  • In this episode of Central Hall, Kapil Sibal discusses with a panel of leading independent-minded lawyers the problem of sitting judges developing political links. Recently, Justice Abhijit Gangopadhyay quit the Calcutta High Court and joined the Bharatiya Janata Party. While on the bench too, his judgments, obiter and interviews generated controversy. How should the legal community respond in such cases? And is it ever possible to insulate the judiciary from politics? Listen in to Sibal’s conversation with Meenakshi Arora, Prashant Bhushan and Dushyant Dave.

Ms. Arora hit the nail on the head when she talked about character building. Schools used to teach students about morals, obeying, respect and the importance of the law, in addition to fairness to our fellow beings. Somewhere we seem to have lost our path and are following a blind urge to make or save money at all costs, with the result that we as a civil society give less importance to rules, laws and even our fellow beings, shunning all notions of fairness. I think our "education" system has completely failed us, and we are seeing the results, where "might is right" and everything else be dam ned.

I also happen to agree with Prashant Bhusan. This psychological fear of repercussions like demotion must be avoided as the public are in support. As Prashant pointed out he continues in his path to the Truth and the Constitution. If the named judges did not achieve success in the careers , a personal altruistic success surely trumps that.

Why do you think people do not have altruistic reasons to rejecting an appointment but only Money. If honest people can't be bought then why do you accuse them of rejection based on money.

Thanks so much to Kapil Sibbal for the excellent presentation. Judges should always be neutral, fair, impartial and a mindset of their own with real logic as their base. Having leanings to any political leader is a personal choice but should never be exhibited in public. In this world there are only two religions and that is Spirituality and other is Materialism as spoken by the Great Vivekananda Swamy. Logic is the biggest asset of any Judge, since this cuts across all religions and has no boundaries. If there happens to be some Judge who favours some political party with ulterior motives then it is very unfair and bad.
