    In a tell-all book, the anonymous author known as The Secret Barrister has painted a picture of a criminal justice system in England and Wales on its knees, while keeping their identity totally secret, even their gender.
    Now we have attempted to bring their insights out of the shadows - examining real cases that reveal the problems at the heart of the justice system. Delays, cuts and creaking infrastructure, all made worse by the crippling pandemic.
    In the first in our series, the Secret Barrister examines the story of a victim of assault, who has been left with life-long injuries. Yet the accused were never tried.
    Filmed before the pandemic, we have disguised the Secret Barrister's identity and the piece has been voiced by an actor.

    Being a barrister myself, it really hit me when I was denied justice as a victim of domestic abuse. The criminal justice system is totally broken.

    You can't have justice on the cheap. For a government who's supposed to be hot on law and order, they don't seem to want to pay the going rate.

    I actually have the book and I've read it. It is absolutely eye-opening about the justice system and since I'm a law student and my dad who, before switching to tort law, was a criminal solicitor and could confirm himself some of the things in the book, like how he would have to wake up in the night, collecting witness statements, important documents, meeting with his clientele and discussing the case itself and what happened etc.

      Furthermore, when the MoJ had decided to cut barristers and solicitors pay, they were earning as much as your average electrical engineer an hour, I can't remember the exact number off the top of my head but I believe its around £40-£70 an hour.

    One shocking stat that SB gives in his book, is that David Cameron's gov granted a minuscule tax relief on BEER which was roughly the same annual *cut* to the CPS

      it shouldn't be that difficult to put any safeguards that might be needed in place. It's not even likely to cost much. This govt don't give a flying fk.

    Anyone that has tried to obtain justice via the legal system will already know about some of the issues raised. It's not like they are new issues. Nevertheless, it's good to see some quality reporting from Channel 4 news for a change.

    The government would rather spend money on ridiculous salaries for the head of equality or some politically correct move, than properly fund their criminal justice system, and in some cases, properly pay their lawyers.

    Why didn't the doctor's solicitor pursue redress from the claimant when the charges were dropped? Why should it be the tax payer who pays for the expenses of the innocent party? I'm referring to the Secret Barrister story on 17/07/20 about the innocent doctor who was accused of sexual offences, the charges for which were eventually dropped by the CPS and he was left with a massive solicitor's bill.

      What most do not understand it that the boom and bust cycles are deliberately caused by those who own the Banks. Most people including most MP's do not understand the money system. Many people are tricked into believing that the Bank of England here and the Federal reserve in the states are government-owned and controlled banks they are not. These Banks are owned by private individuals and they are able to create money from Nothing. It gets worse because the Governments which they control go cap in hand to the to borrow money. They agree to pay back the initial loan plus interest. This is Usury and it violates not only Constitutional Law but Biblical Law. The Banks dictate government fiscal policy as Napoleon said: "The hand that gives is above the hand that takes."
      Hence we have the Deep State, the Hidden, Hand, the real Rulers and they are not the politicians, the politicians are puppets they are there to deceive people into thinking they have a choice and a voice they do not. In this way, the Rothschilds have been able to enslave the people and destroy our Constitution. Only Revolution will change it and that is coming.
      The people should be demanding that the Bradbury Pound is brought back but most people are oblivious to it. This would solve 99% of our problems because the only reason for any form of taxation is to pay off the National Debt, which was created from Nothing:

Most people do not understand that Parliament does not control government. When Parliament is dissolved who runs government then?     Thank you for sharing these circumstances... they are true. Great sympathies for victims, and sympathy is not enough. The British government needs to get this righted, less we become a country run and manipulated by wrongdoers and law-breakers. THEY , the politicians, should be punished as their reductions and cuts are not made ignorantly, but for the sake of themselves - and that is unforgivable.

    A problem is that the justice system in the UK, especially in England and Wales is tied to the government. There is no independent running of the justice system. The judges do not run the justice system, its the Lord Chancellor, and he is a member of the government. In other countries the judicial system is run by the governing of the judicial branch.

    MoJ needs to raise interpreter's wages - so many cases have collapsed or have caused miscarriages of justice due to the lack of un-qualified/experienced interpreters!

