None of the NJs demands given were enforceable and in a sense can be considered as provocation or setting up the other party (ADOR) to failure as NewJeans worded their demands as all or nothing. Here is a summary of their demands: 1. An official apology from Ador/Hybe -Nonsense 2. Revealing identities of individuals from bullying cases and whoever said they want to abandon NJ. -The court will not allow another form of injustice to happen. NewJeans basically wants to name and shame the manager without due process. The judge will not agree with this by breaking another law. 3. Pursue civil and criminal actions against them and anyone trying to embezzle from them, and give NJ an audit report of all of these people. -It's MHJ who is being investigated for embezzlement 4. Remove trainee videos published without their consent. -It wasn't HYBE/ADOR who released the published video. They already requested the publications to take it down. It's not up to HYBE/ADOR to scrub it off of the internet. 5. Assess damages done to them from their activities being put on hiatus. -They were not put on hiatus. The fact that they are still attending the activities laid out to them saying they are doing it against their will counters this claim. Even now that they unilaterally declared their "independence" but enjoying resources and even attended the Dior event the other day defeats this argument of theirs. 6. Resolve issues with the MV director. -This director as well as #7 MinHiJin or any other staff are inconsequential. No contract will ever state that there are permanent management figures that will be provided. The court also has no control over as to how a corporation would handle their management/staffing. It's a matter that is in full control by the board. Any kind of employee will not have a say on this. 7. Reinstatement of mhj as ceo- See #6. And basically, you are right. Through her first injuction, MHJ established that Ador and Hybe are not the same entity so she is walking into her own trap now.
Well said. I thought about doing a video breaking down the points like this but you summed it up perfectly. I also did not think of the provocation point you made, and how ADOR was set up to fail. I wonder if that logic would hold up in court
@@CapitalVictimsNJ knew ADOR won't be able to reinstate MHJ as they were aware of her plans, including the advice the Davolink Chairman gave to her. The Chairman told her to leave ADOR in order to tank its value. Thinking about it, they basically gave Ador demands that they can't fulfill just to justify their contract termination.
I watched a video of a Lawyer (and New Jeans fan) going over all the points they used as reasons they were "terminating" their exclusive contract with Ador. Like you, he broke them down patently, and succinctly, one by one. His conclusion was - New Jeans had no legal grounds to terminate the contract; and they should really get back to work. He also concluded they were getting very poor legal advice (probably by MHJ's lawyers - and he's NOT a fan of hers); and whoever gave it does not seem to have their best interests at heart.
Another reason MHJ won the first injunction is because hybe literally gave her a clause in the contract which stated that hybe had to vote for her to remain CEO for 5 years at any extraordinary shareholders meeting (which is wild). So ultimately the judge ruled that they couldn't vote her out using their 80% voting rights. Hybe had to take the L on that one and find a loophole.
I find it funny how the bunnies are so focused on the fact that she won this one lawsuit, but they completely ignore the fact that there is thousands of pieces of evidence that prove the nonsense she made up and that she lied and cheated, just like her wonderful daughters do.🤦♀️🤦♀️🤦♀️😂😂😂😂😂
i think i head a similar case where the judge said it was to inhumane to let them stay if they wanted to leave, but if they wanted to still work independently or with another label until the court case (around 2 years) they could do so, BUT they had to pay a certain % of their earnings to the label. could this be something they could do? also Ador should also do something about the name they have. it will cause confusing people might think it´s only a spelling error
That will only set precedence for future artist tampering in the industry and loss of investor trust though. If the judge is going to say now anyone can tamper with artists, make up lies for public opinion to intimidate agencies & find loopholes in the contract and you will be free to go independent as long as you pay a small minimal percentage to your agency in such an obvious case of scheming & tampering, what future does kpop have really or the future of trainees of small agencies who don’t even have assurance of ever debuting in the first place? That’s the main reason Ador is asking time and again for support
Yes, what you're saying is very possible. I wonder if ADOR will have to return those earnings if NewJeans win the larger case though... It's very messy
Thank you for this. It is good to remind people of the whole point of an injunction. A lot of NJ's and MHJ's fans seem to be missing the point. And no matter which way the injunctions go (and it's honestly hard to see Ador losing), there are still the main court cases ahead.
