      Idk about that he took a plea to a lesser charge because his codefendant confessed to the murder not exonerating him as a person of interest seeing that he was there what did he have to do with the crime and I wouldn’t like to know what was the lesser charge he took.
      I still think he was somewhat responsible for that woman’s death but 42 years is a long time.
      He should be mad at the codefendant for waiting until 2016 to confess to the murder would’ve saved him a long time in prison

      BUT in this case, he wasn't exactly innocent. He was a co-conspirator in a crime that ended with that poor woman's death. So he himself didn't actually directly caused her death, but the actions of whatever crime that was being committed resulted in her death. Even HE felt he should 'n subsequent did plead to lesser charges (likely manslaughter) which is why he's being released as time served.

      ANNND what of that poor lady's life???? What if that were your mom? This man wasn't exactly innocent in this case. He was a co-conspirator in a crime that ended with that poor woman's death. So he himself didn't actually directly caused her death, but the actions of whatever crime that was being committed resulted in her death. Even HE felt he should 'n subsequent did plead to lesser charges (likely manslaughter) which is why he's being released as time served.

      @@Framer_Mike what America do you live in, just a few years ago a judge in NYC was found guilty of locking up men who didn't deserve the time he gave them.... turned out the judge was getting kick backs from prisons. Google it. The judge offed himself In jail when he was sentenced... once again Google it for yourself

      Imagine what is was like for the victim! His life was ruined by crooked cops and prosecutors, as has happened to untold millions of other people. The framing cops and prosecutors should have served his jail sentence!

      The man HAD to plea to the likely robbery counts and the manslaughter count from being involved in the crime to begin with. It's like this: if a person or persons actions result in the death of a person in a robbery, doesn't matter who pulls the trigger (or in this case, hit the victim with blunt trauma), the perps are goin' down for murder or manslaughter if they had no intentions on killing but the death occurred anyway.
      These guys were very young 'n dumb when the crime occurred 'n likely had some stupid pact to not snitch on each other. BUT the one who actually did kill the woman naturally got scared 'n he'd point the blame on his homey who he knew wouldn't snitch. Damn shame all the way 'round 'cos that lady lost her life 'n her family were 'n STILL ARE affected by her murder. Then these young men's families were affected as well.
      So no, the man plead guilty of the likely botched robbery that ended in murder 'n plead to manslaughter which when added up consecutively, was less than the 42 yrs he'd served which is why he'd got to walk out as time served. The State don't owe him a damn thing 'n he knows it. The man's just grateful that he's not dyin' inside that place 'n is given the opportunity to die at home with family 'bout him...something that poor lady wasn't given the opportunity to do ironically.

    Isn’t it called conspiracy, if me and co-defendant rob a store n the clerk gets killed we both get charged with murder even tho I didn’t pull the trigger. He is a free man not an innocent man.

      Correct but the thing here is the weapon used and the circumstances/manner that killed the woman.
      Assuming this was a botched robbery, it would get so many counts but the counts start adding up with the weaponry used: fist, knives, guns. The more violent the weapon, the higher the counts goes. Now couple this with how the woman died. Was she'd hit over the head or did she slip 'n fell resulting in blunt trauma to the head? If it was the former, then the murder charges would be something like 3rd but if it was the latter, then it'll likely be manslaughter charges.
      That said, adding up the counts of an assumed robbery with manslaughter/murder in the 3rd *, the man have likely served more than the maximum amount of yrs behind prison for both crimes consecutively.
      This is why he's being released as time served.

    Wow, 42 years for a murder he didn't do? I know it was said he was still involved somehow though he didn't actually do the murder, but the only reason that's shocking is because I've seen convicted murders that actually DID do the murder get lesser time than that, which makes me wonder what the original sentence was.

      His accomplice did the murder 'n had no problems LYING to the authorities in order to save his own skin. THAT mofo pointed his lyin' ass finger to his boy KNOWING they'd likely made a pact to never snitch on each other. Well, not only did this man's so-called friend snitch on him but he'd lied. The crime sounded like it was a robbery gone bad 'n the guy who killed the poor woman did so in haste.
      At any rate, whenever a crime such as a robbery goes wrong and there are subsequent deaths occurring (whether the deaths were done by the criminals or by friendly fired meaning the police), the person(s) responsible are charged with murder or manslaughter. This man pleading to what (who knows as the news did not disclosed what), but if it was manslaughter 'n robbery, then 42 yrs covered the sentence of both as time served. This is likely why the man has a positive outlook as he could've very easily served the rest of his natural life in prison.

      @@shanayacarriere926 Not quite! The law's quite clear regarding deaths of ppl from crimes committed.
      In cases of robberies (& this likely was a botched robbery gone wrong), any death(s) that occurs will be on the hands of the assailant(s) involved...no matter HOW the death(s) occur. So for example, if during a bank robbery a teller is shot by friendly fire (meaning the bank guard or police), then the assailant(s) is/are then charged with murder. The degree charges would depend on if the robberies are/were done with weapon(s) & if so, what type of weapon(s).
      In this case, the lady died from blunt force trauma to the head which could've occurred from a knock-out punch whereby she'd landed onto the ground, cracking her skull vs her being hit with a club, bottle, or bat. In any case, the lady lost her life over a petty thief. And as such, this man likely plead to the lesser charge of manslaughter as he had SOME culpability in her dyin'.

      This is true BUT, this man isn't innocent of the initial crime that ended in that poor woman's death. Don't forget she was murdered in what was a likely botched robbery gone wrong. The fact that the man plead to a lesser charge indicated that he felt he had SOME culpability which is why he was released with time served.

      That wasn't a mistake, but a lie. The co-conspirator of the likely botched robbery was the one who'd actually decided to kill the woman for who knows why. Maybe he was angry that she hadn't have 'enough' money on her? Maybe she'd cussed them out? Who knows but the point is the actually mofo that killed the poor lady LIED on his friend as he'd quickly flipped on him to get the lesser sentence while this man kept silent 'n didn't 'snitch' on the actual killer.

    I don't understand what any of this is about because we have many murder cases where the DA don't know who the shooter is but all 3 were involved in the case. This seem like one of those type cases. He wasn't in prison for something he didn't do based on what the reporter said.

      IDT he's seeking to get compensated for any monies. He's just thankful that he's not dyin' in prison hence his 'positive' attitude. Blame Fox 29 News for the click-bait title to the story. I knew something was off when the Asian anchor stated the man 'says' he's innocent of murdering the woman.
      This sounds more like a robbery gone wrong 'n this guy's co-conspirator took things too far.       The fact the DA's Office utilized one to convict the other in that case instead of charging them BOTH with the same charge would've resulted in a different conviction and subsequent sentencing. This sheds a negative light on that office and the police in this case 'n puts into question other cases prosecuted with convictions.

Couple the charges / counts he'd pleading to for the robbery and manslaughter and I'm sure he'd maxed-out on the maximum sentencing so having already serving 42 yrs behind bars is the reason why he's being released as time-served.

      The man is simply grateful to plea to lesser charges/counts in order to be released to enjoy whatever time on this earth WITH his family 'n to die with dignity in HIS own bed with family surrounding him. He understands that had they (he 'n his no good friend) had not of robbed this woman, she'd still be here today or at least would've been able to die in her own bed with her own family 'bout her.       This man was 100% innocent of the crimes for which he spent 40 years in prison. He was framed by criminal cops and prosecutors. He will not be "rich". He will likely receive compensation of about $10,000 for each of his 40 years of incarceration, based on amounts that Delco has paid similar framing victims. And we can only imagine the wrongs that you have done to be so high and mighty. 😪
