Agree! We PAY public servants to make our society better. The taxes we pay for them are not to be harassed, it's to address crimes in a way that incorporates deescalation and safety. We need to change the culture to one of doing the right thing and away from ego and unnecessary aggressiveness. The police have an extremely difficult job and I respect the good ones immensely, but let's continue to make sure the bad ones don't get away with abuse of power.
Your right but that video can be sent to a prosecutor and he can use it to convince a judge to issue a warrant ..the video just can't be used to make a warrantless arrest
Well, it isn't that crazy honestly, I can imagine a few points where it makes sense. But that isn't the police officers fault, Clark's Law is a real thing
From much experience, the lieutenant is correct. I don't know that it is something that comes down from the U.S. Supreme Court, however. But, often times, officers can not make a misdemeanor arrest without witnessing it themselves. This includes video evidence. However, there can be exceptions with Domestic Battery.
@@paulfrmn1 No it's not. Do some research... there IS actually a law about this and it does say that unless an officer sees a misdemeanor they cannot make a 'warrantless arrest'. This is a joke of a law BUT it does exist... that Lt. Actually has his hands tied in this matter whether he wants to or not... even if he DID want to do something he couldn't.
they know the average person can't afford an attorney to compel them to be accountable to the law, thats why this behavior exists and thrives within government, because they know most people will never be able to afford justice...

This isn't entertainment. This is your life, your reality, the mess you are leaving for your children. It can be stopped and it needs to be stopped. We can't afford NOT TO!! @@grumpyoldman3597 - and the judges are also another problem - at least the lower level judges, the upper level judges seem to be better overall. All of which take either an attorney, or someone with a dang good repertoire of the legal system/laws. Although I never recommend anyone go past that "bar" in a courtroom to face a black robe judge on their own. Unfortunately, it seems as if "justice" has turned into something one must purchase (not always, but often). But there are still many things the people can do that do not require a large sacrifice. I noticed another mention some of them in these comments. Putting together a peaceful protest on a public sidewalk in front, getting involved in your local politics more than just voting, which means learning how to decipher "political speak" as far too many politicians now engage in it, letters to the editor, emails to the local government officials (city council, county commissioners, etc), and a whole list of other options exist. 👍
Man has kicked it up to a whole new level recently, last video telling them “I have to” and then walking past their signs to record was straight bliss. This is a fun fam to be apart of!!
Indeed. Gwashop-pah is jumping HIGH....lol. I've been with Sean from the beginning. There are only two auditors I believe are really effectively creating awareness and change for this current period. There is a difference between 'assertive' and 'aggressive'. Hitting that sweet spot in between them is something SeanPaul Reyes does better than anyone else out there. His style of auditing is taking him places, for one reason only. People are sick of the 'sparring exchanges' and cheap shots. We've seen enough immature and self-loathing human beings. We are forced to see them every time we engage with a device. Sean does it with style and grace. Those two things only live in 40-year-old movies. There are some really great auditors out there, except for one thing, they seem to have lost focus and are not producing quality work. Many of them are far too aggressive and provocative, people are tired of seeing that. We would like to see an individual stand on his own merit, be cordial but thoughtful and considerate, even taking pause to form coherent sentences. There's entirely too much talking over one another, too much yelling and cursing. Too many f*ck yous and I was with your wife last night. Incorrigible behavior does not beget gracious and sensible behavior. This is why Sean is pulling miles ahead of the pack. To command respect, you must understand what it is. Your behavior cannot be equal to or worse than that of our public officials and then expect to be taken seriously with any degree of credibility. That's just nonsense. I consider those auditors to be court jesters in a serious arena but hey, everyone needs a good laugh now and then and so they have their place too. Sean is just top drawer, all the way around. Arrogance should never be in any auditors drawers....bawhaahah
Now you know why they didn't want to help cause she works for sheriff's department but the police where good and showed you respect and went through the right steps
You're one of the best Sean.... Do NOT let this go! She needs to have her ego, entitlement and rudeness put down or she can go home ...for good. Nicely done ....and as usual ... can't wait for your follow-up.
Why would an uncivilized criminal thug middle age or old Karen be the one you least expect😩. He must not look at Karen videos on here they all look and act just like her
Wow Sean, that was totally unacceptable on her part. She should have never put her hands on you. She should be sitting in handcuffs in the county jail for her actions. You're right, they always try to protect their own when it applies to their co-workers. I really hope you get Justice for what she did. Great video Sean, and keep up the great work.
It is the law in idaho. If he would of had visible marks it might have gone different. It happens all the time here and it's absolutely ridiculous. Sucks it happened in the area with no cameras, his angle wasn't the best to prove without a reasonable doubt.

