- The Supreme Court on Tuesday agreed to hear after four weeks a public interest litigation seeking that the chief election commissioner and election commissioners be appointed by a three-member collegium. The collegium will comprise the Prime Minister, the leader of opposition in Lok Sabha and the Chief Justice of India. A bench comprising Chief Justice S. A. Bobde and Justices B.R. Gavai and Surya Kant took note of submissions that the plea needed an urgent hearing. Advocate Ashwini Upadhyay filed the PIL seeking to ensure more autonomy for the chief election commissioner’s office and election commissioners. The plea has also sought an independent secretariat for the Election Commission of India and that it should also be given the power to make rules. On this edition of The Big Picture we will analyse how election commissioners should be appointed and how to ensure greater autonomy for the ECI.

Key points-
1. EC has proved its mettle
2. Goswami committee and Law commission reports recommended collegium for appointment of CEC
3. Collegium will ensure transparency and absolve EC of allegations of partisanship behaviour.
.4. It is good electoral reform but IT SHOULD BE PREROGATIVE OF EXECUTIVE and not judiciary as this would undermine separation of powers.
5. Other reforms needed- ELigibility criteria for CEC and other Election commisioners, Same removal procedure for both CEC and commisioners.
Three suggestions for the appointment of CEC and EC's , if the present system come out as a faulty provision. :-
1. Collegum system
2. 2/3rd majority of joint parliamentary session .
3. Existing CEC recommends next CEC
My advice - Last one is best
Challenges to current system
- Security of tenure - present EC's can be removed by govt. Easily (In consultn with CEC ofcuse)
2. Salaries charged from CFI
3. From the perspective of SC , Ultimately it is a case of political gimmick vs real constitutional faulty mech'm , but should not definitely left to parliament to decide.(its already too late , 73ys gone)
There should be a collegium system for the appointment of chief information commissioner and there on Chief information commissioner will appoint information commissioner ,then there will be a transparency in RTI after the recent amendment otherwise it will become a dust on the table.

I'm here after seeing all the mockery of 2024 regarding Supreme Court judgment, govt reversal and appointment of Election commissioners.
How election committee should be formed?
Even in 1990's this proposal for a collegium was raised.Later on that was dismissed.
This is an executive power of the President.There is a procedure described in the constitution.
In US such a discussion is done in the Senate and only then decided upon.
The kind of respect the Election Commission derives from the world is immense.

There shud be a collegium and the election commissioners and the CEC shud be elected by the collegium. The collegium can consist of the CJI, PM, Leader of Opposition and the 2/3rd parliamentarians

The panel members have faint memory . The demand for EC reform has been since 1975 read Tarkunde Committee and not only after Goswami committee in 1990s

The appointment process of Election Commission have just been declared by the court.
Election Commission Require much less reform to serves it end of conducting transparent elections
but it should majorly require political reform
that cannot require any committee or body but WE THE PEOPLE
AS representatives at central state or municipality and panchayat level are not remains ours but of parties
So WE THE PEOPLE
Had to elect an regional independent candidate at all levels so that they are ours and not party
and as whole reform can be taken from grass root level
as Constitution itself say it is from WE THE PEOPLE and not WE from the constitution
SO WE HAVE TO MAKE REFORMS AND NOT ANY INSTITUTION

In short our constitution is all filled with confusions and not allowing anybody to take any decisions easily.. Its riddled with ambiguities and we keep going round and round about these ambiguities ..thats why it takes a long long time to implement anything..
