The First song that I heard by Avicii. My life was in a very bad place and this song made me feel alive and happy, something I havent really felt in a long time. He didn't 'steal' anything.
He took a classic melody a remade it in his own unique modern style. And honestly, thats what we need in music right now a taste of a classic with the style of a great artist.

Well, the original was a nice mix of weird, talent and a bit of sadness as the original ensemble suffered a grevious loss and never performed again, so there are no words but the track record for this song, is a bit sad.

Avicii has said numerous times that "Penguin/Fade Into Darkness/Collide" samples the orchestra, and he has paid them for his use. And he didn't remix their song, he sampled the melody and chords, which is different from remixing.

+Thastor The wikipedia page for Perpetuum Mobile says that Avicii sampled the song in this - ergo why it's named Penguin. If you Google sampling music laws, "If you want to use a sample legally, you must obtain permission from the copyright owner. The copyright owner is usually a publishing company or record label. Remember that you must obtain permission from both the owner of the sound recording and the copyright owner of the underlying musical work." So Penguin Cafe's record label may have given him permission.
I know it's a late reply but pretty much he can get permission from the original copyright owner and avicii would be able to reelase the song with the copyrighted melody and the original owner of the track would gain any royalties from anytime this song is played. For example if penguin got played on the radio avicii would not get any money from it and it would all go to the original copyright holders.
Perpetuum mobile is featured in the swedish movie Smala Sussie (Slim Susie) from 2003. It´s a "Pulp fiction" style movie I can imagine Avicii saw. And from there it went.

I don't know what it is but there's something rare about the melody in this song. Like even though it's pretty much the same throughout the entire thing I just want to keep hearing it. I had the same thing when I listened to Eric Prydz's track Pjanoo. It's really interesting how some artists can do that with their songs. Avicii was clearly one of those who did have an ear for writing melodies. Sad to see such a talented artist go. Rest in piece.

It is the same piece, in Mary and Max it was the original Penguin Cafe Orchestra version and here is the delightful Avicii interpretation, even apparently named Penguin after them. See also Fade into Darkness and Collide which use pretty much the same sample.

The time signature of Perpetuum is 15/16 it's pretty much impossible to squeeze into 4/4. There's a note missing...but he did a fair job of trying 😜
