    next city over did eminent domain on a few houses next to local university. they kicked out four families. paid slightly better then regular price, they demolished houses, and then let is set for 9 years. and then canceled the plans to expand on to it, and sold it for huge gain to a developer. leaves a bad taste in mouths of the families they forced off.

      They did the same thing here in Phoenix back in the 80's. Bought a bunch of houses for an East-West freeway throught the middle of the valley. Freeway never got built, but they kidked all of those homeowners off of their property. The people you elect don't have your best interests at heart.

    I have no skin in this game but I’ll always side with land owners. I think the state should have to pay double or triple the lands value if it’s going to use eminent domain.

      this is the government wanting to control the citizens instead of the way it was intended when the country was founded. how can this guy sit and say i will tell you what the land is worth and then pay that amount and take it. if i own something i should be able to sell it for my price, including land. we see homes sell for several times what they are worth because some company needs it or someone decided they couldn't live with out it.

    If they have not even approved the project, they can push the owner off of the property and some politician can sell it to a friend/developer! It's been done before!

      100% inaccurate statement. I was a real estate appraiser for 30+ years in D/FW area and did quite a few eminent domain appraisals for various agencies including a significant area surrounding D/FW airport in mid to late 80s. Remember Walker-Texas Ranger episode where the crazy guy blew up an entire neighborhood of houses? A appraised all of those houses a few months earlier!. Eminent domain appraisals are not like any other real estate appraisals in that they include not only current Market Value (Before the Taking) but ALSO the Market Value (After the Taking) that would include added value BECAUSE of the fact that a major highway would likely enhance future commercial, retail or industrial development value because of Highest and Best Use of at least a part of each property like these current residential/agricultural tracts. The appraisals are 100% unbiased toward either the "buyer" or the "seller" and often actually end giving the property owners far more money OVER the appraised value because the "govt" does want to be overlay fair to that owner/taxpayer. They also pay quite a bit of "relocation expenses". As an example one of the property owners in the neighborhoods SE of D/FW house and lot appraised for around $200K and they ended up collecting nearly $325K total at closing.

      Some people wouldn't sell what they have if they were offered a billion dollars. There is no fair market value, nor even a value above market price, that would compensate them for the loss of their lives as they're living them, their neighborhoods and their local connections, or their homes and all the little things they are familiar with and have enjoyed with their families all of their lives. But if there were, does that change the fact that an unapproved project can be promised as one thing, then be changed to another, more profitable plan, to someone else's benefit?

I mean yeah, this is a kind of theft and it isn't going to get better.     As long as eminent domain exists you don't own anything. Property taxes are rent and they can take "your" property no matter if you pay it or not.

      Actually you get to ask for jury trial to determine fair price. There have been numerous cases where the jury has determined such a high price that the government walked away.

    Eminent domain prioritizes developers over existing residents. A lot of these issues with traffic wouldn’t exist if proper planning took place and the influx of new residents occurred gradually with small neighborhoods. Developers buy rural land and drop the equivalent of a new small town on a rural area in mere months with these massive cookie-cutter housing developments. That creates a sudden strain on utilities, especially when many developers move into an area in quick succession. Then, after creating this strain they insist on taking over family farms to fix the utility and traffic problems the developers created.

    A number of years ago my stepfather and several other farmers had their lands split through the middle and taken for a road. The laws may say "fair market value", but their process was anything but! The first offers were well below market and all the farmers said no. So the county condemned the land and offered even less! All the farmers then had to get lawyers just get to it back up to barely reasonable. Thieves! Every single one of them!

    Best of luck to them. My dad’s farm was taken by the county in 1986 as it was next to the main airport which they wanted to expand. My dad got paid 60.000 and it was worth more than double to that. My dad was booted out and had no choice. When he was forced to sell his apple farm that he spent decades on growing the trees and caring for them he was depressed for the last 20 years of his life. After my dad passed on in 2012 we went back to do the funeral. We drove over to view his old apple farm. Decades had passed and the land had been leased to grow crops and the airport expansion never happened. My grandparents in another state were forced to sell their land to the country and their home was located near an ocean in a rural area was taken over to build condos and to expand the housing but the condos were on a beautiful land area and only wealthy could afford them. This was in 1983 and they were not paid the value of their property. This obviously has been going on all the time.

