      To understand what happened we need to think like a piece of @#%$ so, this is my theory, Nintendo Intentionally leak Zelda TOK and they know will not run with the current version of YUZU, they wait until Yuzu team Bait and modify the code and release it on Early Access, that way Nintendo Sacrifice a Litle bit of their profits to shut down this project. Proving inside the YUZU project theey use piracy ROMs to test it and made TOK able to run before the legal Release.
      I m a developer , but is not that hard to just think like an evil corporation , they will sacrifice that little profit to kill the entire thing. really is not that hard, If you want to cach them just made this bait and you got them.

      @@GamerEnLinux but that isn't how any of this works. What companies have to do is: protect their ip or risk losing it. The fact they are suing on grounds of 'providing access' rather than 'copyright infringement' shows they are taking notes from Apple. The fact Apple has stopped thr FBI, EU government, and continues to do what they want regardless of harm it causes to consumers, speaks volumes to the year Nintendo is living in. Almost like it's 1945 again.

    I'm not giving up. I downloaded everything for not only yuzu, but it's alternatives as well. And since dolphin was under attack not too long ago, i grabbed their source code too.

    Here's the reality:
    Popularity can become a double edged sword. When you have a whole fleet of big RUclipsrs posting thumbnails of them holding freaking Ayaneo Kun running TOTK and the thing generates millions of views - something was bound to happen sooner or later. None of this is surprising to me.

      they agreed to pay Nintendo 2.4 million and stop all development of Yuzu and give up their website to Nintendo. @@nepaliprayasgurung2594

      They paid 2.4 millions to solve the dispute, presumably the contract is that they continue to develop it for free and without promoting piracy

      The idea is that you cant emulate still market available systems, especially those that have also protection measures. An other thing is that you dnt have to make profit from it or redistribute roms. Ideally pirate before gamecube systems that have no protection measures.

    If Nintendo allowed you to download your digital copy or had a “gamepass” we wouldn’t be talking about this. They can get ahead of it but they want you to buy multiple consoles and multiple copies of games. The exclusivity itself is creating its own demise.

      It's a failure from Nintendo's side of providing the older games on modern hardware. If all companies did that there would never have been an incentive to use emulators to begin with. Blaming the users... Ridiculous.

    I'm with Bill on Preferring digital. But for me, I'm not into packaging waste. But also not into trusting a company to maintain my access. This is all only if I'm able to download a backupable version. Then let me do it in my proffered way (M-disk, 1000 year data shelf life). Yes those will also be packaged, but one package for hundreds or thousands of items (2 packages if you count one for the drive).

    Don't know what Final Fantasy VII Remake you were playing but the Final Fantasy VII Remake me and a lot of other people played Barret was and is f'ing awesome. The voice actor for Barret Wallace went above and beyond, for me he is Barret.

    What angers me the most is Nintendo doesn't even want people having access to the games that they paid for when the hardware break's down.

    This is a more unique case I think. Emulation is still legal, there's legal precedent for it to exist, but the thing is Yuzu was a supposedly free and open-source project that charged users for access to it's EA builds which were all but essential to play Tears of the Kingdom at launch. So the Yuzu team was able to profit off of the piracy of Nintendo's current generation games.
    All in all, not much of value was lost here. We still have Ryujinx which is a great emulator, and I'm sure a lot of the Yuzu team will probably jump ship to Ryujinx. Personally, I never really liked Yuzu since core members of the team have always been kind of sketchy. There's a history of them stealing code for one.

      Yup. Yuzu devs charging money put a huge target on their backs. Never mind the irony of wanting to be paid for their work... it's kind of hard to make the case that emulators are purely for research purposes if you're making a commercial product.

    1:20:52 yes I did not like that, example here: I play league of legends and used to use an companion app (for like matchup suggestion or picking my runes), and one day they had this exact genius idea of "while the game is loading lets put our banner ad on the loading screen", I was so mad instantly uninstalled that thing.

    As I understand it, the company making yuzu is now injuncted against continuing to develop or distribute yuzu. Since it’s open source, though, it will be trivial for someone else, who is not subject to the injunction, to create a fork of the emulator and continue development.
    This probably will have a chilling effect on donation-funded emulator development, though.

      It wasn't donation funded though, they charged users for early access builds. YuzuEA was almost entirely neccesary to play TotK at launch as well.

      @@DragunBreath Yeah, and even though the developers of Yuzu are no longer able to make Yuzu, I'm sure plenty of the active contributors to the project will move over to Ryujinx.
      Well, most of them, some of the Yuzu devs stole code from the Ryujinx dev PineappleEA so there might be some bad blood there, but Yuzu had a lot of other contributors seeing as it was an open-source project.

    I know the latest stories of the lawsuit, but just wanted to say that 20:16 is a good point. It’s better to just not settle this in court because a) it saves more money in the long run, and b) it helps to prevent this case from becoming the new reference case for future cases. I think Yuzu did the right thing here to not go to court and just settle outside.

    When you say they want us to buy the game again remember they are only selling the license and can take it away at any time. We don't own our games any more. Someone needs to do legally challenge their terms of service on how they can "sell" games so that they can't take them away just because they want to.

    So much speculation and FUD over this. Emulation isn't going anywhere, folks. This same discussion has been had over and over, ad nauseam, since the dawn of emulation. Emulators that use proprietary code get shut down, which has also been happening since then. Anyone else remember Bleem? Did that stop PSX emulation? Nope. Did it stop emulation in general? Nope. Will this? Nope. It's not even going to stop switch emulation. Would it have been better if Yuzu fought this? Not necessarily. No court case = no legal precedent set. They took the L, and the big N doesn't get a day in court, which is probably what they actually wanted.