I like the way you present arguments with clarity and how you speak with very courteous vocabulary. Other channels covering the topic simply insult members, bunnies or even MHJ. While I don’t support what MHJ and NJs are doing, I don’t condone lacking respect towards them nor any of their supporters. They may stoop low but it’s not a reason to do the same, it just cheapens the arguments. Logic and courtesy are very much appreciated in your content.
Thank you very much! I really try to avoid harsh language against the NewJeans members especially, because I actually started as a fan (and still kind of am). I don't condone what they and Min Heejin have done, but I also see them as victims of grooming. I think objectivity and accountability are SEVERELY lacking in the kpop world
Honestly, instead of acting like spoiled little children who get what they want, they should pay the fees. And then they could just leave instead of causing a drama and carry on making music legally and signing with a label etc.🤦♀️🤦♀️🤦♀️🤦♀️
I fear that, sooner or later, the truth will come to light. Whether the girls are merely playing a game of who can outsmart the other by manipulating their fans, or if the company is truly to blame for the disrespect towards the girl-rather than it being a misunderstanding or even a result of her own actions.

Looked up the approval rate of this type of injuction and let’s just say I hope Ador has some really good arguments against NewJeans side it’s not commonly approved at all but what NewJeans is doing is kinda unprecedented so maybe the judge can sympathize with Ador
@@CapitalVictims now that I think of it this was for activity I guess Ador’s lawsuit is different and kinda unprecedented never seen one for just advertising
one argument I think NewJeans will use is the fact that Ador can claim penalties in the end of all independent ventures if they win the validity contract portraying Ador’s harm as reversible but if NewJeans wins years later they would have already been harmed too much with financial loss career loss time and opportunities remember the main focus of the judge in these cases is who can prove they are harmed more
Right but ADOR actually tried to flip this argument, because having to pay skyhigh penalties due to lack of clarity is actually harmful to the girls. These penalties would not only come from NewJeans, but also the brands they plan to work with in the interim which broadens the scope of harm to third parties. ADOR made it clear they have multiple sponsorship offers ready to go and plan to fully support NewJeans activities in this way. They even have an album and world tour planned, but this injunction is related to brand deals. If NewJeans are worried about losing out on career opportunities, ADOR seemed prepared to prove they're capable of fulfilling this

It has to be granted if it’s not granted you’re basically asking Ador to be walked all over for possibly years until a conclusion I can see how NewJeans could argue their harm as well though it’s really up in the air imo
HYBE effectively took over ADOR's board of directors, by removing two board members, and replacing them with three who are loyal to HYBE. This includes the new CEO, Kim Ju-Young. Then ADOR's board of directors voted to remove MHJ as CEO of ADOR. It may be difficult now for ADOR to argue that they're separate from HYBE.
Yeah thats also true but its difficult to argue with the current precedent because HYBE literally owns 80% of ADOR. That alone should have made the entities closely linked in yhe first injunction but a court still ruled they're separate... So I don't see them changing just because two board members were switched. That would be very wishy washy, but then again, anything is possible in SK court
@CapitalVictims Also, I originally thought that the court's ruling on the validity of NewJeans' contract would happen quickly. But I've read recently that it could be months, or years. So, it appears that NewJeans are effectively finished as a group. Any word on that?
South Korean courts are very big on artist fairness instead of business interests on cases like this if you look up previous rulings they focus on harm the most and kinda side with the artist instantly until convinced not if NewJeans can prove that an injunction will harm them more than Ador it will probably be rejected
South Korean courts don't even let artists who are literally being starved and overworked out of their contracts very easily, so I definitely think ADOR is the more likely winner. It's hard to say without hearing from NewJeans side though
@@CapitalVictimsI’m just saying a lot of injunctions like this is rejected because of the fair trade commission it’s different from a main case but yeah it all depends what arguments NewJeans side come with
