  • The defense and prosecution have both rested in the case against Jaylin Brazier in the murder of Zion Foster. Closing arguments will come Thursday morning.

    If the defense attorney did not request dismissal on insufficient evidence by prosecution he or she can be subject to a charge of ineffective assistance of counsel. So it's pretty much standard for defense attorney requests dismissal. Typically you have three dismissal that most attorneys follow. Before trial. During trial when prosecutor rests its case. And after the verdict. This is how the defense attorney preserve issues for appeal. So there's nothing sinister behind the defense asking for dismissal. Not to do so would open the appellate door to ineffective assistance of counsel. Charlie Langton knows this.
