arguably the bbc may be above certain things as they are a uk company also one point i've found if you blur the claimed part that can kick the claim as the copyright content is not in the video any more BUT your voiceover is still there
It’s funny because the BBC still let users like Nerdrotic trash the show and constantly calling it “woke” (makes you wonder what will actually please this idiots). That channel just showed up recently for me, and the tone of the video title was suspect (channel name ain't great either), but I try to be a little more open minded than that. That said, the video was long and the intro started out vague in tone, so I scanned the comments instead. And that told me all I needed to know. I could have saved even more time with Ctrl+F "woke."

I'm sorry you had to go through all this BS. As someone who has been dealing with BBC Content ID BS for over 10 years (I obviously use way more footage of the episodes than you, so it comes with the territory) I've found the BBC in recent years to be so spiteful and scorched earth with their copyright on RUclips. This isn't helped by their Content ID library also being mis-labelled. In my recent review of 'The Tenth Planet', it was claimed as footage from 'The Green Death'. When I disputed the claim and said that 'The Green Death' doesn't appear at all in the review...they upheld the claim. Stuff like that are clear breaches of RUclips's ToS, but I've been in private chats with RUclips bosses about this issue and they just do not care. Sorry they messed you around so much here. My DMs are always open if you need any help dealing with the BBC and Content ID. I like to think I've become a "Fair Use" professional after all this time.
You won an appeal on YT? That'a rarity in itself. Congratulations, even though it's too late to make much difference for you. It's worth stating that many of the comments saying it was your disclaimer causing the issue, were because it was believed to be a manual claim. If it had been a bot from the start I feel it would have been seen differently, including by myself.
I doubt the disclaimer was a factor, but I wouldn't put much stock in the idea that going this long without issue proves it wasn't. There's no reason it couldn't have been only recently discovered by someone with influence who then took offense and chose violence.

That the bots had ignored it but an actual person saw it, took offense and copyright abuse was the only way they could do anything. Obviously that changes when it's a bot and not a person but we could only go off what info we had at the time. 🙂
I’ll take a mea culpa here. I was one of those people who blamed the disclaimer (that BBC was butt-hurt by the disclaimer and acted out of spite). I was wrong. I think I saw it within the first couple hours it was up. I'm already subscribed here, and I've been watching a fair bit of Dr Who content, so I guess Vera's new vid on the hot new Dr Who episode comes up quite high for me on the algorithm. I see the video is now back, with all comments attached. I also saw a review of the Star Beast from someone else I subscribe to who I had no idea was actually a Dr Who fan!
I relate to you so much on this. It's infuriating! In 2018, I had a BBC video go semi viral and then the BBC claimed it for no reason. I tried to get it back but it was an instant strike. They then randomly began copyright claiming the majority of my BBC videos, with loads of different shows to the point where I was on 2 strikes and couldn't risk anymore. So I had to delete every BBC video and have only since the pandemic restarted them. It's such a bad system!
Wow. Aside from the fact that you're totally right as far as fair use, it was one of the few positive reviews of the show that I saw. So they're kind of shooting themselves in the food, aren't they?

@@iancuneo1820 Legally, they can't take things down just because they don't like them. It's part of the freedom of the press in the US. You make something and put it out in public, you have to put up with negative public comments about it. What they're taking down is people who steal their content. And yes, even a critic could potentially have stolen content. You see "reactors" all the time who just watch whole shows and barely say anything. That's stealing and a violation of copyright laws. But boy did they screw up here. They accused Vera of using content that she didn't use, and then tried to claim her own image as part of the episode that, again, has not yet aired. And she was largely on their side.
@@R.senals_Arsenal I tend to largely agree with the negative press on this one due to storytelling deficiencies. and some bad ideas (I really don't like that they used the name Rose, for example as this feels more like a stolen identity and I don't like association for a trans character, for example). I came over here and got to watch the initial review because I just wanted to see a GLBT perspective. And while I thought Vera was too kind, I still think she should be paid for her work and not lose her income because of an improper claim. I''m very glad she won her appeal.

My wife and I loved the episode, btw, though I have the same issue as Vera on "are they female or nonbinary?" As for the stolen ID... I don't get that really, lots of people have the same name. Rose is pretty common. Yeah, there is a story reason for it now, but still, anyone can call themselves what they want.