If you understand the true nature and purpose of government, then this should be no surprise. Thats what they do. They dont answer to us; they havent for a very long time. What we are allowed to participate in is nothing more than a thinly veiled charade.
The immediate hostility toward a crime victim is incredible. As we can all see, "in this day and age", laws are not for government employees. Especially if your last name is the same as a street here. AND, YOU WORK FOR THE SHERIFFS DEPARTMENT. They are above the law. This is what your tax dollars pay for. Don't let this one go Sean. You know damn well the prosecutor will stall forever and do nothing. Looks like you woke her up from a nap. That is what they get upset about. They do little to earn their pay and don't want it on camera.
Having been cited for "assault" for simply sticking my finger into another person's chest during an argument, whereas "assault" is defined in the law as a "touch in a rudeness of manner", she ABSOLUTELY committed assault. I learned that expensive lesson and she should too. (Moral of the story, that's taught from childhood, is KEEP YOUR HANDS TO YOURSELF!)
Props to that Lieutenant for telling Sean he mistakenly said it was a Federal case law instead of an Idaho one. Rare you hear them be so honest. Imagine all government and law enforcement being that nice!
@@CaneCorso888 I believe you are referring to the Reagan case where the court decided misdemeanor DUI ALSO falls under the Clarke decision. The Clarke case was specifically about a person who was arrested for suspected battery. The charges were vacated when the Idaho Supreme Court ruled that a warrantless arrest for misdemeanor crimes not personally witnessed by a police officer are unlawful. In the Reagan case a person had reported seeing the vehicle being driven erratically and Reagan was subsequently arrested at her home without a warrant. The defense argued that since the arresting officer did not see Reagan operating the vehicle, the arrest was unjustified under the Clarke decision which as the chief correctly stated prevents them from making an arrest for misdemeanor crimes that aren't witnesses by an officer and where there are no obvious injuries. Hopefully the Clarke case will go to the U.S. Supreme Court becomes it is ridiculous in my opinion.
@@Xterraforce Great summary, though I disagree with you on the Clarke decision. A citizen's arrest should have taken place that's really what Clarke reinforced
@@dajameses that makes sense. It's a shame when something like that ends up resulting in a court decision that goes well beyond the scope of the case. Like I can see how when it's one person's word against another it would be hard to make a case for arrest without evidence or witnesses. A citizens arrest puts the responsibility on the person who actually saw what they claimed happened and I would think the consequences of lying in that case would reduce false claims. It would likely improve the chances of the person making the claim to actually show up in court to testify. With the Reagan DUI case if the person who made the report didn't show up in court the accused would not be able to face their accuser. The arresting officer would only be able to prove the owner of the car was intoxicated, not that they actually drove the car.
For the police asking them to enforce the law on one of there own is like asking fireman to fight a fire with gasoline ( to them you have gone insane).
Same with expecting politicians to legislate themselves such as term limits or getting dark money out of government. It’s hard for them to pass laws that may negatively affect their political careers.
The gang rules don't let them.. just like a blood member protecting other bloods. One of the most organized and dangerous gangs in our country is The Blue Line Gang!!!
If the state sweeps this one under the rug than I strongly suggest you challenge this all the way up to federal supreme court. Enough is enough. A strong message needs to be sent to these so-called "public servant" tyrant bullies.
I dont disagree that this is an issue that needs to be addressed. But, please study up on the process of "taking something all the way to the Supreme court."
So by that officer's logic if I decide to assault someone on the street and they call the cops they can't arrest me cause it wasn't done in their presence? That makes a whole lot of sense.
On June 12, 2019, the Idaho Supreme Court issued a ruling in the State of Idaho vs. Clarke that the use of warrantless arrest in a misdemeanor battery (non-domestic) case was unconstitutional.
Crooks can take someone into a dark alley beat them up and take their money. For fun they can even leave the victim with their card and tell them to take it to the police
I just want to say that the emotional stability, self-control, and maturity required to do what Sean does is insane. Plus to do it as well as he does without losing control is extremely impressive. I have quite a bit of familiarity with these situations and the way Sean deals with the confrontation is extremely impressive. There's no way in hell I could what he does without getting into a much bigger confrontation.
The LT and Chief are two of the most reasonable and neutral officers I've seen coming out of the U.S. audit video in a very long time. The other officers were biased as one would normally expect and that woman be a crazy KAREN
The Clarke Decision is apparently a big deal and a huge bane for the police in Idaho. I'm sure every officer there knows about it since battery comes up often.
What is this cop talking about lol? The cops arrest people all the time with out seeing it . We are a country of 50 separate states with there own laws . Crazy
The LT is full of it. If that lady walked up and made a false claim that Sean touched her, he would have not wasted a second to handcuff, probably rough up, and arrest him.

