It's kind of hilarious talking about restricting their use, just after China has made it illegal to sell any drone of components for them with anything but basic toy capabilities.
With Africa, Middle East, South America and Asia announcing bans on strategic mineral exports to USA and Europe, you guys are officially handcuffed to a chair in the naughty corner with the dunce hat on.

      Unconstitutional Official Acts
      16 Am Jur 2d, Sec 177 late 2d, Sec 256:
The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be In agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:
The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it's enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.
Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it.....
A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.
No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.
      Jon Roland:
Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.
All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life.
Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. No official immunity or privileges of rank or position survive the commission of unlawful acts. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.

DJI could easily avoid all this by hiring a development team within the U.S. and staffed by U.S. Security professionals who would develop and manage the U.S. specific version of the DJI Applications. I sent this suggestion to DJI and never got a response back. The U.S. is such a large part of their business it would only make sense to add a U.S. Dev team here that could counter the spying claims. Cant think of a reason one that DJI doesn't consider this and act on it. Invest a few dollars in the U.S. team and DJI could be cleared without hesitation.

Running an entirely parallel development and manufacturing company for the US market would probably not be "a few dollars" and as we've seen with Tik Tok, it doesn't matter if you have a US based branch of the company, if politicians even *suspected* that the Chinese government could requisition data from the US based company it'd be enough to start criticism.

The rules put forth make no sense to anyone other than companies like Skydio that benefit directly from the lack of competition created by the legislation.

I would like to write to my Congressman and Senators about this. But I am unsure about how the drone provision of this larger bill can be addressed. I assume that the authors of the drone provision included it in the larger bill hoping to get the entire bill passed.
Please tell me the name and number of the larger bill (because it helps the Congressional staffer who reads your letter to know exactly what you are talking about in your letter).
Or if there are any non-profit organizations out there who are working to stop the drone provision, please let me know. They may potentially have a sample letter about this issue on their website.
Please keep us updated on this very important issue.

Question at 8:00, the DJI platform and app used I believe does store the DATA, it goes like Facebook. You have an account on their site/app, everything you record gets stored within the app in your account. They need servers to store the data, so they do in-fact keep our data, but since it is a China company, they don’t have to disclose what they do with the data even though they should. But having the app and account made through DJI that gets stored to your account seems to me like they do in fact data collect.

I don't think so. We talked about this on Rotor Talk Live this past Tuesday. This is just another bill with same/and or similar language to previous bills. It is a large hurdle to get bills passed by the House, then the Senate and President. They are edited and re-edited to suite lawmakers (adding pork) and barely resemble the original draft. If this were a true National Security issue this would have been dealt with a long time ago. We have much more pressing matters to be concerned about.

If you want to succeed with preventing a drone ban, you need to address the Drone operators that abuse the "Trust" and "Responsibility". Given that drones and cameras are tiny and more silent these days, it's those that abuse such as voyeurs that hover a tiny drone outside someone's window while they undressing or other invasion of privacy. Or the drone operators that think it's fun to operate them around an airport. Or the drone operators that attach guns/projectiles to the drone ... and the list goes on and on of irresponsible drone operators and the "events" that triggered our government into action/ban. There are solutions, but NOT addressable by trying to stop the government. We can require all drones to have transponders and that a drone will not operate without an active transponder ... easy enough to do at the hardware level and make it non-hackable. We can also define TFR locations (basically GPS coordinates) where drones are not allow to even turn on. There is a technology solution, and that's where you need to address this issue.
