  • The Jury Has Spoken! Judgment was entered in favor of Johnny Depp in the amount of $10 million in compensatory damages + $5 million in punitive damages (reduced to statutory maximum of $350,000). The question is being asked: "Is this judgment dischargeable if Heard files for bankruptcy relief?" Let's discuss!

    Some added context/background: Johnny Depp sued Amber Heard for defamation (seeking $50 million) based on statements Heard made in an op-ed in the Washington Post in December of 2018. Heard has countersued Depp for defamation (seeking $100 million) for statements attributed to Depp describing Heard's op-ed and subsequent actions a hoax to gain notoriety. The case was brought in the Circuit Court for Fairfax County, Virginia, which was found to be the appropriate venue because the Washington Post (publisher of the op-ed) is incorporated in Fairfax County.
    Chief Judge, Penny Azcarate is presiding over the matter. Depp is represented by Benjamin Chew, Camille Vasquez, and other members of the law firm of Brown Rudnick LLP. Heard is represented by Elaine Bredehoft, Benjamin Rottenborn, and other members of the law firm of Woods Rogers PLC.

    I was a victim of DV, 30 years ago while married to a Police Officer. There is NO WAY, AH was abused in a s*xual way or a victim of DV!
    I’m also an RN of 40 years and that if she was an actual victim, there would HAVE to be medical records documenting the “damage” to her. No way!
    She was even seen on film practicing the ballet seen in the Danish Girl with NO CUTS to her hands, body or feet.
    Had she been a more convincing liar, with evidence not just some sob story, we might have a different case!

      You know,a friend of my sister in law was abused by her police officer husband too. That is the worst place to be in because she could never get them to do anything. O hope you're ok now and away from him.

      There are alot of abused victims who have no medical records.
      And so much as him shoving her up against the wall and sticking his fingers in here wont leave medical damage............it would still be s*xual abuse
      The standard of no physical damage is going to be a tough one moving forward........... just use a condom and cut your nails and hope Toni is on your jury so you can get off and then get off

      I’m also a DV survivor and I haven’t seen a fellow survivor side with her. You’re right, there is just No way she is a victim. She actually reminded me of my abuser. This trial was hard to watch but I had to hang on to see that the jury got it right.

    Johnny should pursue all the damages paid because this woman has never faced consequences of her actions because she was either spoilt or people just didn’t want to deal with her tantrums. she needs to learn to pay for actions.

      I doubt he cares about the money. But going to court publicly I believe was a punishment enough for someone like her. If she does indeed have this personality disorders, perhaps she'll finally realize she needs help. One could hope.

      I don't think he needs to, her reputation is in tatters and no one will want to hire her for anything public. With that 8.35 million dollar debt following her, she will be having hard times for a while. Johnny moving on with his life and away from her and her lies is better for him than sticking around to twist the knife.

    She has no dignity. She will never pay a cent to either charity or to Johnny. No matter HOW she goes about it, she will continue to blame it on everyone else, but be shown, as in this case, a manipulative liar. I believe she has no care or empathy for anyone or anything but herself. She will continue with no remorse or lesson learned.

      @@luisarodriguez5824 I highly doubt that baby is hers. It changes from picture to picture. Like in 1 picture, it's a baby, in another a toddler, then it's a baby again in a different picture. Again, I don't know 100%, so I won't make that claim, but the evidence of her renting/borrowing kids for photo ops is pretty convincing to me. And I'm not usually one for conspiracy theories and gossip. However, this one is pretty convincing.

      Everything that came out in court is essentialy fair game now. You're entitled to your opinions under the first amendment and the proceeding being public means that you can point to it and say it's public domain. She'd need to tred new ground to really move the needle.
      Plus there needs to be actual harm, which would be almost impossible to prove in the wake of the actual trial. You can just say that obviously, people are reacting to that.

    From what I get abt JD's personality and him 'wanting to move on,' he may not pursue the money, BUT, he needs to go after the money, so it solidifies that she won't dare do this malicious fraud again to him nor anyone else with such ease. Otherwise, she will have only learned that she can get away with her devious claims.

