Joe Smyth reenacts Don Dunphy shooting

  • A few days after he fatally shot Don Dunphy, RNC Constable Joe Smyth returned to the Dunphy home with RCMP investigators and reenacted his version of events. This recording of that reenactment was played during the inquiry into Dunphy's death.

    No fingerprints were found on Dunphy's rifle, think about that.

    Everything he says sounds rehearsed, too much of the wrong detail is remembered. Cops always say they can hear and see you lying, us too.

    Shame Paul Davis.....you know Don dunphy wasent a threat ....but you said publicly different ....Shame.....you or your family were never in jeopardy...and you know it.

    I don't believe Smyth for a second when says that Dunphy did not react to being hit by the first three shots, Dunphy was elderly & partly disabled due to his work injuries, so when Smyth says that Dunphy powered through those three shots & continued aiming the rifle at him even after the first, second & third shots is just bullsh*t, this guy came over to Dunphy's house looking to start trouble, he must have antagonize Dunphy to get him to react & then killed him.

    The story doesn't add up at all. He's talking nonsense, every word is a lie. Sounds like the usual response of a police officer shooting someone unjustified: "I feared for my life".

    From where he was stood how could he not have seen a 38" rifle either on floor or leaning against the wall ?

      This is one of the questions I had watching the reenactment. You'd think he would have noticed it upon entering the room.

      Punk! It takes time to grab a rifle. He could have closed the distance and disarmed the disabled man very quickly. Speaking from experience in disarming.

    In a previous cross-examination he said the first time he saw the rifle it was pointing at him. Here he says he saw the deceased pull the rifle round from his RHS and bring it to point at him. ??

    Im still waiting for officer safety. Even after the video. Didn't lose sleep.

    So so very sickeming to witness this, he killed an elderly disabled man who was sitting in his chair, sickening, the story about how it all happened is full of holes.

    poor don dunphy was just a poor injured worker that was made out to be a bad person buy the workers compensation board of newfoundland and labrador and the rmcp. he was only fighting for what was his , the compensation for his injuries !! that because the compensation board of newfoundland has taken everything for him that e ever worked for . they have taken away all his pride , dignity , self respect , integrity dignity , and the last of all they take away his money that he supposed to be entitled to for his work injury !! this is what the these people will do and what they are currently doing all injured workers of this province . they have done it to me
    they will take a injured worker and push them to the limits , prevent any injury worker for getting a proper medical diagnosis in this province . the worker compensation medical consultants and caseworkers will convince your family doctor and specials to deny you any medical treatment. medical examination , mri & ect that will provide u any truth to your work injury . they will try to make u out to be a liar and a fake by using their medical system. therefore u cant get any medical treatment or diagnosis to back up your theory the u were injured u at work.
    the compensation system has this system down to a science. it has proven to work well against injured workers in the province.
    that poor old don dumply was only fighting for what was his , just because he threatened some one in the government he gets killed , but the government of nl can nl can do all the above and it all right and a illegal to the law but it not . but it is as long as no one know what they are doing , because it all done behind closed door.
    what a a well perfected and brilliant compensation system to get rid of injured workers, who would ever know . but i guess don dumphy knew something too because the government of nl had to shoot him to keep him quiet!!

    I am afraid after seeing ,hearing, and reading all the information I would have to agree with the majority of people on this incident. At least from my perspective this constable did in fact commit murder and then had help covering it up. I cannot believe that Mr.Dunphy would pull a .22 rifle and point it at a fully protected and armed constable in his tiny living room as far as I'm concerned the rifle was a plant and the constable is lying like a rug! This whole case stinks to high heaven. I truly feel sorry for Mr.Dunphy's family and in this case justice was not done.

    Notice how he tries to explain fully but trips up and mixes up the story with his emotions and how he felt and sounds and looks really nervous, an honest person would feel comfortable with explaining this I think, and the fact that he seems to have trouble remembering exactly because it “happened so fast” is fishy, the fact that he was found in his chair dead and the rifle was standing up against the bin when they showed up shows that Dunphy couldn’t of been that much of a threat, looks like a cover up to me, cops always try to justify murder with “I felt threatened” mentality which stems from the irrational anger from the cop, he didn’t know how to have a level head going into it, for whatever reason that he had to be there, and I’m sure Dunphy probably had a word or two with the officer but that doesn’t justify violence or murder, hope this officer gets his day in prison and gets help for whatever mental illness he has, that’s pure psychotic or something if you can manipulate and coerce the court system and justify murder, officers need to be held accountable just like civilians

      Well..well..well..lets get some facts straight. Smyth went to the guy's house to establish the extent and intent of his hatred towards public officials. A calm rational person would discuss his dissatisfaction with the officer who would then understand how much of a threat he is to the public official. No one can make threats without ramifications. It was obvious the potential offender was acting emotionally (being uptight,restless,calling Smyth a government puppet). All imflammatory actions or comments further justifying Smyth's belief that he was unstable and indeed a threat to public officials. This was Not the reason for being shot however. The reason for him being shot was the fact he pointed the rifle at him. It's just natural to use equal force to protect your self. The firearm was found lying by the dead man's side not standing up. Watch the female medic's testimony. She stepped over it to establish that he was dead. So establishbthe facts before you mislead readers and misrepresent the facts. Watch the whole case with all witnesses and cross examination before commenting again. Dead men dont have rifle's by their side. There was no shooting in cold blood here. Get your facts straight before commenting.

    I wanna know what he said just before this video clip started, because it would be very important information. All we see here is that he's reacting to being under the assumption he's about to be shot at.

      He came to the house to talk about his tweets and the old man thought it was a smart move to pull a rifle on the police officer which in any other situation will end up with the officer justifiably shooting the man but in this situation, people don't agree because it was in his own home.
      Why the location makes any difference is beyond me.
      You pull a gun on an armed police officer and you signed your death warrant.
      That's America for you.
      If you want guns everywhere then expect situations to be solved with them...

    I think that its great to have an opinion on this happening but we must never lose respect for the law. I aree that sometimes we only see the person or uniform and then react. A strong nation is built upon justice (abraham Lincoln) . I feel sadness about what happened but we are only human and must beleive in each other!. Thankyou

      listen to his testimony on the visit its self, he had no legal grounds to belive a threat existed, he entered a building un announced and was suprised and scared when a scared home owner pulled a gun on him... this guy is a criminal regardless of dunphys choices

    This officer is an incredibly articulate and intelligent man. Performed brilliantly under cross examination. This officer attended his home with the intention of establishing the degree and extent and intent of his threat to government. The purpose is to diminish the potential extremely of threat to a public official(s). The officer is well within his right to shoot a potential offender if his life is being threatened. Pointing a rifle at him at close range is well and truly one of those situations especially from an emotional irrational individual who believes he is a government puppet. Most of this commentary is complete utter rubbish. Watch the testimony carefully first before writing your thoughts on this case.
    Police have to deal with irrational unstable threatening individuals on a daily basis and often lose their lives through no fault of their own. Just trying to uphold the law. That's their job. Most of the time police are very respectful to the public. It is more of a case of the public reacting hostily towards them than the opposite. This case is a prime example of that. If this case was dealt with calmly and rationally,in most likelihood this situation result wouldnt have happened.
    This is an example for the public to understand. First obey the law (don't tweet inflammatory comments which often predicate violence),act calmly and respectfully,use Common sense and act in a rational manner. I see nothing in Smyth's action that indicated irrationality on his part. Only on the offenders part. Pointing a loaded rifle at a public officer especially a police officer is always going to be a probable disaster as was the case here. There is a lesson here for the public. Act rationally and calmly and you will most likely get a far better outcome.
