As of the time of writing this, I can't find any announcement/article/public legal document saying anything about a C&D. There is also no conversation about one in the official Nova Discord Project ERA however is now being shut down due to legal issues with Epic over their use of VBucks. Epic has required them to shut down their ability to take donations and they can no longer support the project.
It seems to depend on the time of day. Subscribers to Nova get priority so you'll have better luck that way. Nova has the most servers so you'll have a better chance with it over Era. Of course a lot of people don't know this even exists. The only way to get more players is videos like this letting people know it's an option.

amazing video, project nova is such a cool thing to exist and i've played alot of it just before the og season got announced last year November
I'm really glad it's here. I miss old Fortnite and while I don't want to play it all the time, it's really nice to be able to go back