      @@danjackson1016 I believe it was proven, Depp has always abused drink and drugs and never been accused of abusing a woman, smashing property to vent and self defense isn't the same thing.
      Amber on the other hand has been arrested for abusing her ex wife out in public. She was also arrested as a teenager to drink driving, which led to the death of her school friend, then arrested again for driving whilst banned..this is histrionic evidence, all of which was omitted in this case, so the jury weren't swayed by it. Yet they still knew she was lying.
      None of her photographic evidence, medical records or witness statements backed her up with the same scenario she painted on that stand, She has no soul..!!

      As a teacher for 30 years, I had many students with ADHD or ADD. One very effective tool for them is graphic organizers to help with comprehension and understanding of complicated concepts. Looks like Rob likes to use them. It helps with understanding for both parties.

    Elaine was just interviewed by Savannah (cBS, I believe) and she said the reason JD won was because the Court wouldn’t admit their “tons” of evidence proving the case. Isn’t this throwing the Judge under the bus? And, Isn’t that unethical for an attorney to do this?

      She blamed the judge, she asked the jury, she blamed Johnny & his team, she blamed social media, she blamed the cameras, she blamed spectators in the room, etc.. The one person she didn't blame, that was solely responsible for all of it, was Amber. It was Amber's fault and Amber's lies that cause all of this and it was Amber's testimony/lies that made her lose, nothing and nobody else is to blame but Amber. .

    Judge Penny was absolutely amazing!! And even further proof of that, is to see how they did a standing applause at the end of the trial 👏 (end of arguments) the entire court room extended their sincere thank you's!! She even mentioned very humbled "oh um thats a first" 🥰🙏🏼

    I disagree on the "secrecy" of the punitive cap rule They should be allowed to award what they choose and if there is a punitive cap, then they need to know that.

      True! A cap that can't be told to the jury ahead of time is beyond stupid. Then what's the point of giving jurors a free hand to set the amount when the amount cant be applied. It takes away jury's consideration of the severity of the wrongdoing deserving of a reciprocal punishment.

      If they know there is a cap they may award a lower amount for punitive damages and they may add more to compensatory because there is a cap. I guess that’s why they aren’t told.

    I am soo frustrated the Jury found Walden’s statement as Malicious (outside of agency issues) when they gave him a sweep that she was malicious and fraudulent. They could have said the statement wasn’t proven (although she submitted false evidence with edited photos and duplicate wine spill) without it being malicious

      The reason behind was not that the incident didnt happen (two different calls to the police etc etc )... it just states that the opinion that AH planned it with her "friends" was false and therefore defamation.

      It’s because the police were actually called and done so by someone other than AH so the jury found that it wasn’t true she did that as part of a “hoax.” They didn’t find for the other two which were far more important because it shows the jury completely rejected the dv claims. The two mil she was awarded, she won’t see that money it will be deducted from the 15 mil she owes JD. Also if she does appeal she will have to put down 10 mil plus lawyer fees. So she’s done no matter what.

      Some of the lawtube heads have said they reckon that they couldn't all agree on that point so there was s bit of compromise on that part of her counter claim which is ultimately better than a hung jury.

      @@ashbash635 I don't think it is because someone else called the police, the statement said she used her friends... but the statement said they did phone call 1, got their stuff together, then did phone call 2. It was pretty clear from the evidence that the two phone calls were close together in time, and they couldn't possibly have done what he said in the time gap. That one statement was too specific as far as speculation goes, and therefore obviously false. I personally may not have blamed Johnny for the agency part, but the falsehood of the statement is definitely the big difference.

      You could have said it all this time little one. But society has taught you that many don't want to hear or care. As a result you didn't feel you had a voice. It makes my heart happy when I hear you say that now you can tell your story because it means you have found the freedom to use your voice. You will still find those who will try to silence and shame you. Don't let them get away with it. Diana Gabaldon, author of the Outlander series wrote a line I think is appropriate here and now. " Truth carries a weight that no lie can counterfeit. " The truth of domestic violence being told can't be hidden. And someone perpetuating a lie of the same subject will always be found out. DV, SA, and DA marks those who have survived it. It is glaringly obvious to some, but easily seen by all who have joined that horrible membership. We will be here for each other.

