Isn't there a comfort damage in Bhim Singh vs State of J&K ? Because the MLA had to remain arrested for a long time..
That is violation of fundamental right.

Yes Sir.. There is a violation of a fundamental right..
But u told that any suit/case filed would come under the maxim "injuria sine damno" if there is an injury (violation of legal right) without damages (of comfort, health and money)...
But in this case of Bhim Singh vs State of J&K, there is indeed a violation of a fundamental right but there is a damage of comfort for the MLA.. It is not "without damage". So how can this case fall under this maxim..?
Kindly clarify my doubt, Sir.
@@rudrakshi_rajput In each and every case there is a comfort of health or comfort but here we are going to clarify difference between comfort of legal injury.
here priority is given to the legal rights than comfort hope you are getting.

examole ki agar baat kare kisi person ko confine kar ke rakh liya jiski wajah se usko monetary loss hua kyunki uski meeting thi wo reh gai. to wo legal rights ko claim karega sath sath compensation bhi claim karega jo loss hua hai.
