The Constitutional Sheriffs movement subverts democracy

  • The Constitutional Sheriffs movement relies on a belief that county sheriffs have the power - and the duty - to make their own determinations about which laws to enforce and how to enforce them. It's not just enforcing laws and following the constitution - it also involves resisting laws, nullifying and refusing to enforce laws that a sheriff has deemed somehow unconstitutional. Whether used to oppose mask mandates or gun restrictions, voting laws or immigration policy, the so-called “constitutional sheriff” movement is an overt abuse of power. There is no constitutional basis to back up their theory of sheriff supremacy, first of all. But it’s also a sign of something bigger. It’s a twisted interpretation of the constitution in order to assume power and subvert the systems of our democracy.

      I'm watching from rural Alaska. We don't have counties or Sheriffs here.
      We have very few laws and very little law enforcement.
      My community has four officers. If one started "Power Tripping" they would be removed before it ever became news.

      psychopath, not sociopath. he former is the one that does not care about empathy, and uses people and conditions as best they can. They are also the planners...Sociopaths are much more the "losers" of life that commit crime, but can feel guilt...just cannot stop themselves. The abused becoming the abusers for example.They tend to be loners and cannot hold jobs, etc. The psychopaths are the "winners", by that meaning the hold jobs, fool people, and often high achievers. They know how they have to act, but it is just that an act...So they would be the ones to USE the sheriff, not the guy that the sheriff thinks is an eccentric bum.

Because, just like in Arpio's case, that means he doesn't have to consider YOU to have any rights. A Sheriff who considers himself above all laws puts you 100% at the mercy of the King Sheriff of whichever county you reside in. That's insanity.

      I hate too break this to you, but its not loyalty to the NRA...It is from Rural America and they love their weapons. I live in rural Illinois, and have one of those sheriffs that refused to obey the law ( they hate Pritzker around here), but that refusal had nothing to do with the NRA, Rather it had to do with refusing Liberals. pure and simple anti-american rhetoric the right have thrown around so long it has taken root in their ignorant brains.

      Slavery was abolished by the 13th Amendment. Doing so was not within the powers that the Constitution granted to the President. The Emancipation Proclamation was an Executive Order, a law that applied to Federal Officials ranking below the President.

    They need to be told that it is for the courts to interpret the law. It is their duty to enforce the laws. These constitutional Sheriffs seem to believe that they are police, judge and jury. Constitutionally they are bound to uphold the laws passed by the state and federal legislators. That is their job.

      during the early 1800s (before the passing of the 13th Amendment) there were local sheriffs that would refuse to prosecute runaway slaves even though it was state law.

    It's not the job of the Sheriff to deem something constitutional or unconstitutional, that is the job of the courts. They need to realize they are just the grunt's, and they need to uphold the laws. Not pick and chose which ones to enforce. And if they don't, they will find out just how powerful the FBI and Marshals are.

      Remember Sherrif Arpaio? His investigative team proved that the Obama birth certificate, presented to the American people as a genuine document, was a computer-generated forgery. It proved that Obama was a liar and that he might not even be eligible to be President. The Obama gang went after Arpaio with a vengeance, tried to put him in jail, to shut him up. The fake news people towed the party line and trashed Arpaio relentlessly. When Trump took over the WH, he immediately pardoned Arpaio to put a stop to the abuse.

      I’m a liberal gun owner. It amazes me how tone def MSNBC types can be when It comes to topics like this. We’re all for sanctuary cities, and jurisdictions that refuse to enforce bad immigration laws, but get upset when people who disagree on other topics use the same strategies. Only then does it become a crisis that threatens our very democracy. If the people who elected these sheriffs wanted the laws enforced, they’d elect someone who would enforce them. If the federal, or state government want these laws enforced, then they should use federal/state agencies to enforce them.

      @@USS-SNAKE-ISLAND , I know. My husband was LEO. He told me this would happen while he was still alive. Back in the early 90s it was the very beginning of this. PDs across the country were changing, PDs were hiring people unworthy of the job, and they were getting military equipment that they never had. He was very upset that cops weren't being vetted properly and he had to constantly correct them. When PDs began offering early retirement, he took it. He said he wanted NO part of that anymore. He was a Sarge, and he LOVED his job because he loved people and was good with them. He was great PR for the Dept too. I knew it was SERIOUS when he said he was going to leave the job that he loved. And I've been telling people this for at least a decade plus. This has become so SO bad. AND I can recall when sheriffs were not allowed to show their political affiliations. As soon as I saw them openly getting behind politicians, I knew that this was exactly why he left and how bad this was going to get. He must be rolling in his grave over this crap.

