I am an insurance agent. Unfortunately this type of situation is far to common. I strongly recommend that any time there is an accident to immediately turn your phone's camera to record and keep it going until you completely leave the scene. That way if someone changes their story you have proof of it. Please note, I am in a single party consent state as far as recording, make sure you are aware of your local laws before doing this. If you can't record take photos before moving a vehicle, I don't care if it appears to be incredibly minor and during rush hour traffic, take photos.
Yeah cause he knew if the accident was reported as his fault, his insurance would go way up. And if all parties have insurance, why not call the police for a report for the insurance companies. Defendant was crazy any, dragging his daughter in that summer dress in the cold into court.

Defendant probably told his insurance company the story right after the plaintiff left because he had no intention of paying damages out of his pocket. It makes perfect sense what plaintiff stated and defendant was trying to work angles into his story, he even brought his young daughter to stage sympathy. Glad judge seen right though his story.
I've bought and sold a lot of cars, and many people do leave old, expired documents in the glove box. It's almost irrelevant if he has current docs to show coverage. But, the way the defendant claimed his docs were expired as if it mattered, it seemed disingenuous and manipulative. The Insurance company never had an adjustor look at the cars, so it's irrelevant. Pictures and description: it's a tough call, but it could have easily been ruled 50/50 or denied. Insurance makes money by denying claims. When two people claim he accepted responsibility, that's solid, and they didn't seem to be lying. In California, if you called the cops for that, you'd still be waiting on the roadside. Not sure why the Defendant isn't just paying a deductible on his insurance unless he had liabilty only and no collision coverage.
Why the defendant would lie or fabricate a story instead of just admitting that the accident was his fault is ridiculous, given that his daughter was in court with him.

I find that these judges after hearing years of stories can become hard of heart and maybe even bored by them. They go after the low hanging fruit to be done.
What causes a car to fishtail: too fast, bad tire traction, careless driving, severe sudden unpredictable weather (like a hurricane wind), earthquake, or an alien tractor beam perhaps. The defendant is the definition of "people suck". It was not the plaintiff's fault 100%. Less than human conduct for the sake of money. Bad juju as JM always says.

Defendant over-arced his turn into the oncoming lane and struck the plaintiff, that's pretty clear to anyone who's sane. The theatrics and hands in pockets while he's trying to overdramatize what happened indicate to me he's embellishing his story to put himself in a more favorable light, when he just screwed up and he doesn't want to own that. Regarding the registration and insurance paperwork, I probably have a dozen insurance cards in my glovebox - I do the same thing and throw the new one on top of the old one. Maybe in a perfect world we'd all pull the old one out and throw it away, but it's not a big deal in the big scheme of life. He has coverage and it's easily verifiable. He might have handed him the wrong one and that DOESN'T mean he didn't have current coverage.
The plaintiff was holding this in for a long time, he didn't tell a long, sad story, he went straight to action. By the way, why keep the little girl there if you're going to rip into her dad, JJ would've had the little girl wait outside, just more respectable.
The defendant brought a young girl to court for "Oh poor me" visuals. He obviously is a "liar" & should have his drivers license revoked & the child go to a foster home so she does not grow up with a "Liar" an an adult example. Some people never grow up to be responsible adults. They just look older.
Judge Milan its important to keep all your old insurance cards, I switched insurance companies and the company that I left didn't do their job and report my paid insurance, when I went to the new company they said I had not paid insurance previously, I went out to my vehicle and brought in the past 7 years of insurance cards showing i had FULL COVERAGE that I had been paying.......without that proof my insurance would've been outrageous! Thats why Judge Milan you SHOULD KEEP your old information!!
