    Once someone is convicted that person’s privacy should not supersede a victims right to know, and to sue a victims family for costs is just plain cruel. I used to look to Canada as a model of a well run country but it’s clearly changing.

      From National Post - a go fund me has been taken down at the request of the victims lawyers.
      “I know your intentions are genuine and heartfelt, but in the end the (government) was forced to walk its position back and waive the cost order, so no money is owing. Further, out of principle I do not charge the families for my legal services. Everything is pro bono. I do not want, nor will I accept any money or payment for what I do,” he wrote to Rollins Thursday morning.

      @@jlys5037When someone is granted PAROLE, they should be taken in by a member of the Parole Board, for the period of their Parole. Shouldn’t be a problem, as they have been deemed fit to return to Society.

    Disgraceful for any governmental agency to do this to these traumatized victims. As the mother of a murdered son, I would absolutely lose my shit if I were billed for anything whatsoever in regards to my sons brutal murder. I cant even imagine what rationale would go through the person's mind who ultimately signed such an order. What in the ever loving world would make a person think for even a minute that those families should have to pay a penny? I hope all of Canada is outraged and voices a sense of horror and anger at this outcome. It's just outrageous. It's not like those families had asked for anything frivolous or unthinkable. It's bad enough that they weren't entitled to that information. Their loved ones were brutally stripped of the rest of their lives. And the policemen were serving their community for God's sake. When someone commits such crimes as this, why do they have any rights to privacy? You take away their freedom, their rights in many other respects, but somehow these murderer's right to privacy is a higher priority than the family's right to know? No people, this is just wrong. To hell with these men's rights to anything. They sure werent worried about the rights of their victims. And so now to add insult to injury, you send them a bill? Has government lost all sense of reasoning? I just dont understand how things like this even happen.
    And it's not the amount of money that I find appalling, it's the sheer callousness that anyone would weigh this decision and conclude in this manner. What the bloody hell is wrong with you people?
    Sorry for the rant, this really hit a nerve with me. A little too close to home. I stand 100% behind these families trying to get the info they requested. They earned the right to know how these men spent their time in prison. They EARNED that right when these men chose to take away all the rights of their victims.

      I'd gently suggest, only if it wouldn't be too much an emotional burden, that if you were to copy this rant as is along with a brief explanatory paragraph for context to your local MP, it would send a powerful statement to someone in government just how much an egregious abuse of trust this is. They won't get the message otherwise

    Canadian, here. I well remember the horrors that Bernardo inflicted not just on his direct victims but on every person in that time. Young women disappearing, evidence of hideous acts perpetrated against them and every female between the ages of 12 and 30 living in fear - as did their parents. This parole hearing resulted in Bernardo (at least) being secretly moved from maximum security prison in ostensible preparation for being released back into society. He is a monster and should NEVER be released to terrorize the populace again. That the government had the unmitigated gall to charge the families of the victims for wanting to know what happened, and WHY the penalties were being reduced is shameful. Absolutely shameful.

    This is gross. I am a Canadian who grew up in Scarborough and was a teenager when Bernardo was called 'The Scarborough Rapist'. It was a truly scary time and I would say the end of my innocence. My Mom had talked to me my whole life about how to keep myself safe, but that was the first time I really had fear that I might not make it home alive from my high school or part-time job at the mall. I would say keeping Bernardo behind bars 24/7 for the rest of his life is definitely in the public interest. While I agree that this is unjust, does the PM have the actual authority to intervene in and/or reverse a court decision? My understanding is he does not/cannot.

    I cannot fathom the concept of unattended temporary absences. I didn't think there were supposed to be vacations from prison, especially for such incredibly violent offenders!

      Usually UTA's are coordinated with some type of expected outside activity if not earned, rarely given near start of sentence and with conditions on them. Most of the ones I knew of were individuals given a UTA to attend a dying family member or funeral where the escort might bring more issue to the compassionate leave. Other reasons could be work/education which was common in youth cases. They are 'unattended' in that the person doesn't have a direct officer next to them but almost always have an itinerary and expected check in times. Also low tier personnel like I had been are usually tasked with phoning each place on the itinerary to cross check the person went where they said they would when they said they would.

      @@axolotllan thank you for the information, I appreciate it. I can see this as being an acceptable thing for non-violent offenders. But for a murderer, I think the law should take into consideration that the innocent people he snuffed out will never get any "leave" of any sort from death. I don't think a violent offender like that should ever be let out for anything, let alone unattended. As we all know, people get shot at work, youth classes, schools, funerals, everywhere. And for someone who should die in prison anyway, I see no point in allowing them to go to classes or school or anything that might help the time go by any faster for them. Just completely opposed to it for violent offenders I guess, and don't understand how it can be considered safe or justified in those cases. I do appreciate the additional info though.