As a Brit who loves America, I know that the Constitution of The United States (1787) was written well over 230 years ago - at a time when normalcy, rationality - and even some measure of 'trust' - existed! Very sadly, it was never intended for America in the 21st century! In many ways, some 'Amendments' to the Constitution of The United States (1787) are, so sadly , causing more "harm" than "good" today in 2023!

    The 2nd Amended gives the state the power to regulate the militia. The governor/the state legislature make/execute the state law, not the sheriff. It's the duty of law officers to follow/enforce the law, not to decide what is law.

    The constitution gives powers to 2 Governments STATE and FEDERAL. The states delegate their powers to county and local governments. Which means the State can revoke those powers of law enforcement from sheriff Agencies.

    We had one of those in Mason county Washington. His name was Casey Salisbury and after background checks for guns was voted in as law, he stated that he would not enforce the law because he didn’t believe in it. Yes, the voters that pay his salary had a sheriff that refused to enforce the law. He is now gone (thank God). There’s a new sheriff named Ryan Spurling. Going to check to see if he’s one of these right wing cowboys. Sure hope not. If you can’t do the job you were elected to do, you need to GO.

    A sheriff's authority is limited to his jurisdiction, but can decide whether or not to enforce state or federal law. This is an important part of the system of checks and balances that helped make this country so resistant to central power for so long.

    I'm still looking but as of today I still haven't found where in the constitution it says we have a right to own AR-15 style firearms. There are those that say in the time of our founders freedom of the press involved ink and paper and our rights should be adaptive to new technology. Maybe that's true. But there is big difference between spreading as much information as you can as quickly as possible and spreading as many bullets as you can as quickly as possible.

      The fact that the democrats are more concerned about television pictures of crowded detention facilities than they are about securing the border tells illegal aliens all they need to know about what their odds are if they cross illegally in huge numbers. Already there are 60,000 migrants massed at the border, and another 150,000 on the way. The more who cross, the fewer who get detained and expelled, owing to the Biden's real priority: the fear of those news pictures.
      Illegal aliens aren't stupid and can read between the lines of messages. If Joe's priority is avoiding those overcrowded news pictures, then for them, the more who cross, the better. The democrats are truly sick people who hate the USA ! FJB !@!@!

The 2A is thus seemingly both insufficient and unnecessary to prevent tyranny from within -- a governor calling up and arming their state militia should it ever come to that would not be impeded in any way if those words didn't exist.
      And on the other end, one could argue that the 2A provides a useful tool for would-be tyrants -- much like these sheriffs want to be the final authority on what is or isn't Law, if you're making a proclamation of tyranny without democratic backing, you're no better (or possibly worse) than the supposed tyranny you seek to supplant.

      It has actually been proven that states with constitutional carry laws have lower per-capita levels of crime.
      This stat makes perfect sense when you think about it, you are far less likely to commit a crime if there is a good chance the person on the other end has a loaded gun on them.

    The ability tp decide whether or or a law is unconstitutional or not does not recide in law enforcement, but in the judicial branch. A sherrif could bring a case or suit before a judge to challenge a law they believe is wrong, but they have no authority to ignore it. None. Hells, the very document they claim to uphold clearly states the authority of state and federal law, and most states reserve the right to terminate a Sherrif if they refuse to do their job. The FBI also has the authority to investigate local law enforcement and remove them if necessary (happened twice in my area in the last 15 years).
    So what I see here is a bit of a spine problem. If sherrifs are refusing to enforce laws, remove them immediately. I can understand disagreeing with a law, but thinking you are above it and capable of judging it on your own is NOT a power any sherrif has.

(Basically, the far eastern and southern part of the state) The justices decided 5-4 that an eastern chunk of the state, including its second-biggest city, Tulsa, should be recognised as part of a reservation.
      The ruling means some tribe members found guilty in state courts for offences committed on the land at issue can now challenge their convictions.

    The right to bear arms does not mean you have the right to bear whatever arms you want. Your right to a firearm shall not be infringed, but there's nothing in there that says you that right to any type of firearm you want. Your rights would not be infringed even if the only thing you can get is a handgun. Enforce the laws that are passed, or step down.
