Does the design patent disclosing the movable strap not make such it prior art if the functionality of this strap has not been patented despite the fact that design is design and not utility? For example, if an invention Looks like a photo found online but that item in the photo does not come with description what it does only showing the Looks that is similar to the present invention, does that constitute prior art ? If so it shows that Design or Look can br prior art to a utility invention. I am not sure if you guys see my point? The grey area between design and utility prior art
Sure thing, but to the extent that structure and function are deeply inter-related, beit in nature or electronics (amongst other examples), I believe you can get away with just a design patent if you're low on money, and are very careful with the words used in your claim and the depiction of the drawing.
