    Smythe seemed a very self righteous and cocky man, and in my opiniona liar. Smythe was hoping to at least slap Dunphy around a little by escalating the confrontation. He ended up killing him and perhaps that was his intention from the start. After the killing he staged the scene with that old gun that didn't even work and that had no fingerprints on it. It's all very fishy.

    It takes a coursgeous person who is willing to make the commitment to take someone's life should they have no other way and it takes a murderer to take someone's life because they want to. HE FIRED 4 SHOTS BECAUSE HE WANTED TO.

    Workers Compensation "Controls" everything including the falsifying of MRI results, even falsifying injured workers medical information / claim file information. "Everything possible is used to "Control Compensation claims costs' With "$Billions of dollars in the compensation bank account, anything that costs a nickel that would help the injured worker is DENIED.

    Dunphy might be a bit to handle. Remember though he was in his own home. No doubt the cop went there to kill him. He succeeded in his mission and got away with it. I don’t abdicate violence but in this situation I think it’s time to hire the hangman. Remember that the ones protecting him r supposed to be the good guys. Lmao.

    I watched all the videos of Smyth and he testified he wasnt sure if he had hit the victim but I doubt that Smyth is a very truthful person based on listening to his full testimony and his special reactions... Sad to say but on EASTER! Come on, Smyth there is something wrong with this man if he thinks it is at all OK to do what he did on EASTER.. they should have a brand new law stating that witnesses s/b created for situations such as Smyth... I dont trust him at all..

    The cop shot the old man in forhead from 7 to 10ft, while he sat in a chair,that's an execution!

    I watched the testimony and Smyth comes across as a cold calculated individual. That doesn't make him guilty, yet it is striking. He seems to have no social filter similar to Austic traits. I wouldn't be surprised if he is on the Autistic spectrum.

    I know no one will agree with me, but is this judge suggesting that if a man picks up a gun and threatens cops that they should not shoot to kill? If someone threatens him with a gun would he just let them shoot him? This is crazy talk. Of course they are trained to shoot to kill otherwise the person with the gun could still harm them or someone else. I'm not saying that cops are perfect or that all police shootings are justified, but to act like a cop has a choice once a gun is pointed at them or anyone else is to be living in some kind of fairytale. The choice is out of their hands at that point. They must protect themselves and the public once a gun is pointed.

      I think the point is the policeman had no business going to Dunphy's in the first place. He wrote a couple of tweets like many people do. Smythe had no right to question him and had no business being there. Showed up unannounced on Easter Sunday.

    4 shots wasnt an unreasonable amount given the circumstances . Everytime a police officer shoots a gun its to use lethal force, there is no such thing as shoot to stop outside of hollywood movies, bullets kill. Given the confined space it happened in, close proximity and lack of cover, it's probably what you would have expected to happen either way, if smyth had of being killed. The judge draws some wild unfounded conclusions. You would have question the judges bias and knowledge

      I agree with you, this whole shoot to wound nonsense is absurd. You shoot to stop the threat, there is no such thing as shooting to wound. Now if you happen to shoot someone, thereby stopping the threat and that person lives? That's all well and good, but the intention at the time of the shooting is to stop the threat, plain and simple. What you really have to question here is how that cop didn't notice a 3 and a half foot long rifle being slowly picked up and pointed at him by an old and injured man seated in a chair inside of a 10ft room. It's not like we're talking about a handgun that could be concealed between the seat cushions or something like that. No, this was a long rifle, whose bolt was open by the way, being lifted up off the ground by a seated individual all the while going unseen by a much younger, specially trained police officer standing less than 6 feet away. It is my contention that the cop knew the rifle's bolt was open, posing no threat to him, and then allowed Dunphy to pick it up anyway so he would have grounds to shoot him.
