It’s called parenting and being present enough to teach your child how to operate safely. If you didn’t do that and something happened and it turns out to be operator error it’s the parents fault.
I think it all falls under the responsibility of both child and parents when it comes to E-Bikes for children, because a lot of these accidents occur due to the bad decisions and lack of parental supervision.

Its not the bike. Its the person teaching and the kid understanding it well or not. If the adult is teaching them the correct, safe, and proper way to use them the kid will grow up just fine as long as they, in their minds, know what to do after being taught.

Parents should be held responsibility to there kids... when there is a lawsuit it on there own. I think all ebike's company should have age requirement when purchasing of proof and how to operate the batteries is at risk. Owning them can be scary so use at your own risk kids

Put up a law that strictly prohibits ebikes on major highways. No access to busy traffic at all. And also put a age restriction from 14-17 since they're also coming to age of operating a small electric bike is like driving a mini motorcycle and restriction for them to enter any congested street traffic in downtown city areas.
There is a difference between e-bikes and e-dirt bikes, such as a surron. A surron is classified as a motorcycle, not an e-bike as it does not have pedals and can be easily unlocked to go 45+ mph.
Sadly this is a tragic accident but I have to say this fault relies on both the child and the parents. Like I said with the one chip challenge kids want to do something popular especially around the age of kids/ teenager life and they're willing to do something dangerous that can potentially have grave consequences. I give out my condolences for the family but you also got to teach your child how to learn the ropes of the road especially when you're riding on a scooter e-bike any type of vehicle.