      What about the solicitors, barristers and case workers? Or how people in the magistrates courts are judged guilty or not guilty by volunteers who have little knowledge in criminal law. Or how innocent people are denied bail and are put on the list for the crown court to decide innocence (a process in which the defendant may have to spend up to 6 months in jail just waiting for the trial even though they did nothing). Only to list a few but I think the MoJ need to think a lot more than just interpreter wages

    These are the basic principles of English Law that would all be swept away by those in the Establishment who are committing Treason.
    ( Here from one of my Law books is the definition of Treason and I have reported leading politicians and others for committing it to my local Constabulary and thousands of others have done the same:
    High Treason is any act designed to betray the Sovereign, Constitution and People of
    England.
    Sedition is any act designed to subvert the Constitution.)
    and which is why British people especially the English over the last 800 years have
    resisted European domination. Sovereignty is all about the Right to Self-determination:
    The Right to Jury trial
    Habeas Corpus
    Presumption of Innocence
    The Right to Silence
    No Taxation Without Representation
    No Cruel and Unusual Punishments
    All these principles and others are at the core of our Constitution and integral to our
    liberty with the separation of powers at its heart.

    If you think the criminal justice is broken try defending yourself in a civil court against banks and their crooked barristers and solicitors who are engaged in insider fraud, produce false documents and blackmail judges and abuse their priviledge positions demanding judgments against defendants in person. The barristers clerks are operating a closed shop or cartel by discrimination especially against litigants in persons, the direct access service is not fit for purpose if barristers clerks who are legally unqualified operating the system in their own interest.

    This is disgusting.
    The judiciary service is most certainly broken and archaic in my opinion.
    I was on jury service recently, it certainly opened my eyes to how inept the system is.
    The defendant was filmed on cctv, there was DNA evidence and fingerprint evidence, yet the defendant plead not guilty.
    We, the jury spent 6 days on this trial, obviously finding him guilty.
    What a total waste of money for the taxpayer.
    IMO the jury system is outdated in cases where the evidence is so compelling.
    Turns out the guy had so many previous convictions of similar crimes.

    How much of the traffic jam of trials is due to greedy lawyers advising their clients to plead not guilty when they obviously are . The system needs to be modernized so that a preliminary hearing before three magistrates/judges decide upon how the case is to be tried. Another shake up should be on the length trials take. Again lawyers both prosecutors and defense make fortunes by stretching a black and white case over weeks and months . No Win No Fee , if lawyers lose the case then they should foot the bill , that would ensure that only genuine grievances reach the court room.

      I will have you know barristers cannot tell a defendant to plead guilty or not guilty, they can only advise as to, on the evidence if they should plead one way or another, they also cannot defend someone who admits being guilty to them but enteres a not guilty plea. Furthermore, they do not recieve pay for time that isn't spent in actual court so the delaying of trials actually costs barrister money, I cannot speak to solicitors as I just do not know how it works for them.
      Barristers are self employed, Criminal barristers are severely underpaid and literally sacrifice all other aspects of their life to carry out this form of work. I understand the misguided belief that all barristers are rich middle age white men, and in the past it was true, but over the last 20 years it has got worse and worse. So after 5 years of studying usually accumulating 50k debt there are only two reason a pupil (a trainee barrister) goes in to criminal law, they are either not good enough to make it in a different (much much much more lucrative area) or they are truly passionate and dedicated to justice. No criminal barrister is in it for the money, there are plenty of easier jobs that pay much higher salaries open to us.
      So as I am sure you wouldn't blame doctors for NHS waiting times don't blame barristers for courts, the system is broken and barristers are just trying to old it together

    It's just really sad and it's not even on the agenda for improvements all thanks to this austerity, covid excuse ( the first one since Tony Blair took office ) this, is such a very important matter it involves all lives in our society and worse we all pay our taxes over it for this type of shamble system but, the Tories didn't work on these issues and I doubt it other parties will this should be a number one priority for improvements not a bonus system for whenever they feel like it this is so appalling

    I don't think it's a shock that the legal system doesn't exactly work effectively I think it's on best day it's 70/30 on average it's probably 60/50 or 50/50 which you and I certainly don't want to hear about our countries legal and judicial systems.

      It was the outgoing Secretary to the Treasury who left that note as a joke to the next chancellor. It's been part of the political handover of the Chancellor's office for the last 100 years to wish the successor well, but for some reason the Tory party decided to use this as political ammo.

For that very reason I being a medical student suffered from law teacher who believed it's fair to make medical students to learn 5-year jurisprudence program in one year. The economics teacher went even further and forced us to study even international economics on the thirdt year of medical university. Now you will understand why it's on its knees.

    When the light (Conscience) is lost…then human becomes animal…But many doesn’t know how it’s getting lost in a human..It’s like this-When a person does wrong ,his conscience will tell him it’s wrong…if he still does it..then the 2nd time the voice of conscience inside you will be bit feeble…and 3 4 times if the same thing happens then one will never hear the warning…which makes him go forward with anything as he lost the antenna to know wether he is doing right or wrong…This is the way criminals are coming up…but karma knows the address…it will come and affect the persons every valuables…May be family,children,or themselves…That’s why Jesus said …you will hear a voice from behind…..Turn towards right. …and should never allow the light in you to set off…