    My not so humble opinion is that if an authority wants to take land by imminent domain then that authority should pay multiples of the land’s true market value. Say 3 to 5 times more. Then we’d see how d@mn important it really is. Imminent domain is often just gussied up tyranny.

      If that road is intended to be there for the future, then the FUTURE value of that land should be paid. Extrapolate for a minimum of the projected life of the road and pay THAT amount to the landowners.

      They'd set market value...
      I'd say they need to pay 1 & 1/2 times the cost to find & relocate to land that has similar features including proximity to whatever exists now, average of annual rainfall over X amount of years, soil composition, cost to build the exact same house, barn, fencing, etcetera and offset any cost if the new land/home is in a higher property taxed area and so on.

      That's actually a terrible idea.
      So, the ideal case would be buying the land in a normal market transaction. If you're giving people who get pushed out a giant windfall, then you incentivise people from not engaging in the normal process.
      You'd also get speculators buying up all the land around projects at any price, since they could double their money and leave the bill with taxpayers.

    Cap the population in the cities. It would be like the farmer and ranchers reclaiming land to farm by taking developments, tearing them down to plant more crops.

      Then you end up with unaffordable housing. If a ton of people want to live somewhere (demand) and there’s only so many properties due to various reasons, like availability, or as you’ve suggested, calling a population, (supply), then whatever existing properties are so,d at skyrocketing prices. This means that people who have no desire to sell their home have to pay property taxes on housing that used to be affordable. If not for that 10% annual cap on rising taxes, a lot if people would be out of a home from taxes alone!
      And if you’re thinking, “well, they don’t have to live in Austin. There’s plenty of land elsewhere,” they’re moving here for a reason. They end up building on places near her property, and whatever rural town they have now has to deal with that traffic, ultimately needing even more new roads to get these new people in and out.

    I would say not no, but hell no. Stand your ground. Ten times the appraised value is not enough. You will have traffic, noise, and exhaust pollution. What if you had planned to hand that land down to family

      I forgot what state it happened in and a family tried that. I believe they killed a couple and arrested others and treated them worse than animals when they where in jail. I don't remember what happened to them. Obumma was in office then.

      Not always it’s power lines and pipelines also ….we have some property in Texas hill country and we have had this issue several times over like last 30 years once was a pipeline in the 90 and recently high voltage power lines …so far they picked other routes.

    Urban sprawl is like a disease.
    Cities grow and get old and then those old properties fall into disrepair and are abandoned.
    They then just move out and destroy open land and the process continues on and on.
    Redevelop the abandoned run down areas before seizing other people's property.

    Let me tell you our family story. I-95 ripped right through the center of our property. We only sold the strip they needed and held the rest. Future growth and development rezoning kicked in and the roadside parcels each sold for a solid sum for commercial development .

    Why do you need to appease the oil and gas industry. It’s my land and you can’t steal it because some giant industry wants it. Roads have to be built but around property not through it. We aren’t guaranteed the shortest route. No private land should be taken for housing. People have no right to buy a home in a particular area.

    Eminent Domain is used to tell people either sell at a price they dictate or they just "Steal It' in court using the rules they wrote to steal property they want AND in that process you could also end up in jail for any actions you may have taken to try and protect your property. When the Law Enforcement arrive with the Surveying Crew you are SOL.

    Eminent Domain can be defeated if you’re the right type of resident. Hwy 281 South in South Texas takes a detour around the King Ranch bc the family just said No! Of course, they had a little bit of pull in Austin.

    Big cities should build up, not out, "to save the planet".
    I remember Sacramento county in Commiefornia bought land through eminent domain for a connecting freeway, then sold the land to developers.
    Imagine having your land taken by the government for a roadway, then sold to have new homes built on it.

