So, why did he even have an expired registration if he didn’t ever need one in the first place under tribal law? So confusing.
There could be lots of reasons. He may only be able to operate without registration on specific waters. Or only while engaged in a protected activity (e.g., fishing, hunting, or gathering food), but not while engaged in others (e.g., water skiing). Or maybe he bought the boat from someone who previously had it registered.

@@MotherMeece I haven't heard enough to know that that's been established. IF he's a member of the tribe and IF tribal members are exempt from registration when engaged in a protected activity, and IF he was engaged in that activity on waters where it's allowed, then it wasn't illegal for him to operate the boat in those waters without registration. But even if true, that doesn't mean the cop did anything wrong when he assumed that that the guy was required to have registration, because that's the norm, and not needing registration is the exception.
The guy’s defense is a six-second video? You could take any arrest video where the suspect resisted and find a six-second clip where the suspect wasn’t resisting. The real question is, why did he submit only six seconds? What’s on the rest of the video that he doesn’t want the court to see?

He thinks "resisting" means "fighting." He doesn't want to show the longer segment of the video when he doesn't obey lawful commands (which is "resisting"). He only wants to show that he wasn't physically fighting them when they grabbed him.

Yeah he'd have to be a registered member and then it might maybe possibly (if you squint real hard) have some sort of applicability but only if he was ticketed/arrested by a federal agent on tribal land.
Even then, the most that would happen is that he'd be tranferred to a tribal court where they would, in all probability, be much less lenient.
He has a tribal card for Sault Ste Marie of Chippewa Indians is my guess. Most of us that live in Cheboygan are a part of that tribe.

He wasn't a kook. The judge had his ears wide open listening to the witness. If the judge accepts him as an expert witness (a technical term) then it becomes incumbent upon the prosecution to bring forth their own expert witness to rebut his testimony

This whole case is a joke and so is this quack judge. He’s enabling these sovcitz behaviors. They do this to waste time and tax payer money so the judge just gives in and the criminal gets his way. My thoughts exactly, I think the prosecution needs to bring in their own expert witness for this trial. The prosecutor was not prepared well for this hearing, IMO.

A coworker of mine and his daughter were nearly killed by a drunk boater. Life jackets are the only reason they survived.
I grew up on the Ohio River. I knew of several deaths due to drunk boating, not to mention three sunk boats. Boat owners would get drunk and pass out leaving the boat to float down the river only to run over by a barge, known as the "Black Death" because you couldn't see them at night, and you didn't hear them until it was too late. Thank goodness they are finally enforcing the drinking while operating a boat laws.

A Juris Doctor degree is technically a professional doctorate. But unlike other Ph. D. holders, lawyers don't hold the title of "Doctor." Instead, they can choose to use the title "esquire," which is shortened to "Esq." and is fashioned after the lawyer's name.

Yes, he's arguing that "counsel" is his right, but skipped the part where the state law only allows LICENSED attorneys to practice law in court. Each state has its own specific definition for "practice of law".

I believe the federally recognized tribes keep birth records of tribal members. You can't just claim to be a member of the non-exisant Bazinga tribe. The federal government has a list.
It is up to each tribe to decide who is and isn't a member.
There are black tribal members who have no native blood. (And many that do have native blood) These were descendants of slaves held by the tribal members. They gained tribal "citizenship" when the tribes outlawed slavery. These slaves were sometimes living on reservations under tribal law. Some were with their masters on the Trail of Tears.
This has been a contentious issue within the tribes, with some black members having to sue in federal court to retain their status.
As for "White" tribal members, most of them are descendents. They have one Indian in their ancestry. But again, it is up to each tribe to determine who is a member. In one case it was matri-lenial (I can't spell it today, through the mother.). The children of men with the non native wives were told to leave.
Why? Being in a tribe does NOT MEAN YOU CAN BREAK THE LAW. Really nobody cares who’s an Indian . They have to follow laws too. When they don’t they go to prison . Which is why most of them are criminals . Some of the worst kind
@@glynncordry5965 Tribes who now run casinos which promised to pay profits to their tribes have now redefined who is and who isn't tribal. Some folks who were granted tribal membership and have lived on tribal land all their lives because they were 1/16 or 1/32 tribal have been denied tribal membership so that the casino can share monies with fewer people. Corruption isn't just a white man's disease.

He's pointing out how the language has changed. American Indian, Native American, Indigenous People. He used the terminology that was used when he got his degree and when he was teaching. So, yeah, they don't call it that, but that's what it is.
He is probably alluding to the "euphemism merry-go-round". As PC shifts things get relabeled despite feelings if those being relabeled.
"Indian" was the first term used to distinguish Natives from Non Natives. They never needed a word for it before contact.
American Indian is used to prevent confusion with people from Deli.
Native American still has American in it, as does Amerid.
First Nation avoids having them named after India or an Italian explorer.
But all the renaming might be irritating to those who have been calling themselves Indian for centuries.

You'd be surprised, I've read of them taking up cases that were very stupid and even ruling on them and then on cases that were serious and they ignore them.
@@Suisfonia Courts of appeal generally don’t want to micromanage the decisions of the trial court, so it is pretty rare for them to accept an interlocutory appeal (that is, an appeal of a pre-trial decision of the court, such as whether to suppress a witness’s testimony).