If you tell the truth then you will he believed, as she was until she was proven to be completely and utterly untrustworthy in every way. While I deplore what she has said and done, by having such a clear cut example of what truth is, it may have been easier for the average person to see and understand what all is involved and occurs in the nightmare world of DV. If we have to put up with her and her unethical and lying lawyer let us find what is good out of the nightmare. She gave us clear evidence that will hopefully take away any doubts or questions of those confused about what DV & SV can involve, who can be a victim, and why it is so incredibly hard for some to escape. How many times have we heard people question, "Well, if she was being abused why didn't she just leave?" That question haunts many survivors, male and female. The average person sees DV as a simple black and white picture of physical damage. They don't see or understand the subtle nuances of pyschological, emotional, and even spiritual abuse. Those people ignorant of the foundations of abuse never consider that the victim is not only trying to escape injury, but also to escape the control and power of a twisted mind. Few ever stop to consider that it is not simply a weak willed person not strong enough to find their way out of the maze of pain and anguish, but instead being unable to escape imprisonment of by a person who violates them physically, mentally, and emotionally every day using their own mental illness as the weapon of choice to inflict that pain and punishment. Like it or not, Amber Heard, with her obvious lies, made many sit up and realize that they are smart enough to know when they are being lied to and manipulated. Unfortunately, Johnny was the person who endured the damage inflicted. But maybe it had to be him, or someone like him of enough celebrity and status in the world to be recognized, kind, loving, and compassionate enough to be believed, and with the quiet power it took to endure 6 years of torture and still have the strength to expose himself publicly, to teach the world that men can be victims too. I gratefully and respectfully thank him for doing that. He didn't portrait himself as someone standing up for all men, but that is exactly what he has done. His quiet strength is awesome and I pray he never has to use it again. But as Amber, hopefully, tucks her tail and crawls into the anonymity of a life where she will, God willing, never hurt anyone else, I will give credit where credit is due. Amber taught us more about recognizing a liar, an abuser, and manipulator then might ever have been done before. I hope the world never forgets this lesson. But the light has now been shown on the ugliness of DV/SV, and the reality of male victims. As long as we continue to focus that light on that problem, and work together to learn, educate, support, and report, it is another form of evil that won't be able to hide in the darkness and claim more victims.

    I am a Canadian Insurance broker. The intentional defamation is absolutely EXCLUDED on every liability policy including a homeowner policy. I represent insurance companies from all over the world. Errors & omissions insurance coverage is kinda spelled out in the name of the policy. She didn’t just make an error she deliberately wrote the op-Ed. She could sue the lawyer who read & ok’d the op-Ed, his E&O policy would pay up to its limit, $5mill is a common policy limit on E&O, although if he generally handles high earners he may have say $10mill (very pricey premiums though & best insurance for businesses/law firms or whatever company is to have strict risk management-risk limiting internal practices).

      @@mom4nz610 You’re right, she couldn’t sue on the basis that the lawyer said DON’T or ONLY use these narrow perimeters & she didn’t listen - went ahead & published what she or others wanted, regardlessly. I think she’s going to sue all the lawyers, including, possibly, the lawyers at the ACLU & Washington Post. This morning Elaine, during her TV morning show interview said Amber doesn’t have $10.3million, but that doesn’t mean she’s penniless or that a friend with deep pockets or group of man hating feminists (I am in the equality including “taking responsibilities equally” camp of feminism & have met some of the man haters) might, on principle, fund the law suits I think she’s going to pursue. Amber doesn’t strike me as someone who will let this go. I believe the mental illness she has is driving many of her decisions. I truly hope she gets long term therapy & controlled medication for her illness, for her sake, Whitney’s, her close friends & daughter’s sakes.

    I am a DV survivor. My case was criminal and when I was removed from his reach he used phone (landlines) to stalk, threaten, and harm me (and my family) for years. My abuser thought because he dialed from outside the county using payphones he was outside the reach of the law. He felt protected. I suffered for years while stalking laws caught up to what I lived, police were able to get warrants to collect evidence, and when the case was heard years of abuse were clipped away because nothing could be used prior to laws being in force. Now we have the internet and social movements - I felt AH was using the media to threaten, stalk, and harm JD. Instead of payphones, Amber used the media and when offered a nonprofit ACLU to continue her attacks. As I listen to this I am disheartened that JD has little to no help from the courts to help him be free from AH's attacks. I truly believe she thought she was outside the reach of the law. What happened during and after the divorce troubles me so much. JD had one of the finest attorneys in CA. Begs the question are there missing laws in CA that allowed AH's attacks to snowball and cause so much harm? This VA case demonstrated AH manipulated people and the ACLU and she thought if she confined herself to personally using the internet she was protected. I watched this trial hoping to find laws existed now to protect a victim from being stalked via the internet/media. It is so sad to learn victims only have legal recourse - there is no way to stop someone from lying even if there is a case that proved a jury found the claims defamatory. Most victims don't have the deep pockets JD does. For me - this case highlights where PRIVACY laws need to focus. We need to be an OPT IN not an OPT OUT culture/society.

