      If a self employed can't take outside work then that's not right. But that doesn't mean that people shouldn't be allowed to be self employed or that people that are self employed should be entitled to the benefits of a permanent worker.

    Bravo to the Supreme Court. He is a worker, he is not entitled to full rights but some rights, so as the employer you are still at an advantage. Suck it up. These are some of the things employers do to disadvantage workers. If he was self-employed, why was he promoting your brand and company in a marked vehicle and marked uniform. He should have been promoting his own business. It's a franchise situation you have him in, but you are controlling him. Wasn't it because he asked for his hours to be reduced and you sacked him? It suits the company because they do not have to pay the full package, no vacation, no sick leave, no insurance because that cuts costs for the primary company. A lot of people take these types of contracts because they have no choice, and others want the flexibility for various reasons, but it turned out to be to their disadvantage. Now this employer is playing the victim. Sick.

    If he still wants he's employees to have flexibility with working he should put them on flexi-time contracts not self-employed. This is just a massive tax loophole for him.

      What's is the problem of being self employed? You earn more money and in return you take full reasonability of your financial life, instead of having the company taking care of that for you. That means more freedom. I've been self employed all my life, working as a contractor in IT. Doctors do it, lawyers do it, any smart professional can do it if they have the skills, they get more control overall and can decide how to best sell their work and how to best invest their money.

    I'm not surprised the employee won. It's the terms and conditions they work under that determine whether people are self-employed or an employee. It's not whether the employer tells you whether you are or not. That's always been the case. Many people don't seem to realise that. This employer thinks bringing employment law into the 21st century means removing rights that people have fought for over the centuries. His mentality is like a 'modern' Victorian.

    I must say I am sympathetic to Mullins here. Smith was 'self-employed' for 6 years and now claims he was exploited? Why didn't he do anything before?

      He's not claiming he was exploited. He voluntarily chose the "self employed" route over PAYE, and greatly benefited from that choice. Now that he has fallen ill, he is trying to claim PAYE benefits as well, and so far the law seems to be siding with him.

    So this guy was self employed earning a lot more than PAYE workers, therefore he has to pay his own tax, NI, van, uniform, pension, holidays etc.
    That’s how it works.
    Pimlico just want him to be advertising there brand while sub contracting for them as it’s their customers the work is for and not his own.
    This is completely normal and I don’t see the issue at all.
    He is free to take days off to do his own work where he doesn’t have to represent Pimlico but obviously these days he receives no payment from Pimlico.
    It’s the exact same at my work, I’m PAYE but some guys choose to be self employed and get more money but no holiday or sick pay and no company van but still have to wear my company branded clothing when working for them.

    This is terrible, I make more money registered as self employed for many reasons, and the flexibility is something money can't buy, this will turn into a regulatory black hole. If I want a haircut do I need to employ the hairdresser as I am paying his wages???? Or do I need to employ a window cleaner because I want my windows cleaned once a week. This is absolutely ridiculous, do I need to employ a labourer if i only have a months work for him, or do I just not employ him??? This is the stuff that makes it harder for everybody, stifles competition and makes services from these sectors more expensive, this doesn't help at all

    Self Employment (Good) - make money on your own time. Set your own prices. Take as many days off (no pay for days off)
    (Not Good) - Need your own Vehicle , insurance and supplies. Have to buy Medical insurance on your own.
    Employed Person - Must follow a schedule , makes almost the same amount weekly. Between 20% lower or higher of there average pay. Have supplies given to them. Only take holidays off (some holidays) and sick days off. They have vehicle given to them for the job if needed. Also have medical insurance 🙂
    Of course I'm only 20 years old and I stil lhave to experience life a little more , but personally if your self employed you have to know what your doing and love it.
    That's the whole point of being self employed.

    This woman doesn’t understand a thing about business or the case she’s reporting on. The gentleman chose to work as self-employed rather than on the PAYE scheme as a normal employee because he wanted the benefits of flexibility and getting top dollar for his skills. Now he wants to come back and get more out of Pimlico. Makes no sense. I’m sure Charlie would’ve hired him as a normal employee as there’s a shortage of skilled workers anyways.

    what a horrible man taking the work from honest plumbers into his company pockets. company's like this should be illegal making it almost impossible for regular plumber to leave as their ads get all the attention. As they can spend millions on adds compared to your actual self employed trader.

    A lot of these businesses wouldn't exist if these workers had to be treated like a full time employee. Without the business, there is no job, and without a job these workers would be far worse off.

    i had the same problem in manchester, with a company. but i had the last laugh. i was given a vw van 2 years old.and i had my own van 7 years old same make .me and 3 freind took the engine out at weekend,and put it in my van, then monday i quit .my van is still going .

    Anyone who has their own business in the construction industry would understand Mullins. He looks after his workers which in turn allows them to put food on their tables and live good lives. I bet they still get paid on a Friday regardless of if Pimlico plumbers hasn’t been by their client. Taking that risk is why Mullins deserves to have done well.
    Try taking on 250 employees on PAYE contracts, it’s not the holiday pay and sick pay everyone witters on about it the fact Pimlico HAVE to have enough work each week to pay for them, offices, vans etc. The benefit with self employed staff for the company is as company workload fluctuates so can the workforce. The beauty for self employs worker -they command top money, far more than PAYE and if they are a a good quality worker will get work anywhere AND this is their choice let’s not forget.....if they are bad quality and are lazy they won’t......but then again these are the individuals complaining because they are scared of hard work and just want to latch on to someone else’s hard work (Pimlico plumbers/Mullins in this case) and get as much out of the employment or contract for doing as little as possible.

    I am a self employed joiner you can't get am employed job in new house build . I earn 18k a year if I am lucky it's a con . Employers should not be able to have the self employed working for them
