I made this video to help you understand Trademarks and Print on Demand. I walk you through what trademarks are, how to check for trademarks, how to understand what the trademarks cover and how to avoid getting trademark infringements if terms get trademarked AFTER you post them for sale.
If you get too many trademark infringements then Etsy will close your shop, so its very important to check for trademarks on your designs, titles and tags.

So how do we go about trademarking a shirt that we know would get ripped off Cassiy? Do you know the cost etc?
This video was incredibly helpful for me as a newbie to all of this! I have to admit though that I am annoyed at some of the simple phrases like Happy Camper that are being trademarked. I feel like one day there won't be anything that we can use!
I just received a trademark infringement for having the 3d shape of a VW bus in one of my designs. It didn’t even have the logo or anything in the title, tags, or description about VW. Sure enough, that shape is copyrighted. News to me! Be careful y’all!
Ugh that stinks!! But a great example of why it’s important to keep trademarks in mind!

You know the VW bus isn't even for sale today is it? The original VW bug isn't either. So stupid for artwork. Are they on here making us digital content so we can use it? How else are we suppose to get it for personal use? I'm 52 and I searching for the original VW car to drive but maybe now. Forget it!
I'm so late to this video, but for the people expressing concern, it appears that the trademark application for "He Is Risen" was denied, as searching for it only pulls up two results which are specific to a certain design and not the phrase itself. I did a bit of digging, and it appears that whoever tried to trademark it was being rather scummy, as they also tried to trademark phrases like "I ❤Mama" and "My First Thanksgiving" "My First Halloween" , etc.. They really thought they were about to pull off a get-rich-quick scheme or something.

HI Cassiy; Thank you for doing this video. Trademarks are confusing for sure. I ran across a song lyric "Whisper words of wisdom let it be" on a bee t shirt and thought, they cant do that. But when I searched on the trademark site there was no trademark. You mentioned song lyrics and this one is very popular....

Also, I have a question regarding Trademarks for Tags. Let's say for example that my tag is "Love Tshirt". Should I search for trademark for "Love Tshirt" then, or for "Love" only?
Thank you so much for this tutorial! My shop was shut down today and I just posted my second listing last night. I came right to this video for the tutorial and I've checked and triple checked my tshirt saying and I do not see a trademark infringement! But I also do not see an email from Etsy explaining why they shut my shop down. Good time to do some designing while I wait this out. Thank you so much for all your inspiration and the reminder of how much work this will be but how worth it it is! It's what gets me back to the computer every day!
Etsy shuts down a lot of newer shops in case the are fraud, just email Etsy and they should get your shop reopened within about a week! Just keep researching in the meantime on what is currently selling and be ready for when it opens back up! Congrats on getting started and taking action!

I see a trend where POD sellers are submitting huge number of request for trademarks for the most absurdly, common phrases.. in many languages, and the stupid patent office is granting. If this trend continues, you literally won't be able to use any text in your design without getting suspended or sued.
A lot of these trademarks end up not officially getting approved or get overturned. So there are people out there trying to stop this. But trust me there will always be generic things to sell like "teacher" and new sayings that will come out. Try not to focus on the negative side of it and just check for trademarks of things and then move on. Still plenty of money to be made!

I am really appreciating your Esty/Printify tutorials.. Question: How do we use the info we receive from the trademark search? The ones I have received info back for seemed to be the names of businesses. Does that mean that I can not use the phrase as the name of my business but it's ok to use it as a phrase to go with a graphic? Or does it eliminate it it completely for any use?

Thank you so much for this video!! It's so helpful, I was kind of confused when I looked at the site on my own prior, so this really helped break it down! I have one thing I'm still confused on - when I search some short phrases sometimes there will be a longer phrase (or I've even seen paragraphs or really really long strings of words all together that don't even really make sense), and my 3-word phrase might be included in there as part of the saying or in the long string of text. Can you use it still if it's not an exact match? Or do they own the rights to phrases that can be broken out of their trademarked phrase? I wasn't sure if people are trademarking long rambling phrases to try to get as much trademarking as they can all at once or something lol. Thank you!!

Great question RN! I definitely am a little bit blessed in the fact that I was an all commission salesperson for over 8 years, so the ups and downs that come with POD aren't as wild for me.
What you really need to understand is the flow of sales, once you have been doing it a little longer it starts to make more sense and you expect the slow times and know to just keep building to the busy times. There are slow times of year and busy times of year. Like January and February are typically pretty slow, then it picks up for spring, gets slow again for June/July and then August the rollercoaster of Q4 starts.
But if you don't have for sale what is selling for each of those seasons, then it will be slower than normal. In the beginning you have nothing prepared in advance so it is extra tough. Just make sure to be always focused on the next big holiday/event/season and eventually there will never really be super slow times if that makes sense. But it takes time to have a stockpile of designs for each season. Just understand that nothing sells amazingly well all year round, it just doesn't work like that. So work on getting your calendar of things to design for and design 50-100 things for each season/holiday etc. and be ready 8-12 weeks in advance. Then you are bound to do well

I am so glad you are enjoying my videos Amy! I wish I had the perfect answer for you but I can't say for sure. I think its fine when you do this but no way to know unless you checked with a trademark lawyer.
If its something super common then I'm sure its not a big deal!
hi!!! you’re really saving my life with these videos! question about book quotes and song lyrics: I am super passionate about this, so i’d really like to know for sure. when i research the trademark and i type in EXACTLY the words i will have on my shirts, including the artist or writers name, nothing comes up. doesn’t that mean it’s ok? also, it doesn’t allow you to used apostrophe in words, so i assume to just take it out and then check. is this correct? so AIN’ T becomes AINT. thank you!!!

Thank you for doing vids on the nitty gritty details so many people ignore - very appreciated. Somewhat unique question on the trademark thing. There's a quote I would like to use, and the quote is not trademarked, but apparently the name of the person who said it is. Kind of interesting considering he died in 1955. Anyway, I hate not attributing a quote, but if I want to use the quote, it would seem I would have to leave it unattributed and just use the quotation marks around it to denote someone else said it? Was curious if you had any info/knowledge/workaround for that particular issue? Thanks!

Hello Cassiy! Thanks so much from the video this has really helped me on my journey. Is there a way to check if a design without words is trademarked? i know you said for example smiley faces are a no go.
These would be copyrighted designs and I am sure there are ways sometimes but it's very complicated. I know for smileys there are over 3,000 copyrights filled for all the different emojis etc. So I don't have any good advice on how to search those. But feel free to check out the Copyright website in the US and see if you can find what you are looking for

I wanted to make a design with a happy face, and I realise that the smiley company has trademark and copyright, but a happy face has been around for ages. You mentioned in detail whether a phrase is trademarked for specific goods such as shirts, but if it were trademarked for an Etsy title or tag what would that look like?
