    Very interesting. Thank you for sharing this information.
    As a note of personal opinion: With the demographic issues in the Italian population, would it not make sense to do more to actively facilitate “return” of descendants of the Italian diaspora? In theory these would be individuals with cultural affinity that are already predisposed to integrate. Italy could look to the success that Israel has had with assimilating returnees of their diaspora (language immersion, classes teaching aspects of the nation’s culture and history, etc). An overt “invitation” of sorts to the diaspora community could solve much of the demographic problems within a generation or two (and do so with skilled and educated workers).

      Most Americans of the Italian Diaspora who would like dual citizenship would bring money, education and more. You're absolutely right.

    its a shame some companies who are in the business of Duel citizenship are blowing this off and saying "Don't worry it doesn't apply to you or the US consulates" They are afraid of the huge financial loss in there Niche Business coming down the road

    You can get citizenship after three years with an ERV (Elective Residency Visa) the retiree Visa, through naturalization. Usually it takes 10 years with an ERV but since your line was broken (minor case) you can apply for citizenship through Naturalization after 3 years of residency in Italy. It is important to understand that you must LIVE IN ITALY to be naturalized with an ERV. Easier and less expensive way of pursuing Citizenship.

    • @lawfirmbersani
      @lawfirmbersani  Месяц назад +2

      Thank you for your comment, which is correct, but it's not applicable for most of people.
      1. You need to qualify for the ERV.
      2. Being resident in Italy for 3 years , with pretty high taxes, may be more expensive than paying a professional once, depending on your net worth.
      3. You can apply only if you have Italian parents or grandparents, so it's not applicable to who's claiming Italian Citizenship from GGPs, GGGPs and so on.
      4. Not everybody can (or want) move in Italy long-term.

    So my paternal grandfather naturalized when my dad was 7 and my paternal grandmother naturalized when he was 15. So how old then was my father supposed to be when my grandfather was naturalized to not have a "minor case"? Thanks so much

    I obtained Italian citizenship in 2020 as a minor of natualized parents through the consulate. My two sons have applied for Italian citizenship through the consulate one year ago and still waiting. In your opinion, will this change make them ineligible for citizenship?

    • @lawfirmbersani
      @lawfirmbersani  Месяц назад +1

      Thank you for your very interesting comment.
      We think this will be a common scenario for many applicants, and we think it's a clear discrimination given the Law is still the same.
      We predict many future lawsuits will be filed, to fight this discrimination between family members. And we will support them.

    Can you please post a video on citizenship by marriage (jure matrimonii) before April 26, 1983. Specifically, after the Nota Ministeriale is it a viable line to look at a non-Italian born grandmother or GGM who acquired Italian citizenship by marriage ... even if the marriage was not previously registered in Italy.

    Can the definition of "minor" be challenged since the age varies whether it is drinking, enlisting in the military or marriage. A "minor" can consent to relations and marry as young as 14. Can an argument be made that at 14 they could consent to retain their Italian citizenship even if their Father became naturalized after they were 14 but before they were 18 or 21?

    Btw, my Father was 19 years old flying combat missions in the South Pacific against the Japanese in 1944 when his Father naturalized in 1944. How in the world can my Father be considered a minor when he was in combat during that time? Does this fact make any difference?

    If I have two different valid female Italian ancestors in two different court jurisdictions (no paternal or administrative lines available), is it against the rules to file two case simultaneously (one in each jurisdiction) so that if I win either of the two cases I am an Italian citizen? Or do I have to choose one of the lines and only file one case?

    By "back of the case" do you mean, for example, my case.
    My GGF naturalized when my grandmother was 19 (shes still alive at 96 ❤) BUT his wife, my GGM never did. This could serve as coraborating evidence?
    Both my GGF and GGM are from italy. But only my GGF ever became a us citizen

    If my father's birth was registered in the late 1920s in Italy, does that mean I can be an Italian citizen, even though my Italian grandmother naturalized when he was still a minor? My Italian grandfather naturalized before my father was born. My naturalized grandfather married my Italian grandmother before my father was born.

    I was working on my great-grandfather's line with a minor until this happened. I might have one shot, via my great-grandmother who naturalized later than my great-grandfather putting my grandfather at 21 or 22 but it would then be a 1948 case that would have to go through the courts. Wonder what my chances would be then?

    What is your opinion on this new interpretation? Are you expecting, or rather when are you expecting to see challenges of this interpretation make their way to the Corte di Cassazione?

    • @lawfirmbersani
      @lawfirmbersani  Месяц назад +6

      Thank you for your question.
      We expect the Court cases will increase, because many denials from the Consulates/Town Hall will be appealed.
      Hopefully, the Supreme Court of Cassazione ("Sezione Unite", this time) might definitely solve the Minor Cases.
      We will keep you all updated, as always, so keep following our channel.