      Also, JD was lucky there were no kids in the mix, as her hand would've been strengthened immeasurably, as she & her lawyers would have shamelessly used them, like Angelina Jolie did.
      I have got my fingers crossed that he does not let her off the hook with that fine. She should be made to pay it all to the children's charity.

    The 10million are based on an intentional tort that was found to be "intentional" and "malicious." It is therefore not properly discharged in Bankruptcy. The punitive damages were properly scaled back to $350k under Virginia law, which has put a cap on punitive damages. The punitive damages are also not properly discharged. AH does get a set-off of 2million for the statements of JD's attorney. Total damages of $8,350,000. Further, even if she tries to make a run at BK, she would first have to list, under oath, all her assets, and would only be able to keep the amount scheduled by the BK Court.

      @@artelisx it’s true she has to put down the compensatory judgement plus lawyer fees for bond before she can appeal. It’s a way to stop appeals from being dragged out for years as a way to get around paying. So she has to put the bond down. If she files bankruptcy I better not see her put down a 10 mil dollar bond, if she can’t afford to pay JD then she can’t afford to pay for an appeal.

So if she comes out with that the public backlash will not be pretty.

    "Family" bibles were not just called that for the sake of the family only having one. Family bibles usually had pages set aside containing family genealogical records, so a Bible might be expensive (and usually were until cheaper methods of printing and binding were developed, which was another excellent reason to treasure the Bible if inherited) but depriving a family of their family Bible was basically depriving them of their legal records.

    In my eyes, JD won the moment he brought this case to light. All he wanted was to tell his side and clear his name (which Disney and Warner bros. didn’t care to hear years ago)..and he did just that. You can tell his stories and his witness stories were genuine, whereas AH and her witnesses were scrambling and pointing fingers. She and her team made this about ‘women and DV’ and never had mention of ALL survivors..not just women. Not saying he’s 100% innocent.. however, She also abused this man. But instead of taking acknowledgment, she smirked, laughed, and continued to put her story ahead of his. In the end, I wish them both well and hope they can finally move on and continue on with their careers.

    I didn't find out that I had adhd until I got diagnosed with multiple sclerosis. I was put on adderall for debilitating fatigue from the MS. I told my doctor how much it cleared up my head. I could plan to do things and then get them done a lot easier.
    Normally I would just start doing things then get distracted with trying to do other things and end up with like 5 things in my hands having not actually finished anything. I had trouble speaking and would get confused trying to think of the words I wanted to say. I was overwhelmed by everything.
    The medication helped with so much, but I assumed it was just the brain damage from the MS causing the problems. My doctor figured it out though and assessed me for adult adhd. I've been trying to learn everything I can so I can hopefully improve.

    I love your views about professional jury vs. Lay person jury. Ive been called to jury duty twice. I never actually sat on a jury, but I was so nervous about being selected. I have adhd too. I was worried I might not be able to concentrate. I also feared I may not fully understand the applicable laws and get something wrong. Your explanation on how this is really understood and even expected in a jury really helps me feel like I can do a decent job if I ever do get selected. Thank you!

    It's amazing to hear and see so many comments on ADHD! I have ADHD and know it only for 3 years now, so largest part of my life I was oblivious and suffering from it without knowing what it was that made life so hard. I have a great career but it is sometimes almost an insurmountable uphill battle. It is heartwarming to see so many RUclipsrs who break a lance for and prove the added value and ability to find your own way in life despite or even thanks to ADHD. Entirety off topic but thank you so much for opening doors and maybe burning down the taboos for some still (I for one still suffer from my self inflicted wound of treating it in the dark). So thank you so much! Next to this very important victory of JD to rehabilitate his name and clean his slate of this horrific slander, this is the next major milestone , for me anyway.       @@deecee7042 Amily Baker, Runkle and Rob (I thought) have ADHD. Wether they take medication I don't know. There are basically 2 types of medication: dexemphetamine and methylphenidate. But you really need a trial period with your doctor to figure out which is best for you, there is no one glove fits all.
      I need to too, and I switched once due to the rebound that killed me.