The annoying part is that most "recommended" reviews of the starbeast are by outrage merchants and instead, RUclips punishes one of the only reviewers in my doctor who feed who knows how reviews work
In the USA we are only a month away from an even numbered election year. One of our major POTUS contenders from time to time over the next year is going to be inside 4 or 5 courthouses in at least 3 or 4 different states. The toxic trolls who whip out a pre-filmed RUclips within minutes or hours of a program clearly have a bias... and a political affiliation. If RUclips is placing their propaganda missives above the "from the heart" RUclipss by the true~fans who have only a few dedicated sponsors... this is highly unfair. I have been looking at and liking these RUclipss BECAUSE i can sense something genuine that has much less slickness to it. Fans are not cookie-cutter copies of each other, but paid propagandists often have a most similar pitch. CAN WE SAY "ASTRO-TURF" VERSES GRASSROOTS? Often, people have held back several years from an opine, or being rather opinionated! The more dedicated fans are picking up on things i tend to miss....

My reaction to the Star Beast was flagged as copyrighted material from The Giggle, which has not been released and I have edited my reaction down and it still gets copyrighted as The Giggle But the copyrighted section is not the title sequence, it was actually the section of The Meep talking about "The Boss" that was copyrighted as from The Giggle
I have disputed the claim but they have upheld that the footage of The Meep talking about The Boss IS footage from The Giggle and if I used the YT trim option it takes out everything but me saying hello and goodbye essentially, I am unsure about appealing because it could end with a strike on my channel and as a reaction channel that's one of the things I'm scared of getting because it could result in me losing the channel and having to start over
As you said in your video, the momentum is gone, it did make one right winger come in my comment section call me a N*z* because I had a sign about the freedom of Gaza and Palestine but he quickly deleted those comments and the video was re-blocked, so I think I hit the maximum views it would have hit since it was released 48 hrs after the episode ended, but no matter how much I edited the video the copyright kept saying it was all from The Giggle, so it seems the entire episode is in The Giggle as a recap because it keeps choosing random sections to copyright wrongly as another episode

I swear BBC content ID has gotten so much more aggressive lately. Always autoblocks. I don't have this problem with any other show I talk about, its JUST Doctor Who. There are other reasons but this one's part of why I don't talk about it that much anymore cause its just a headache to get a video up these days. With the exception of a video about An Unearthly Child I did recently which would just be funny if it got blocked because of a match "owned by BBC worldwide"
DISNEY has had an incredible string of flops over the past year... when THE STAR BEAST got onto Disney+ globally.... it came in 2nd or 3rd country by country. DISNEY is desperate for good news.... and they are waging a HOLY CRUSADE against any & all forms of piracy.... i think BOB IGER talked the good folks at the BEEB into being as strict. People were dropping Disney+ over the past year. If this partnership with the BBC continues, and DR WHO goes onto Disney+ on a regular basis.... it helps out DISNEY.
Well that was stupid and unfair, I'm sorry this happened to you, unless of course this is an overcomplicated superplan you've developed in order to hide the fact that you'll be appearing as a special Guest Star in the Giggle (all jokes aside I really am sorry and you deserve better).
My own experience with disputing copyright claims on YT has been a little different: the copyright claim holder does have 30 days to respond, but YT releases the video for view after 48 hours, perhaps in recognition of copyright holders' tendencies to drag their feet. The clock is still ticking on their claim, however, and they can still reject my dispute, at which point we move on to the next steps you described. Most of the time, though, they either approve the video, or else they simply run out the clock, the claim expires, and everybody goes about their business. Is this new on YT's part, or am I lucking out because mine is still a relatively small channel (in which case I'm for once actually thankful for the algorithm sailing past me on a regular basis)?
It’s been a while since I’ve had a dispute and it didn’t resolve immediately so the 48 hour thing may be “new” since last time I had a copyright holder wait out a he clock but that would still make it years old.
Great now this is going to get claimed too. Not by the BBC for any DW footage, but by Fox News because “Voltron of Bullsh*t” is the copyrighted tag line for The Five.
The BBC itself probably wasn't involved at any stage of this. A department of the Beeb's legal team outsources to a social media interaction firm who in turn employ freelancer techies to run algorithms to police BBC content. Sadly this layers deep entrenchment of "Computer Says No" decision making is becoming a norm across society.

hey, as a content creator I thought i would let you know a few things! you should not worry too much about a strike, youtube changed their system now so they give a warning and then 3 strikes and now you can now actually appeal or do a "course" basicly a few basic questions to get that warning removed as long as you do not violate the same guidline a second time within say 90 days!! I am not too sure if you are aware of this and if not hopefully it does help in some way :)

All the big media companies protect their copyright. They have to. The problem here is that RUclips's systems are rubbish, and the BBC's copyright team go to far sometimes. The law is pretty harsh too.
yes, I’m torn. Given that the BBC is basically tax payer funded (‘licence fee’ is just a tax by another name) I’m a lot less mad at the BBC protecting its copyright and therefore public funds than a big private company protecting their profits. But they do go hard in a way that harms small creators and suppresses content that would boost interest in their programmes, particularly when they do it on older footage that could actually bring in a new audience for those shows and very clearly short, fair use footage like this.

