  • Rajan Jerath's invention causes a real stirrup in the Den as Peter promises an entrepreneur that Apple will sue him, but Duncan challenges Peter's opinion, only to that "you'd be stupid to disagree." Rajan Jerath is seeking a £75,000 investment in return for a 20% equity stake in 'iGloves'.

    Peter was proved wrong here. Apple tried to enforce the small 'i' in court and were told you can't can't claim trademark rights over the letter 'i'

      Perfect - I honestly can't imagine a free economy where letters are allowed to be trademarked. "i" and "X" are free - they're building blocks, not an idea being stolen or impersonated.

      Of course, Peter was wrong here. He's a clown. Any fool knows that whoever registers the trademark first owns it in the regions in which they were granted the trademark. That's the entire purpose of the trademark process.

    Apparently Apple made some moves against them for the exact reasons Peter gave, but they failed miserably. The iGlove is going strong in 2020, having grown enormously.

    He seemed like a really sweet, intelligent guy. I'm glad Duncan gave him a chance. He's always been one of my favourite dragons. You can tell he is more empathetic than the other ones.

    This is actually one of the best counteroffers an entrepreneur has ever given in the Den.
    So often entrepreneurs are trying to stick to their evaluation and give away less equity. When opening a buy back option, or an equity reduction contingent on sales is the best way to keep the investor on the hook. You don’t insult them by knocking their evaluation and industry knowledge. You project a confidence in your products market potential and show that you know your own worth. It’s a very smart strategy

      Not being worried about Apple in that line of work is like walking naked in a house fire. The matters of a trial aren't about being afraid of Apple being right. It's about being afraid of Apple burying you into so much paperwork and legal costs that you go bust before the case ever reaches the stage of floor proceedings. Those lawsuits aren't about resolving a matter of truth in a court of law. They're about grinding you down in a war of attrition on your cash flow before that stage is reached.
      And let's be honest. All five dragons may be millionaires, and astute business people for all I know, but they wil never reach the levels of ressources and expertise Apple has access to. Even combined.

      He does it because hes in the tech industry and doesn't like competition, he successfully poisened at least 2 dragons against this guy here and insisted that Apple could destroy it. It simply wasn't the case. Good thing business people are disagreeable by nature, Duncs really got a good bargain there, 40% of a middling company or 30% of a growing and successful one.

    Duncan is very smart and the most humane businessman. He knew the "i" could not be trade marked, and hence the offer. Also he could have ripped off the entrepreneur, but still played fair by allowing negotiation of share percentage. What a great man Duncan ! 👏👏👏

      I don't think it's THAT ridiculous... I mean, it is a trend that Apple basically started and one would assume they'd have some recourse against people who just try to look at that trend and trademark a bunch of things in order to demand that Apple pay them a ton of money in order to have the name...
      I just think of all those people in MMORPG video games who immediately will make characters that have highly desirable names like "Sephiroth" so they can reserve it until someone pays them hundreds of dollars for the name from someone who had no plans to use it...
      Like, this isn't AS scummy because the guy is obviously using what he protected, but still...

And yeah, I'd say that it would be an issue even if Apple isn't suing all the people who use their naming gimmick because it's possible that they might only bother suing a company if it is exceptionally successful and I don't think any examples you listed are so successful that they are household names (unlike the iPad or iPhone which basically everyone knows about). Like, the iPlayer without looking it up I have no idea if this is like an MP3 or a DVD player... And the iHome I similarly don't know what it is other than I can infer from the name it is probably something to do with smart devices scattered around your home or something... These products are so obscure and if you are pitching a product to an investor then an obscure product won't be big enough to get Apple's attention isn't what they are looking to invest in... So it's going to have issues if it is either too popular or not popular enough (for obvious reasons).

      But Peter is right in this case. He was mistaken in that he specified that this guy will lose the lawsuit because of the 'i'. But he was correct in that Apple will give him a hard time. Duncan find out about this later and cancelled the deal.

      @@pugsterjosh7925 BBC iPlayer is a video in demand service, Hyundai i30 is a car, iTeddy is a children's toy. None of these products are consumer telecommunication electronics, which is Apple's main product line. When you talk about legality, you need to understand context. Something that is legal can be illegal under the right context. You can get reparations from someone over something legal, if you can find the right context. This guy is clearly attempting misrepresentation on his product.

    I'd actually use the gloves if they made it in leather, it's illegal to use the phone on a horse or cart and most riders wear gloves all year round so it would be incredibly convenient seeing as you can ride using one hand but don't risk having to drop anything if you need to get control quickly.

    Lord Alan Sugar took to twitter agreeing with Peter Jones, one of many who made their opinions known on social media.
    As of 2019, Apple just applied for a patent for a new "smart glove".

      I don't think he worded it correctly. I think he meant to say it was a different material. A few years ago all those gloves started using a newer material which allowed you to do the twisting and zooming to perfection. Before you could do it but it was very cumbersome and not as accurate as it is now. I remember when these type of gloves first came out and they had one finger with a little metal bit on it.

      well, naming his product staring with a prefix i was most likely his intention to begin with, as it generates consumers' interest instantly by associating it to a well known brand name...there wouldn't be the same marketing effect if B or C were used, as most of the buying consumers are loyal to brands and their names and just go for a well known familiar name to begin with. So yeah, Peter is absolutely right, there is a conflict of interests here and Apple could easily bury this guy legally if they cared to do so...

    What Peter said about the "I" in Iglove is utter bollocks, they do not have a copyright on I, it is utterly ridiculous he even said that. You cannot copyright all words with I in and not just that, Apple is American, this isn't sold in America either.
