    I found this video right on time! I hired a lawyer and I am just realizing that I could have done everything on my own. The process is very slow. But it is still a good experience.     My I-140 got approved in May’22. Waiting to hear from NVC on next steps… an inquiry was submitted and got the reply that USICS to forward my petition to NVC… how long do you think it may take?

      Hi Aijaz, congratulations! Unfortunately, I don't know how long it may take but you should be notified as soon as you can schedule the appointment with the consulate (assuming this is Consular Processing). Good luck!

      @@OscarsGreenCard Oscar my doubt is that we need to have recommendation letters in order to satisfy the prong 2 right? But I'm confused: What is the prong about 2. Some colleagues are asking me specifically what things we need to satisfy before issue the letter

      @@MrGilbiz you can find very specific information on all prongs and what types of evidence you can use in the Manual from USCIS (www.uscis.gov/policy-manual/volume-6-part-f-chapter-5 ) . Letters of recommendation, in my opinion (not legal advice!) can be used for different and multiple purposes. Definitely, you can use them to meet prong 2 (well positioned), but they can be useful to strengthen other claims (substantial merit and national importance and even On balance or prong 3).

      If you filed AOS, you can stay in the US lawfully. Of course, I don't know your exact case and this is not individualized advice (for that, please consult a lawyer)

    Your videos have perfect timing - just discovered your account yesterday as we’re trying to find a way to change from academia (J1/J2 EAD) to a corporate job that allows the J2 dependent to keep their current paid position.
    Q: Does any of the EB1/EB2 options allow this fasttrack processing option to know the results within 14 days? We are getting discouraged by 1yr+ waiting times we keep hearing and are considering returning back to Europe where we don’t have any of this headache.

      Hi Maximilian, sorry to hear about your situation. EB2 NIW does not have premium processing right now except for older cases. People that submitted more than one year ago can request premium processing for their cases but not anyone else. USCIS announced it will happen soon but without specific dates that I know of . And when it exists it will be a longer decision time compared to other premium processing times (45 days instead of 15). EB1 does have premium processing available and if you pay 2,500 additional USD you are supposed to get the answer in 15 days. As always, this is not legal advice.

    3)are there any national interest requirements to get citizenship coming from eb2 niw green card?

      Hi there, thanks for commenting. My green card is valid for 10 years, but I would just need to renew it without going through the same approval process. Once has to be in the US as permanent resident for at least 5 years before applying to citizenship. Citizenship process is independent of NIW, but you can get probed on what you did about your proposed endeavor during the interview process.

    Hi,
    I'm 34 years old and a qualified Counsellor from the UK who is looking to emigrate to the US.
    I have a degree, 10yrs experience in the required field and I'm member of a registered body (BACP).
    Do you believe that I could prepare a case on my own or would you recommend that I use lawyers services to do so?

      @@OscarsGreenCard I've just been put off in the past as one so called immigration lawyer told me that I would not qualify for an eb1 NIW. However given my degree in the health care sector plus my 10 years of experience, proof of savings and letters of recommendations I could get, I don't see why I wouldn't be eligible...

    I am watching your videos from Pakistan. From here we need ECA from WES. Means all educational credential assess from awarding body. Plus I have MS in Project management only 2 publications and 5 citations.

    Hola oscar estoy haciendo mi solicitud para la visa EB2-NIW y despues de 8 meses finalmente complete los documentos y los envie a USCIS hace dos semanas, pero ahora no se que hacer?, Es decir estoy esperando que me respondan si la I-140 fue aprobada pero quisiera tambien ir adelantando algo, tengo entendido que hay que llenar el formulario I-485 para el ajuste de estatus pero no se cuando ni como completarlo y tampoco se si me van a hacer entrevista, cual es el siguiente paso?

      Hola, tienes que esperar. Dos semanas no es nada, primero te llegará el recibo de que lo recibieron y más adelante decidirán sobre tu caso. No puedes meter ajuste de estatus hasta que tu fecha de prioridad esté "Current" en el boletín de visas. En el canal tengo vídeo de ajuste de estatus, si no pásate por eb2niw.info . Suerte

      Hi there! It is hard for me to know the situation on all the fields. In my field I can say there are a lot of jobs depending of course on the concrete geographic area. You can go to LinkedIn or another job portal and search for your keywords to see how many openings there are in your discipline.

      Hi Chibuzo, concurrent application is possible too. The timeline would be slightly shorter but not by so much. It saves some time on USCIS doing things such as background checks. Another advantage is the issueing of EAD cards and/or travel cards. However, for most situations I would still do separate I-140 and I-485 just because the financial risk is only $700 on the I-140, but it is $1,840 (for one person) if filing both forms concurrently. Filing the I-140 separately allows you to see if it is approved before investing more money into it. Maybe this should be a video on its own!

      Hi Elisabeth. I post a lot of information here and in www.eb2niw.info. I generally do not do 1-1 help with the exception of a Support package that you can find on the top bar of my website. My site and channel are meant for do-it-yourself applicants - you can learn the different aspect of the green card category first, download my own petition, and then work on yours. With some effort and time you can do it!

Do you think I should apply a business plan or professional plan as my self petition if I do not have working capital to be proved. Or just put it professional plan? (I am thinking to work in finance industry while generating income from my startup)

      @@elisabeth1219 Hi Elisabeth, I can't do this type of advising as I don't know your full profile. It's really up to you how you present your plan in the best way possible. You do not need to show funds, but in my opinion at least you should show them how you intend to get them, otherwise it may make more harm than good.