I'm sorry that your video was flagged and happy that it is back. Yours was one of the few positive and decent reviews I have seen. I have deleted a ridiculous number of negative and derogatory views from my home page in the past few days. Sadly, I see it only getting worse through the next two specials and when Ncuti takes over. Instead of footage, a possible alternative could be still photos. Surely the BBC wouldn't get all pissy about that.

Rather than use clips how about stills or better yet stick drawings which will probably make everyone laugh and further highlight the absurdity of it all and still add a dimension to your review. What is really annoying about automatized responses and the official bots of RUclips is how usually there is no way for content creators to contact real human operators and try to explain unfair demonetization/blocking problems. And worse, the system for disputing/appealing copyright claims is designed in a way in order to intimidate creators and they do not push that forward, even when they are actually breaking no copyright infringements. It is just another example of corporate bullsh*t!
Not sure if it would be same on RUclips but i know on tik tok people speed up clips...some people even invert them to avoid the copy right, even if you wanted to play it safe you might still able to use the audio might be harder to detect

Thank you for bringing up that fair use is a legal defense and not a protection against copyright claims. I've brought this up in a video I did on copyright-and while I get *WHY* RUclipsrs frame it like this because in their eyes all that matters is they put a dispute in and it was lifted and they don't really have to look into it further-it gives their audiences and the misguided impression it's a way to stop any copyright claims at all and that's not 100% accurate so it's great to hear dispelling of this for many reasons even the petty ass one that it's a huge bugbear of mine lol Sorry you had to put up with so much bullshit from YT's terrible bot detection system even with the video popping back up -I really enjoyed your review and your work should have been treated better

Thanks for sharing the info on this. Might be good for you to vent but it's good for all of us when you take the time to explain this kind of thing. Don't want to step on your creative vision, it's your channel, but what if the clips were in a picture in a picture over your shoulder? The algorithm can't detect that and it means there's no case at all for unfair use.
Most of the RUclips reviews and reactions I’ve seen have been positive but I don’t swim in the underbelly of the internet. And BBCs highest rated drama of 2023… the outrage channels can bite it. Frankly they don’t even belong in this fandom if they missed the message of tolerance and embracing the best of humanity that the program has always embraced.
You're lucky. I, and likely most fans, don't even search up that hate-bait content but the algorithm pushes it so unbelievably hard. I've literally clicked the "Do not recommend this channel to me" button on dozens of those channels, and yet their videos STILL get shoved in my face. Hopefully you continue to avoid them.
Same, I must have done a good job of curating my algorithm as I’ve only had one of those foaming at mouth about woke SJWs reviews recommended among lots of neutral to positive reviews and reaction watches and a heap of Meep related content (which I’m not mad at). It is a reminder how fragmented and personalised the online experience is these days. Lots of the outrage watchers are probably genuinely unaware that lots of of people loved or liked it as they’re just not being shown those recommendations.
The BBC should be thankful for your analysis. Without it I'd not have returned to the show, and I doubt I'm alone. I got tired of the meandering plots, inconsistencies in tone, and sense of not knowing whether or not I was even going to be entertained. Bringing in production-side context demystifies that context and at least gives me a sense of when I'm liable to actually be interested in the show.

That the bots had ignored it but an actual person saw it, took offense and copyright abuse was the only way they could do anything. Obviously that changes when it's a bot and not a person but we could only go off what info we had at the time. 🙂

I think I saw it within the first couple hours it was up. I'm already subscribed here, and I've been watching a fair bit of Dr Who content, so I guess Vera's new vid on the hot new Dr Who episode comes up quite high for me on the algorithm. I see the video is now back, with all comments attached. I also saw a review of the Star Beast from someone else I subscribe to who I had no idea was actually a Dr Who fan!
I relate to you so much on this. It's infuriating! In 2018, I had a BBC video go semi viral and then the BBC claimed it for no reason. I tried to get it back but it was an instant strike. They then randomly began copyright claiming the majority of my BBC videos, with loads of different shows to the point where I was on 2 strikes and couldn't risk anymore. So I had to delete every BBC video and have only since the pandemic restarted them. It's such a bad system!

