  • The former owners of a home on Vancouver's west side have continued living in it despite selling it for nearly $4 million last June. Last week, they won a court case that will prevent the new owners from evicting them for at least a little while longer.

      @@wc4109 yes that they would get once they moved out. Those were the terms of the PSA, along with how long they could stay.

    Canadian justice system is a joke. Go reclaim your home by force. Worse case scenario, you’ll do 2 weeks in jail.

    So we have rich squatters now. No sympathy for the sellers. They are 100% taking advantage of the buyers and BC’s joke of a residential tenancy board. Hope the purchasers get lots of money in damages from them.

    It’s not clear who’s right or wrong here… Some said the sellers are squatting, but the buyer kept $100k of the sale price… Now if the buyer agree to pay the remaining $100k (minus rent), would the seller agree to leave? Then we’ll know better…

    The new owners should have given the seller their 100,000 back and it would be done.. Ignoring the request didn’t serve them..

      I think the attorney said sellers weren't paying rent, that is why the buyers are refusing to give back the 100k. Either way, sellers are the scammer.

    They dont owe them the $100k, that money was part of the purchase amount. There are many legal ways to get them out!
    Thats insane! They got their $3.9 million and they are living there. Than i would charge them market rent!!!

    At what point do the buyers acknowledge the role they played in the tomfoolery. This is the fault of the buyers b/c when the sellers requested to remain in the home beyond the closing date (Which is NOT uncommon), it became a landlord/tenant a matter, all of this could have been avoided had they specified the
    terms in writing.(Surprised their realtor did not suggest that).

    hahaha how dumb do you have to be to side with the old couple (buyers) from penticton. They kept 100k as damage deposit and never gave it back now they have squatters to deal with and will probably eventually have to return the 100k. who the hell keeps 100k as damage deposit and doesn’t return it. no surprise they made some enemies. should have returned the money

      You realize that a damage deposit is for... damage? How are the buyers supposed to assess if there are damages to deduct from unless the sellers move out as agreed? It's exactly like how any rental works anywhere; you do a walk-through after the tenant (seller in this case) has moved out.

      @@philisdaman99 You realize there’s limits for damage deposit right? It’s equivalent to half a months rent no matter the size of the property. Keeping 100k for damage is ridiculous. The buyers probably kept such a large amount of money hostage in order to deter them from squatting but the sellers are probably worried they might have to sue and attempt to collect if they leave. These lawyers are a bunch of jerk offs who are just wasting time and collecting legal fees. the 100k should be placed in escrow with a neutral third party such as an escrow company or lawyer and paid to the original sellers once they move out on an agreed upon date.

      @@prabjotplays it's not a rental agreement that was signed; it was a purchase of a property and the limit you refer to does not apply on a property transaction. In situations like this where the possession is a long ways out, it is not uncommon for these amounts to be large because you don't know if something major will fail that far out like a boiler or a roof or something significant.
      I suspect there is more to this transaction than reported as these types of deposits are usually kept in trust by a notary. That being said, the sellers have to move out if they ever want that money released and they didn't do so... that is on them.
      The most likely scenario at the moment is that the sellers have seen an opportunity to live rent/mortgage-free and are taking advantage of it.