      Mental Health has a lot of stigma with it. It is getting better, at least here in NZ, but still a lot to do. I have a dear family member with ADHD and they do struggle.

      Actually, this was a smart move by the jury by giving her one of her charges (and this most minor one at that) against JD. This way, she is unable to come back and file an appeal of the judgement. By not awarding any compensation for malice is a “middle finger” to her, in my opinion.

We need to dive into how this society leaves families and communities without support and opportunity to rehabilitate trauma. And so mental health untreated as in AHl lands quite often in a harsh criminal system and untreated

    1:03:00 The "sense" this part of the juror verdict that favored AH is the jury bought into AH lawyers' sneaky strategy to question Adam Waldman on the stand even knowing he was protected by attorney-client privilege. No guilt should be inferred by invoking attorney-client privilege but AH team relied on unjustly courting that inference by asking incessant questions that forced Waldman to invoke the privilege. The jury found this sneaky and evasive - - even though they are not allowed to find this sneaky and evasive. That's how the jury found that one aspect for AH.

      I don’t think JD’s team cemented the two police visits & tied it in with the photographic evidence. They did do what Adam accused them of
      so it can’t be malicious as the jury thought.

    I doubt Johnny will actually go after her for the judgement. He doesn’t need her money. It’s a drop in the bucket to him. Even though she definitely deserves it….he just wanted his career and dignity back. His truth has been told and accepted. Her career is ruined. She still owes a good chunk of money she got in the divorce to the charities she “pledged” too. After her legal fees and that…. Before the judgment she’s ruined. My guess is he won’t go out of his way after her for the money.

      Yeah I figured the same thing I can’t imagine he will go after her for the damages. Though I wish he would simply for the fact that she needs to be held accountable. She never been held to account but I know he’s won’t do that. She had no problem with taking him down and completely destroying him she doesn’t deserve any kindness from him.

    (Edited) I thought that Elaine told the jury that there was a cap of $350 000 for punitive (see Edit). She told them that Amber didn't want the $100 000 000, she just wanted $350 000 punitive.
    EDIT: I was looking for a transcript to get the exact quote and didn't find it. So I watched her closing arguments again.
    I was convinced that she said it was the maximum she could get (really fast), that it was a slip, but she didn't.

    The judgement really seems like it was a jury doing what juries do they compromised. There was one or two hold outs that didn't want amber to walk away with nothing.

      Waldeman/Johnny simply should not have published what they did , as it was a very broad sweeping statement which was difficult to prove , as it involved her friends . I agree with that verdict .

And if Johnny Depp didn't ask his lawyer to make the statement, then the lawyer is still liable for malpractice and Depp can get the several million USD from him -- but I doubt Depp wants to spend too much time on that, and he will take his loss instead.

    My youngest son has ADHD ;we diagnosed him at six, he couldn’t concentrate on anything and when he started school by the time he was 11 and having to go into the older school I had to go in and chat with the headmaster because he would’ve got chewed up and spat out in the secondary modern school! He was put on Ritalin, and I think it was risperidone which calmed down the Ritalin so he could sleep at night, but by the time he was a teenager he couldn’t handle the way the Ritalin was affecting the way he was, he got into a lot of trouble, and I think the ADHD is different in every individual my son had it really bad, he used to do his figures upside down and his writing back to front it was crazy dealing with it, unfortunately he , struggled with maths his handwriting but he’s brilliant at cutting hair so there is fours and against with ADHD he was put on another tablet but I can’t remember the name eventually he took himself off everything and he’s dealing with it, so guys well done you forgetting where are you’ve got in your life and future with a darling good job well done, I’m from Cornwall in the United Kingdom so different from America I’m in the countryside, my son loved fishing he could concentrate on fishing he loved it and he used to be able to tickle trout 🥰

      In civil cases there is probably no penalty -- who wants to go after it? Her penalty for lying is that she lost, because the jury did not believe her claims.