Professor Bellfy is possibly a relevant "expert" on something he has been teaching for 40 years at various universities, and used in his law practice in the Chippewa courts.

I worked at a telecom company and one of our customers was a physical a few hours away, always insisting we called him 'doctor' before his name. "I spent the time to earn this degree I deserved to be addressed as such" was the entire issue. So we'd always call him 'mister' NAME just to annoy him since he was a nightmare of a customer

According to LinkedIn it's on the up and up, it states he has a Doctor of Philosophy (PhD) American Indian/Native American Studies and he is the Professor Emeritus of American Indian Studies at the same university. I didn't hear anything establish his expertise in modern legal matters, as he seems to be research focused but that's on the prosecution.
I have a bachelors degree in Psychology but it's not called that. It's Bachelor of Arts in the department of social science, something like that. After you graduate nobody cares what it's called, including me. :)

Based on what we heard today, it does sound sketchy. Does show the value of having the right assistance, qualified DUI attorney vs Ph.D expert in tribal law.

Dr. Bellfy is listed on both the Michigan State U and Northern Michigan U as professor emeritus and as an enrolled member of the White Earth Band of Minnesota Chippewa. His expertise doesn't seem to be directly related to the matter. He lectures on the history and experiences of indigenous people along the border and on environmental issues. I'm not sure how that applies to boating while impaired.

He wasn't testifying to drunk boating as this hearing was a motion to suppress. He was testifying that there exists a tribal treaty which brings legal jurisdiction into question, which IS directly relevant if his testimony is correct and the defendant is a member of a tribe which is a part of that treaty.
It isn’t relevant to the issue of whether he was boating while impaired. It is potentially relevant to the question of whether the officer had a right to stop him for having an expired registration, since the U.S. has allowed members of certain tribes to fish without needing a license or registration - but that exemption only applies while they are fishing. If he is boating but not fishing, he would still need a valid registration.
That being said, it’s pretty rare for courts to accept expert testimony on what the law is. I think the court was trying to accommodate a pro se defendant.
@@amicaaranearum Yes, a well-prepared prosecutor at trial may have his own legal briefs on the actual "law" on that issue, or it may come up in the interlocutory appeal process.

I don’t know what tribal law says, but the judge seem to accept what they were saying. The denial was that there was no probable cause for the stop.
The officer only needed reasonable suspicion, since it was just a _Terry_ stop at the time that he saw the expired registration. This is a pretty low standard, so it’s difficult to get evidence thrown out on the basis that the _Terry_ stop was unconstitutional.

In court, they lose sight of the fact, that an officer is going to impound your boat, transport you to a medical facility for a blood draw, basically jack your day up good! In theory, if the original reason for the encounter was not an actual violation (creating the necessary reasonable articulable suspicion,) due to treaties or the like, the remaining evidence may be excluded. It wasn't, for reasons explained.
An attorney would know he has to inform the court of his presence or whatever the term is. First thought, he just grabbed a home boy and brought him in as an "attorney". LOL
the term you may be looking for is "filing an appearance" on behalf of the client.

I’d be interested to see that video. I doubt six seconds tells the whole story. I wouldn’t have stipulated to it as the prosecutor without it being authenticated (I.e. a witness such as the defendant would have to take the stand and say that it was a fair and accurate depiction of what happened).
Seems like they'd need the bystander who took the video to testify as to its authenticity as well as its original length, noting any editing they may have taken place. Seems to me this was just a snippet and not the entire confrontation.

Yeah, I'm only halfway through and I haven't heard anything from the SovCit playbook yet. Maybe there's something from his previous appearances? So far, all I'm seeing is him somewhat challenging jurisdiction, but with a potentially effective argument if he'd had proper legal counsel.
@@PitifulDelay Yes, unlike some post-office frauditors who stupidly believe that local police can NEVER have arrest powers on federal property. Sure, it sometimes happens, and the trespassing case is dismissed in state court, but your lawyer might advise you not to get your hopes up.

The cop may be a newer officer with the DNR, but he seems like he must have prior experience and isn't new to testifying in court.
Yeah, DNR is a dream job as far as officers go, Can be hard for a rookie to get into. He probably had a good record as a correction officer or as a city cop

I feel like calling this guy an idiot is a bad move. The judge even said he is doing a good job.
The problem with his 6 sec video is we do not know what previously happened. He could have been resisting not on video and then he agreed to be handcuffed and did not resist.
Defendant is an idiot, but there is one point I've often seen that gripes me. The officer talks about cuffing while not complying - that is, not putting his arm behind him. Then he describes the situation as the officer pinning the guy to the ground with his other arm under him. So, with his arm pinned under him by the weight of two men, how can he possibly "comply"?

No, but the judge was going out of his way to be fair to a pro se defendant. I have no problem with that.
While pro se defendants are technically held to the same standards as attorneys, in practice, judges will often try to accommodate them as much as they can (within reason). They won’t give them legal advice or explain how to practice law, but they will often give some basic instructions on court rules or procedures.