    Those city officials forget that they are not immune to citizens who are tired of being pushed around when the sun goes down. There is no limit nor law I would not break in the protection of my land. These public entities need to realize when it comes to planning upgrades they need to look at other options. rather than a single road being submitted, submit Road A, Road B, Road C, enlarging existing roads, increasing speed limits on existing roads, adding an express lane to existing roads to bypass heavy traffic locations. All of these things need to be put up for public vote and let the public decide, not the public entities.

    this happens all across the United States. I find it extremely sad. Because people when they buy their homes, they’re thinking it’s their longtime home, and then for the county to come take it over an intimate domain in my opinion is wrong. Basically people are being bullied out of their homes. That’s the way I see it. I don’t even own home, I’m glad.

      That Texas Central project is dead. The corporation still owes its 2023 property taxes and HOA fees. The governor may order TC to sell their ROW property back to the original owners since the corporation only purchased 30% of the land needed for the ROW.

    "You can't stop progress". That is a phrase that's thrown a4round to shut people up. Progress being supposedly a universal term of something good. IMO, in Texas, "You can't stop progress" refers to the growth of a metestatic cancer. County residents, most for generations, didn't ask for and don't want the cancerous growth. They don't want to watch their home towns turn into something unrecognizable within as little as ten years. This always fatal, incurable, and rapidly metastasizing cancer is called Greed.

      100% inaccurate statement. I was a real estate appraiser for 30+ years in D/FW area and did quite a few eminent domain appraisals for various agencies including a significant area surrounding D/FW airport in mid to late 80s. Remember Walker-Texas Ranger episode where the crazy guy blew up an entire neighborhood of houses? A appraised all of those houses a few months earlier!. Eminent domain appraisals are not like any other real estate appraisals in that they include not only current Market Value (Before the Taking) but ALSO the Market Value (After the Taking) that would include added value BECAUSE of the fact that a major highway would likely enhance future commercial, retail or industrial development value because of Highest and Best Use of at least a part of each property like these current residential/agricultural tracts. The appraisals are 100% unbiased toward either the "buyer" or the "seller" and often actually end giving the property owners far more money OVER the appraised value because the "govt" does want to be overlay fair to that owner/taxpayer. They also pay quite a bit of "relocation expenses". As an example one of the property owners in the neighborhoods SE of D/FW house and lot appraised for around $200K and they ended up collecting nearly $325K total at closing and they were VERY pleased.

    The most egregious example of land theft through Eminent Domain happened several years ago in Connecticut. People were forced out of their homes, not for roads but for commercial development. People left, their houses were demolished, then the commercial development was never completed. It was so sad!

      I did business in Longview with a guy that once owned a Midas Muffler franchise in Boston. Said the property owner lost to eminent domain so a shopping mall could be built. He received some compensation from Midas for that but had no desire to stay in that region any longer due to the COL.

    The owners of the property need to find out if this is going to be for profit or nonprofit companies because if it is for profit, eminent domain cannot be used against them. And a lot of these highways and roads being put up in Texas are owned by certain LLC companies under different names it’s gonna take a long time to do it, but that’s what needs to be done for these people to save their property just like what happened to the people on the bullet train route from Dallas all the way to Houston they got their land taken, and from what I understand, the bullet project train is not going to be Produced anymore so these people technically had their land stolen from them. Good luck this has to stop.

    The theory in our current times according to economists is that Texans along 135 need to understand what’s coming via Mexico and USA trade. If we replace China w/ Mexico for industrial and consumer trade - the whole of I35 will be insane and I wouldn’t want to live too close to it.

    I was taken aback by the realization that running goats and sheep on a $3.2 million dollar property allows this gal to probably pay less in property taxes than I pay on a little plot of land next to a dusty road surrounded by old trailer houses.
    It looks like someone likes legal favoritism when it suits them, but doesn’t like legal frameworks that don’t directly benefit them.👹
