-
(i) inspection of work, documents, records;
(ii) taking notes, extracts, or certified copies of documents or records;
(iii) taking certified samples of material;
(iv) obtaining information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts where such information is stored in a computer or in any other device;

How transparency affect judicial independence ??
Has this judgement opened a backdoor to control the institution of supreme court especially now since RTI has been diluted? May be this is not a good decision at this point of time.
I think the office of governor is come under public authority. so illegal appointment in said office must be check through RTI act .
