I'm actually curious since I'm not a USA resident: If some guy like Reacher did that to help a woman and her child in this situation in real life, would the guy face charges for defending people by demolishing a criminal? I don’t have actual legal background, but I think it would be tough to get a lawsuit against the Good Samaritan. The guy who got a beating is in an active kidnapping situation with threats and assault with a deadly weapon (mom is beat up). There’s enough against him that I don’t think the Good Samaritan would actually face charges or law suit of any kind. They could try to sue, but nothing would come of it based on the presence of everything else (gun still actively in hand, crimes actively present)
Thats a simple self defense claim. The fact the man had already beat the woman, and car jacked her, Reacher could have done the same thing and gotten away with it under Self Defense and "Good Samaritan" law. But considering the man used a gun during those crimes, makes it a felony and a CLEAR case of the mom and son being in imminent danger. "For either defense to apply in most states, the defendant must reasonably believe that someone is in imminent danger of harm." Worst Reacher could expect, is being questioned at the police station and released, and the District Attorney would choose not to bring any charges against the Reacher. A similar case actually happened, when a police officer was in a fight with a criminal, and the criminal grabbed the officers gun. A motorist came upon the scene and shot the criminal, and wasnt charged, due to this "Self Defense of another" law.
Self-defense extends to reasonable defense of others. Reacher would not face any charges here, he rescued a child from an armed robber. He would get a medal from the mayor.
Sadly, it depends on the jurisdiction. Some states (California and Illinois in particular) do not recognize most self-defense or defense-of-others cases and will gladly charge Reacher in this circumstance. Other states (most Southern states such as Texas) have laws in place which could result in the prosecution receiving penalties for charging Reacher in this circumstance.