@@iancuneo1820 Legally, they can't take things down just because they don't like them. It's part of the freedom of the press in the US. You make something and put it out in public, you have to put up with negative public comments about it.
What they're taking down is people who steal their content. And yes, even a critic could potentially have stolen content. You see "reactors" all the time who just watch whole shows and barely say anything. That's stealing and a violation of copyright laws.
But boy did they screw up here. They accused Vera of using content that she didn't use, and then tried to claim her own image as part of the episode that, again, has not yet aired. And she was largely on their side.
@@R.senals_Arsenal I tend to largely agree with the negative press on this one due to storytelling deficiencies. and some bad ideas (I really don't like that they used the name Rose, for example as this feels more like a stolen identity and I don't like association for a trans character, for example).
I came over here and got to watch the initial review because I just wanted to see a GLBT perspective. And while I thought Vera was too kind, I still think she should be paid for her work and not lose her income because of an improper claim. I''m very glad she won her appeal.

My wife and I loved the episode, btw, though I have the same issue as Vera on "are they female or nonbinary?" As for the stolen ID... I don't get that really, lots of people have the same name. Rose is pretty common. Yeah, there is a story reason for it now, but still, anyone can call themselves what they want.

The annoying part is that most "recommended" reviews of the starbeast are by outrage merchants
and instead, RUclips punishes one of the only reviewers in my doctor who feed who knows how reviews work
In the USA we are only a month away from an even numbered election year. One of our major POTUS contenders from time to time over the next year is going to be inside 4 or 5 courthouses in at least 3 or 4 different states. The toxic trolls who whip out a pre-filmed RUclips within minutes or hours of a program clearly have a bias... and a political affiliation. If RUclips is placing their propaganda missives above the "from the heart" RUclipss by the true~fans who have only a few dedicated sponsors... this is highly unfair. I have been looking at and liking these RUclipss BECAUSE i can sense something genuine that has much less slickness to it. Fans are not cookie-cutter copies of each other, but paid propagandists often have a most similar pitch. CAN WE SAY "ASTRO-TURF" VERSES GRASSROOTS? Often, people have held back several years from an opine, or being rather opinionated! The more dedicated fans are picking up on things i tend to miss....

My reaction to the Star Beast was flagged as copyrighted material from The Giggle, which has not been released and I have edited my reaction down and it still gets copyrighted as The Giggle
But the copyrighted section is not the title sequence, it was actually the section of The Meep talking about "The Boss" that was copyrighted as from The Giggle

I have disputed the claim but they have upheld that the footage of The Meep talking about The Boss IS footage from The Giggle and if I used the YT trim option it takes out everything but me saying hello and goodbye essentially, I am unsure about appealing because it could end with a strike on my channel and as a reaction channel that's one of the things I'm scared of getting because it could result in me losing the channel and having to start over

As you said in your video, the momentum is gone, it did make one right winger come in my comment section call me a N*z* because I had a sign about the freedom of Gaza and Palestine but he quickly deleted those comments and the video was re-blocked, so I think I hit the maximum views it would have hit since it was released 48 hrs after the episode ended, but no matter how much I edited the video the copyright kept saying it was all from The Giggle, so it seems the entire episode is in The Giggle as a recap because it keeps choosing random sections to copyright wrongly as another episode

I swear BBC content ID has gotten so much more aggressive lately. Always autoblocks. I don't have this problem with any other show I talk about, its JUST Doctor Who. There are other reasons but this one's part of why I don't talk about it that much anymore cause its just a headache to get a video up these days. With the exception of a video about An Unearthly Child I did recently which would just be funny if it got blocked because of a match "owned by BBC worldwide"
DISNEY has had an incredible string of flops over the past year... when THE STAR BEAST got onto Disney+ globally.... it came in 2nd or 3rd country by country. DISNEY is desperate for good news.... and they are waging a HOLY CRUSADE against any & all forms of piracy.... i think BOB IGER talked the good folks at the BEEB into being as strict. People were dropping Disney+ over the past year. If this partnership with the BBC continues, and DR WHO goes onto Disney+ on a regular basis.... it helps out DISNEY.