      @@TenaciousSLG I understand, and yeah it can feel pretty unfathomable for violent offences. Most of my work was min security and teens so for me these things felt like part of trying to build trust and get these kiddos on track for better future choices. Though, I know from some friends who worked max security prisons with certain units some violent offenders are only consider risk to reoffend if not medicated for underlying conditions and are only permitted outings supervised or not if they provably take their meds. It's a hard line to hold as to whether the service of our system in strictly punitive or intended to have rehabilatative roots and goals and what we do to reduce recidivism where possible. Another reason an offender might be getting UTA's I forgot to mention is if they are approaching a parole and the board wants to gauge if they will adapt or whether they need a reclassification of terms and conditions as it were.

      The fact that the "partly aboriginal" claim was even a tactic speaks volumes about how perverse things have become. If you claim that genetics magically made you predisposed to committing violent acts, you're suggesting that you are _inherently_ dangerous, not _less_ dangerous. For all I know, maybe it wasn't even an appeal to reason, but rather a lazy exploitation of existing double standards within the bureaucracy... as if that's somehow less of a shame.

      @@PSUQDPICHQIEIWC Well, there are very valid reasons for judges and justices of the peace to pay "particular attention" to the circumstances of Indigenous offenders. There is a great deal of case law surrounding the issue in Canada. Also a couple of sections in the Canadian Criminal Code. It's not about "genetics". I do, however, think that just saying the words "I'm partly Aboriginal" is pretty lazy. On everyone's part. Especially in Ontario, where that happened, where there are significant resources for delving into a person's Indigenous background and circumstances.

    I remember learning about Paul Bernardo and Karla Homolka as a kid watching HBO's Autopsy. Whatever you think they did, it's actually so much worse. The idea that families of victims are paying anything is disgusting.

    What a blunder from the government's part. I hope they think very hard about this nonsense and decide to give the families their money back. It is ridiculous. The only thing that would make this even more scandalous is if the inmates received any money from this.

      Thinking about the wellbeing and best interests of the public doesn't seem to be a factor in our current government's calculus. They are not interested in appeasing public outrage, but do seem to enjoy belittling and underestimating a great number of citizens.

    Why did the government stop the demand for payment? This is the same government that allowed the parole board to transfer Bernardo to minimum security and NO ONE said a word about it to the families. Where was the respect for the victims?

      MPs emails are usually public information, so you can write there. Also you can try writing to your state senator and have them try to push against Canada. Whatever goes down in the USA tends to trickle up north to Canada.

    Sadly, this doesn't even come close to cracking the top five ways that the Canadian "justice" system utterly failed the Mahaffy and French families. The following is a short chronological list. I would order them by vileness but it is all so vile, I don't even know where to begin ranking this:
    1. Failing to catch the Scarborough R word even with a description of the car, perpetrator DNA off victims and DNA from the criminal. This would have put the husband (I will use husband and wife as I dont' want to even type the name of the two criminals involved) behind bars before the girls were ever kidnapped.
    2. Failing to investigate the death of Tammy Homolka properly and writing it off as an accidental overdose. Second chance to stop this couple before the girls were kidnapped.
    3. Failing to find the multiple VHS tapes of the crime during the execution of a search warrant of the couples house. From all accounts during the trial, the tapes prove both the husband and wife were full participants in the crimes.
    4. Then there is the lawyer who went into the house after the search and removed the VHS tapes so the police wouldn't find them (the husband told the lawyer where to find them). In the US I believe the lawyer would have been obligated to turn over the tapes. Not sure that is the case in Canada. Instead, this guy held on to them for 17 months even though he was horrified by them.
    5. And let's not forget the sweetheart 12 year deal the crown made with the wife. She seems to have the ability to wrap men around her finger.
    6. The justice system did make her serve the whole 12 years. Of course once she was out, the system was going to let her apply for a pardon so she could travel out of the country with her new husband (the brother of her lawyer). Only after incredible pressure from the French/Mahaffy families and the public did the politicians finally act to stop this from happening. The politicians couldn't even do this on their own.
    I am sure there is more but these are the immediate lowlights I can remember of the total failure of the system. To be honest, charging the $4,000 is one of the nicer things the system did to the families. Our justice system handled and continues to handle this so poorly it is amazing the full amount wasn't ordered.

    So disappointing, perpetrators of crime have more rights than victims despite all the self serving words of those who would speak for the Canadian Justice system. I have always believed that the legal profession and our politicians look down upon the rest of us. There is no compassion or empathy in their eyes.
