    Thanks, Mark, for not only clarifying the legal principles involved here, but for demonstrating that Judge Newman is sharp as a tack. I hope you and her succeed in fending off this unwarranted and unlawful attack on her.

    Via Bloomberg Law, just learned Newman suspended for not submitting to medical testing; this is same tactic employed by Fidel Castro against human rights activists, where, under pretense of being a threat to self or others, the political target is ordered to take medical/psychological testing for competency. In other words, the target is allegedly mentally or physically ill for doing the right thing. This was also part of the playbook employed against me as AJ, and so I'm all too familiar with the tactic; I did not comply, and neither should Judge Newman.

    "[T]he Chief Judge and the Special Committee are continuing to act as accuser, investigator, prosecutor, and judge. That would not be acceptable in any other circumstance, and I'm hard-pressed to see how it can be acceptable here."

      Are we not seeing the very same thing going on in our government and justice system right now ? There has to be a deeper look into the checks and balances that we depend on. Our future depends on it!

    So you get to pick an arbitrary age of 80. Why not 70? Why not 85? There is no one-size-fits-all when it comes to someone’s fitness to work. People should only be judged on their ability to perform their job. Not their age, not their gender, their race or any other non-work related factor.

      My family knows Judge Newman quite well. In fact, she was the officiant at their wedding. We can assure you that she is mentally fit as she always has been and operates at a level above what most people only aspire to.
      I will also speak for myself. I’m 72 years old and still working by choice. I am a senior level recruiter for a government contracting company, and my senior management tells me all the time the value that I add to the company. So I encourage any senior citizen who enjoys working I’m still capable of performing their job, to not let any narrow minded person tell you you’re too old to work.

    As a former Administrative Judge, who was retaliated against twice over, losing my position, once for maintaining my independence, and second for not permitting a conflict of interest APA violation, I now understand how vulnerable the judiciary is. In my experience, it was the Executive steamrolling the Judiciary to get its way, and here, astoundingly, it's this jurist's fellows who are trying to eat her! Being a jurist is to touch the third rail: You get burned alive! How disturbing to realize that so many have no regard for the rule of law! Can mankind be reformed of his base instincts? I'm beginning to doubt it!

      I worked for a judge that was a by the law judge . Mind you this was more then 30 years ago but he even said then they would do anything to remove him from the bench . This country had better fix this undermining of our justice system. With out law there is no order. I pray
      God helps use now and for the children to come .

      So sorry to hear about what happened to you. We always think we can depend on the majority of people being good and have conscience, but what if in the environment you are in that is not true anymore, how scary would that be?

    Kimberly Moore should be ashamed of herself and ashamed that she started this weird, vindictive process for no apparent reason. She'll be lucky to make it 96 and be as vital as Judge Newman.

    "mental disability" in relation to her age or her office? Because for her age she is fit above avarage .Nevertheless she may not meet the normal requirements of this position anymore

    Mandatory retirement for judges and congressional members should be 65.
    Sorry, when you exhibit symptoms of dementia it's time to move on instead of screwing the people appearing befor you.

      Judge Pauline Newman is still sharp and able to do her job.
      FJB on the other hand; yes, he has to go.

    Despite any conditions, nobody over the age of 80 should be allowed to hold office of a judgeship.
    Period!
    Even the Military has age limits.
    Get real!