My own experience with disputing copyright claims on YT has been a little different: the copyright claim holder does have 30 days to respond, but YT releases the video for view after 48 hours, perhaps in recognition of copyright holders' tendencies to drag their feet. The clock is still ticking on their claim, however, and they can still reject my dispute, at which point we move on to the next steps you described. Most of the time, though, they either approve the video, or else they simply run out the clock, the claim expires, and everybody goes about their business. Is this new on YT's part, or am I lucking out because mine is still a relatively small channel (in which case I'm for once actually thankful for the algorithm sailing past me on a regular basis)?
It’s been a while since I’ve had a dispute and it didn’t resolve immediately so the 48 hour thing may be “new” since last time I had a copyright holder wait out a he clock but that would still make it years old.
Great now this is going to get claimed too. Not by the BBC for any DW footage, but by Fox News because “Voltron of Bullsh*t” is the copyrighted tag line for The Five.

The BBC itself probably wasn't involved at any stage of this. A department of the Beeb's legal team outsources to a social media interaction firm who in turn employ freelancer techies to run algorithms to police BBC content. Sadly this layers deep entrenchment of "Computer Says No" decision making is becoming a norm across society.

hey, as a content creator I thought i would let you know a few things! you should not worry too much about a strike, youtube changed their system now so they give a warning and then 3 strikes and now you can now actually appeal or do a "course" basicly a few basic questions to get that warning removed as long as you do not violate the same guidline a second time within say 90 days!! I am not too sure if you are aware of this and if not hopefully it does help in some way :)

All the big media companies protect their copyright. They have to. The problem here is that RUclips's systems are rubbish, and the BBC's copyright team go to far sometimes. The law is pretty harsh too.
yes, I’m torn. Given that the BBC is basically tax payer funded (‘licence fee’ is just a tax by another name) I’m a lot less mad at the BBC protecting its copyright and therefore public funds than a big private company protecting their profits. But they do go hard in a way that harms small creators and suppresses content that would boost interest in their programmes, particularly when they do it on older footage that could actually bring in a new audience for those shows and very clearly short, fair use footage like this.

I'm sorry that your video was flagged and happy that it is back. Yours was one of the few positive and decent reviews I have seen. I have deleted a ridiculous number of negative and derogatory views from my home page in the past few days. Sadly, I see it only getting worse through the next two specials and when Ncuti takes over. Instead of footage, a possible alternative could be still photos. Surely the BBC wouldn't get all pissy about that.
I’m glad you got the correct resolution though feel for you that you went through it in the first place. Rather than use clips how about stills or better yet stick drawings which will probably make everyone laugh and further highlight the absurdity of it all and still add a dimension to your review. What is really annoying about automatized responses and the official bots of RUclips is how usually there is no way for content creators to contact real human operators and try to explain unfair demonetization/blocking problems. And worse, the system for disputing/appealing copyright claims is designed in a way in order to intimidate creators and they do not push that forward, even when they are actually breaking no copyright infringements. It is just another example of corporate bullsh*t!

Thank you for bringing up that fair use is a legal defense and not a protection against copyright claims. I've brought this up in a video I did on copyright-and while I get *WHY* RUclipsrs frame it like this because in their eyes all that matters is they put a dispute in and it was lifted and they don't really have to look into it further-it gives their audiences and the misguided impression it's a way to stop any copyright claims at all and that's not 100% accurate so it's great to hear dispelling of this for many reasons even the petty ass one that it's a huge bugbear of mine lol

Don't want to step on your creative vision, it's your channel, but what if the clips were in a picture in a picture over your shoulder? The algorithm can't detect that and it means there's no case at all for unfair use.
Most of the RUclips reviews and reactions I’ve seen have been positive but I don’t swim in the underbelly of the internet. And BBCs highest rated drama of 2023… the outrage channels can bite it. Frankly they don’t even belong in this fandom if they missed the message of tolerance and embracing the best of humanity that the program has always embraced.
You're lucky. I, and likely most fans, don't even search up that hate-bait content but the algorithm pushes it so unbelievably hard. I've literally clicked the "Do not recommend this channel to me" button on dozens of those channels, and yet their videos STILL get shoved in my face. Hopefully you continue to avoid them.
Same, I must have done a good job of curating my algorithm as I’ve only had one of those foaming at mouth about woke SJWs reviews recommended among lots of neutral to positive reviews and reaction watches and a heap of Meep related content (which I’m not mad at). It is a reminder how fragmented and personalised the online experience is these days. Lots of the outrage watchers are probably genuinely unaware that lots of of people loved or liked it as they’re just not being shown those recommendations.

The BBC should be thankful for your analysis. Without it I'd not have returned to the show, and I doubt I'm alone. I got tired of the meandering plots, inconsistencies in tone, and sense of not knowing whether or not I was even going to be entertained. Bringing in production-side context demystifies that context and at least gives me a sense of when I'm liable to actually be interested in the show.
