Yes,the driver is also liable to pay compansation to the plaintiff bcoz there is a relation b/w them of master and servant acc to ormond v. Crossville motor company LTD case they both are liable or owner or driver is liable

Yes we are held liable in a condition where we have control over the directions given to the driver related to speed and way but if the driver was denied to follow our directions and do not follow our command then in those circumstances we are not liable.

Yes sir ji only a driver was liable for his tort because he is a indigent contractor he work without any control
right
Only driver will be liable for the remedy to plaintiff because as he is an independent contractor and do not work under anyone's direction and control so exception arise's here even though the company has not authorized him for an illegal act/work!!

Sir apne jo ABC firm ka example liya hai usme agar A employees ke paise le ke baag jata hai toh Employees ke pass sue karne ki choice hoti h
Aur agar employees ko pata hai ki yeh sab A ne kiya hai
Aur woh log A ke against suit file kare toh uss case m B aur C bhi liable honge kya
But siut toh A ke against hi file hua h

In RYLAND VS FLETCHER case the contract and engineers were indipendent.. so why in that case , master was liable to pay remedy for loss ?

What if person A convince B to give him money and he will deposit in xyz company and A gave that money to C for depositing but C didn't deposits and flew away . Who will be liable ?
