    I was with him up until he said you have to pay taxes even if your green card expires and you dont live in the country.

      We see your point, Rasheen. Yet an expired green card does not necessarily mean your permanent residence status also expired. That's what makes this rather insane.

    I have 2 questions.
    After how many days of becoming permanent resident one has to file the tax. In the same year or next year?
    What is the worldwide taxable income or investment or bank balance above which one has to file us tax?
    What if we are filing tax in our home country?

    I'm doing my research about US tax laws prior to the possibility of accepting a green card. What are the obligations of a 'US person' who holds superannuation accounts in Australia? Reading a few other websites about the topic and it sounds complicated.

    Do you have to pay taxes as a green card holder but not living (and not having moved yet to the US) in the US, and already paying income taxes in the residence country?

      Great question. If you received your GC outside the US, your first day of residency is first day you were physically present in the US after your received the GC. So, if you got the GC in July, but did not come to the US at all by December, you would not be a resident and not be a US person for tax purposes. But importantly, there does not appear to be an intent element to this. So let's say you got a GC in July and visited the US in September to look at apts with your wife and then left the US a week later, not returning until the following year in January. It does not appear to matter that you only planned to stay in the US for a few days apt hunting with the intent to return abroad for the remainder of the year. You were physically present in the US in September after you got the GC, so your residency date starts from there. And, your date of residency may begin January 1st even if you got the GC after and moved the US after too.

    Thanks for the great video. I have so many questions now regarding my situation. I am a US citizen, my wife is not. She will get her green card soon and then we will move to the states. She works online for a non-US company and gets paid in her non-US account. Will she be able to use form 2555 while living in the states but being paid abroad? She has previous investments, bank savings, and two properties as well. Will she be held liable for any previous incomes, profits, properties, etc?

    Should the same rules be applied to some American Citizens or Nationals who may be seeking to immigrant to other Countries for wealthy seeking, most Americans or Nationals will fail the test.
    Most Africans or individuals from developing countries, they immigrate to the western...world already with multiple graduate or doctorates degrees. Back home we either study using the American or the European or both syllabus . And the majority we are polyglots, yet the westerners et al., et hardly acknowledge education standards. We then forced to survive conduct low wages domestic work, & we start studying all over again to the request of the host countries requirements, which are in just. As though we never attending higher education. Again, we tend to be the well experienced professionally, & we end up training the westerners..., who most times happen to be our superiors in our jobs....just saying.
    Something is not right. Ambassador Susan .E. Rice, once said, "The American Human Rights Is not functioning right"...Human Rights in America and in UNited Nations has not been working according to its "rules & regulations", it too corrupt.

    1-proof of presence for a minimum of 330 days per year to qualify. What consequences will this have when applying for us Citizenship.?
    2-invoicing and income in the other country is directly under the personal name.

      Thank you so much. I am not quite sure if using the SFOP would have any impact on applying for citizenship. Our first thought is that being outside that country already happened. So you might as well take advantage of no penalty of SFOP if you can. If your question is "let's suppose I *could* live outside the US for one year in order to qualify for SFOP, would that impact my application of US citizenship?" That would probably be an answer best for an immigration attorney. Also, by intentionally delaying any FBAR filing you are aware of, that sort of makes you willful which disqualifies one from either the Foreign or Domestic Streamline procedures.

    Just for reference, a green card does NOT open the -entire- US job market to you. Certain job categories are limited to US citizens. And an expired green card does not affect your immigration status full stop. Although companies might want to see a non expired green card to give you a job even though they have the means to check your work eligibility through E-verify.