Sean is absolutely correct that if it was him to have done that to her, he would have been tackled to the ground, beat and arrested. I hate these double standards.
they are not just double standards it is a breach of the law and dereliction of duty, all an officer needs to make an arrest is evidence and the video is enough to make an arrest she might be found innocent in a court but that is irrelevant.
The woman that committed assault should never be working in a public setting and should be fired, she is a menace and a danger! The police in this video are a joke, absolutely shameful!
The sheriff's deputies were a joke. The police department was professional. Sounds like they need to run a "clear the bench" campaign to get rid of the boneheads on the state Supreme court!
You damn well better believe that if a woman walked up to a police officer and said this man just touched me inappropriately and I have it on camera, I want him arrested… the cop would put shiny bracelets on the guy. But when a guy says this woman just assaulted me and I have it on camera the police just ignore the citizen’s complaint.
Depends on the cops. Cops have an extremely high rate of domestic violence so often they empathize with abusers and don't give a shit about women. Remember those Utah cops that answered two 911 calls about Brian Laundrie hitting Gabby Petitio and they threatened to arrest her instead and gave him a free hotel room along with fist bumping and yucking it up with him like dude bros 🙄. Wait a second. The crime didn't occur in front of the officer so he's not going to arrest her. Not every crime occurs in front of cops, but they arrest people all of the time. They never want to do anything when an assault occurs to an auditor because they hate the people who hold them accountable. If Sean would have put his hands on her, he'd definitely be arrested.
@Justice Starr Hunter And I agree with that ruling, on the face of it, because it prevents men from being arrested under false charges. However, it seems like it should be amended that if video of the incident is readily available, that should be the same as seeing it in person. The issue is when couples fight, certain types of people like to lie to the police and turn on the tears to have their boyfriend/husband dragged away out of pure vengeance, without any actual violence taking place. And for the argument that this could leave people in danger, getting a restraining order is always possible from nothing but one side's words, and that can have the same effect of forcing the person out of the house, without their freedom being taken away.
There's nothing flawed about the law in question. Cops are WAY too eager to go hands-on with people for trivial shit, and it's absolutely a great idea to tell them they CANNOT do that for a misdemeanor. They should be prohibited from making a physical arrest for ANY misdemeanor, even one committed right in front of them. For minor crimes, they can simply collect evidence and statements, forward it all to the prosecutor, and let the judicial system handle it from there. No need to be physically putting people in chains for such a minor crime. The only reason the cops DON'T like this law is because they are violent thugs and bullies who can't stand the idea that they AREN'T allowed to physically tackle someone and put them in chains for jaywalking.
@@ajm5007 As always it depends on circumstances. Like all laws and regulation, in a certain context those are very intelligent and usefull on another context they are not fullfilling the intention written in it. I would strongly recommend you, not to throw all LEO in one bucket. There are very good officers out there, very careful decition makers and law enforcers. An there are officers who are a curse, a shame to their oath. But i get your point and i have to agree with it. There is a problem with policing in the US right now, too much cases where police are bending the law to their favor. Props to that cop, too, btw. I looked up Idaho v. Clarke (2019) and he's right. They can't affect a warrantless arrest unless they see it. Thanks to you for bringing this to attention. How bizarre... I wonder which politicians kid did something effed up to get this pushed through?
In State v. Clarke, a woman flagged down a police officer near a beach in Hayden, Idaho.[iii] She reported that Mr. Clarke harassed her and groped her while she was trying to enjoy the beach with her son.[iv] She provided the officer with a description of Mr. Clarke and advised that she wanted to press charges.[v] The officer located Mr. Clarke, who admitted to talking to the woman and grabbing her, but Mr. Clarke maintained the touching was consensual.[vi] Based on the woman’s complaint and Mr. Clarke’s admission that he touched her, the officer arrested Mr. Clarke for battery-a misdemeanor offense.[vii] The officer searched Mr. Clarke incident to arrest and discovered drug paraphernalia, methamphetamine, and marijuana.[viii] A Motion to Suppress Mr. Clarke moved to suppress the evidence obtained after his arrest, arguing that the arrest was illegal pursuant to Article I, Section 17 of the Idaho Constitution-which prohibits unreasonable searches and seizures-and therefore the evidence of the drugs and paraphernalia was “fruit of the poisonous tree.”[ix] The district court found the arrest permissible under both the Idaho and Federal Constitutions and under Idaho Code § 19-603(6)-which permits warrantless arrests when there is probable cause to believe an assault or battery has occurred-and found there was probable cause to support the arrest.[x] Mr. Clarke appealed the district court’s ruling.[xi] On Appeal The Idaho Supreme Court analyzed Idaho Code § 19-603, which sets forth the bases upon which an arrest may be made.[xii] Until 1979, that statute echoed the state constitutional interpretation that a warrantless arrest was lawful if the arresting officer had probable cause to believe a felony was committed or if the offender had committed a misdemeanor in an officer’s presence.[xiii] But in 1979, Subsection 6 was added to the statute and since then, the statutory standard has diverged from the constitutional standard.[xiv] Indeed, Subsection 6 allowed for warrantless arrests when there was probable cause to believe a misdemeanor assault or battery occurred outside the presence of an officer.[xv]
The 1979 decision, I would argue, was based on the need for officer witness. I would argue that viewing the footage on someone's smartphone (a non-biased witness that wasn't around in 1979), would be sufficient evidence to satisfy the demand for probable cause. . If they've ever used the footage from security cameras (involving any case after the 1979 decision), as satisfying the demand for probable cause to arrest anyone for a misdemeanor that wasn't committed in their presence, I would use that to make another argument (the more often they did it, the stronger that argument would be). . I didn't check to see if there was an update, ahead of time. Are there any updates? Is that unhinged lady still on the job?
As I understand it the clarke decision was an idaho supreme court decision and never went to the us supreme court. This means it may not be valid in your state because of local laws. It would take a lawsuit to determine.
I'm not familiar with us laws. Can you show me the part with the exact wording? Because you sey "unless they see it". If i show someone video evidence in my eyes they "see" it.
As County Manager for a small county, I feel that this was handled incorrectly by the Sheriffs Department, I think the Police Department actually did what they were required to do within law. The County Attorney will not do anything because you can tell on camera they protect one another.
They may have thought there was a conflict of interest but I have seen Sheriffs do the same thing in other videos (refer it to the local police). If it were a felony then State Police would have probably handled it but a misdemeanor is usually the local PD jurisdiction. I could care less as long as SOME officer handles it and an arrest is made.
Glad to see other public officials chiming in on these channels. A s public official I am regularly incensed by the behavior of servants in other jurisdictions.
@Gofuk Urself 🙄Lovely name you have. I said that because the OP had mentioned the county attorney wouldn’t do anything about this since she works for the county sheriff’s office. A couple of things - 1. I can see why the Chief became a Chief. A very calming demeanor. My hats off to him. 2. That lady should NOT have been walking around without a government ID badge in the office. Not a good look when you're asking someone for accountability when you yourself don't show any. 3. Awesome content man. While you take the hits in these videos I can't even imagine how many other people were spared from these types of nonsense just because these morons will remember your incident.
If that woman had accused him of looking at her in a threatening way, much less make contact, as he said they'd have him in cuffs if not on the ground. Did you think the chief would answer truthfully when you asked? Handcuffs would have been the minimum response and fabricated charges to jail you.
I liked the other guy as well. He got the two supreme courts confused but cleared that up later. Seemed helpful all round. I wouldn't even fault the guys from the sheriff's department. Basically the only thing they did wrong was not volunteering the information that the suspect was their colleague, which wasn't really hiding it because it was bound to come out later. Totally understandable.
Wow, the entitlement that lady thinks she has. This was Way out of line for a public servant to treat a member of the public like. She needs to be held accountable and charged accordingly.

