    UPDATE:
    Nearly a decade after a Philadelphia family launched a lawsuit to save their home from the city’s abusive forfeiture program, the case ends with reforms in place to protect property owners and compensation paid out to victims of the city’s forfeiture machine.
    The funds which could not be given back to individuals will be going to help those communities in Philadelphia most harmed by these practices.

    This is more than revenue generation; it's theft. Stealing a house has nothing to do with punishing a drug offender who doesn't even own the house.

      These unjust laws should not have been allowed in our lands in the first place,
      Senators and DA office must be held liable for making & supporting any laws that violates the constitution. They are allowed to steall without impunity.
      & if & when these laws go away then the injustice already perpetrated against thousands will never be compensated

    I sincerely hope that this is being argued before the Supreme Court for the abolishment of Civil Forfeiture across the country. Civil Forfeiture turns Law Enforcement into armed thieves with a badge more interested in profits instead of justice.

    This is precisely why the founding fathers worked hard to create and ingrain basic constitutional concepts to protect the people from the power of the state. They knew that, eventually, there would be unscrupulous people in positions of governmental authority. People who would use their authority to abuse citizens for their own gain. These are the kind of people who come up with these types of laws. A clear violation of U.S. code Title 18 sections 241 and 242, any way you spin it.

    While the idea of winning a lawsuit is good, the root of the problem is the individuals involved. Administrators, police and city council members MUST go to jail over these types of actions.

    This may help. A precedent I could remember from my (abortive) English law studies was Dimes v Grand Junction Canal (1819), when a civil judgement was voided on the grounds that the Judge was a shareholder in a canal company. It's an English case of course, but there is such a thing as persuasive precedent.

    These victims had their house taken because their son had a small amount of heroine.
    The son was arrested and that’s when the cops made the move to take the house, too.
    The way it used to work was: you’d be arrested for possession and taken to jail.
    The mom and dad would be upset and would have to bail him/her out and return home for a trial date. That’s it.

    It is no different than the police charging innocent people with crimes 2 and 3 charges forcing them into litigation at the arraignment they give them the opportunity under duress and through intimidation to plead down to something they never did in the first place this is racketeering I have the recording with the police officer Lieutenant Harrison Easley South Carolina where he admits this that they push and push and push these charges because they think they think that the person did these crimes even though they have no evidence whatsoever they push and push through the courts intimidating them forcing them to get lawyer forcing them into the courts and this is explained to the accused this is the same thing as civil forfeiture only it's done under the color of law

    I think you will find that one of your son's so called friends ratted him off for a reduced sentence. It seems that would give the informant a real good reason to plant drugs somewhere in the house. That way they don't have to waste a lot of time searching the house.

      Nope the cops watched the $40 drug sell and followed him home... Seizing $40 is not worth it... I watched two cops let drug smuggler's go so they could seize the half a million they were carrying instead of arresting them... Which would have cause for the money to be eventually sent elsewhere...

    My neighbor won 13 mill in the state lottery . The state took it because while he was away on vacation his son was partyin with drugs in his home . Just a little pot was their

    How civil forfeiture became law throws the consitution in the trash bin of history. The fact that the citizens sit idly by and watch politicans ignore the consitution bewilders me the founding fathers bought about the consitution to protect all citizens from such vile laws as civil forfeiture the consitution cannot be superceded nor watered down. Those that wilfully disregard the constitution when framing laws are ineffect committing treason. Yet the average citizen is content to be a spectator and allow tyrants to steal other citizens property and destroy citizens lives. If individuals believe civil forfeiture only applies to criminals then those individuals are deluded. A person does not have to convicted of a crime to have their property stolen by the state suspicion is the bench mark.