That's a see if you are dumb test by the Lt.

Even if the prosecutor doesn’t do anything, it’s good to know that the chief and lieutenant were at least willing to help you go in the right direction. Hopefully they follow up with their submissions. The county deputies were a disgrace though.
What are you talking about. The chief and the lt are just giving him the run around, the are not willing or trying to help him. That law is about DUI.
Didn't that police officer say she worked for the sheriff department?

Ya dude I'll take a turkey sandwich no tomato. Hurry up too I'm hungry.
I have to applaud the city police. They were knowledgeable and able to see the flawed logic of the very laws they enforce. Good job guys.
@@ajm5007 Good point!

So as long as the police force has such bad examples in it, it is better to limit their powers.
Clarke and advised that she wanted to press charges.[v]
The officer located Mr. Clarke incident to arrest and discovered drug paraphernalia, methamphetamine, and marijuana.[viii]
A Motion to Suppress
Mr. Clarke appealed the district court’s ruling.[xi]
On Appeal
The Idaho Supreme Court analyzed Idaho Code § 19-603, which sets forth the bases upon which an arrest may be made.[xii] Until 1979, that statute echoed the state constitutional interpretation that a warrantless arrest was lawful if the arresting officer had probable cause to believe a felony was committed or if the offender had committed a misdemeanor in an officer’s presence.[xiii] But in 1979, Subsection 6 was added to the statute and since then, the statutory standard has diverged from the constitutional standard.[xiv] Indeed, Subsection 6 allowed for warrantless arrests when there was probable cause to believe a misdemeanor assault or battery occurred outside the presence of an officer.[xv]

The police officers said it was going to the city prosecutor.
They may have thought there was a conflict of interest but I have seen Sheriffs do the same thing in other videos (refer it to the local police).