      It will remain there unless emudeck does something with it, (Assuming you installed it with emudeck)
      However it will no longer receive updates, which means no improvements will happen (and no exploits will be fixed if any are found)

      @@malgerx4295 Oh I don't doubt it, but I don't think anyone is going to going to repost it without filing the serial numbers off first. Which probably means you wouldn't be able to directly update Yuzu to this new fork, though admittedly I don't know how Yuzu self-updates.

      @@BlueCollaredGrit Don't know that program, but generally with programs that aren't DRM-filled, it'll just stay there.
      I would recommend turning off automatic updates, although it looks like Yuzu doesn't have those on quick glance.

    I don’t necessary agree with Phawx either. Like, no matter what specs a console has, it will get hacked and emulated anyway. These factors helps to make Switch emulation development easier, but it doesn’t mean it’s the prime factor that Switch emulation exists, that’s crazy and kinda stretching it out a bit there.

    These days Nintendo are basically leeching on customers for profit. They are literally some of the worst companies when they are doing well. Because of it, I hope the Switch 2 fails miserably so they can get a reality check where they are required to win back their customers and fan base again. Because that's the only time Nintendo are actually good (and with Iwata at the helm, bless his soul). The best period to be a Nintendo owner for me was during the Gamecube-, and the WiiU-era by far,

    I disagree with Bill’s notion that Nintendo wouldn’t try this unless they felt confident in winning. They’ve done it before and know the most likely outcome is what happened here: the small guy settles. But even if Yuzu had fought and won, it still wouldn’t have been legal to share ROMs online. So even if courts rules that people could back up their own games and emulate their own machines, the common practice of downloading emulators and ROMs still would’ve been untouched by the ruling. And ROM sharing is never likely to be legal.

    the biggest issue is that amazon/nintento/etc are trying to blame and hold accountable the "provider" of a product, rather than seek out the actual individuals who may be "breaking" a law/rule, thats the bigger and more worrying precedent and they are getting away with it. It's no different to blaming a car company when a driver kills someone at a pedestrian crossing. emulators and emulation front ends like emulationstation should not be able to be dropped or attacked as "facilitating" anything as that is attempting to give direct blame for something they have not done, the end user is always responsible for their own actions.

    Bought TOTK twice, special edition and digital copy and still would rather play it on my PC . Now i wish i had only bought it once . Their actions against the emulation community have taken me 100% the market for anything nintendo. So funny how nintendo uses emulators on their own consoles Lol

    I've been playing games by emulation since back when it took 6 hours on dialup internet to download Zelda 64 because my parents wouldn't buy systems for me as a kid. With that in mind Switch emulation has always been just a novelty to me. The switch and its games are so easily accessible. Emulating any of the big 3D games like Zelda on a handheld is not enjoyable to me because of all the shading cache stuttering. I much enjoy playing older systems that I wasn't allowed to play as a kid.

    I can't get behind your assessment of FF7. However I am a major FF7 nerd so a lot of my love comes from nostalgia. I just replayed Remake to get ready for Rebirth, and its great!

    In some part content creators contribute to this, because every single new console they got their hands on the only thing that was done was emulating. This is a very sensitive matter that shouldn't have had that much exposure.

    From my childhood(probably 2001), I had a lightsaber that had some buttons and a small screen in the middle of it and had a simple game loaded on it. I loved that stupid thing. Its One of those things that if I could emulate it I would not waste my time but if I ever found another physical model I'd probably play the heck out of it

    i found Russ' take on 'all the young people are gonna draw attention to it online' very funny, because i see history repeating itself here. in the late era of the GBA being a thing (think 2004/2005) were it was still a relevant console, it was already super easy to emulate it, and online forums and the like were full of kids (let's face it, we were just kids, even in our late teens) discussing how to get certain games to run best (i remember the pokemon games, aswell as kingdom hearts on the GBA specifically needing some adjusting with the save format with popular emulators at the time).

    I’m not buying Nintendo products anymore. I understand the Yuzu situation but Citra?! This will only make used games more expensive.. Nintendo should sell their rom’s like GOG after console death. Nicely zipped, tons of goodies. & then they get paid again & again.. Nope! It would cost them too much in license fee’s or whatever BS

    Truly depressing! Just tired of Nintendo insisting of recharging for the same games over and over again, poor refund system, anti-consumer and fan policies.
    At least Sony and MS get it. Where they allow their fans to play their games on PC!

    Game & Watch titles are often genuinely fun. Super Mario Bros Game and Watch was my childhood one, first video game I got. I also had a few other simple LCD (Tiger, etc) games, and they are garbage in comparison. Nintendo game designers really understood the limitations and how to work with them WAY better.

    Nintendo is guilty of unlawful behavior by like extent. Like the economic model or not, we are in a capitalist model (those which this pertains to). The writings capitalism came from, express the problems with monopolies. For decades, we have been slipping to allow more and more monopolies, or situations in the spirit of monopolies. These are expressed through duopolies, exclusive rights for distribution, walled gardens and ecosystems. Windows encryption itself, what they are defending, is unlawful by the spirit of the law. Purchasing software and media should be the consumers choice for how they consume them, and if they mod them. The hardware they use should be the consumers choice separately. The OS and/or launcher should be the consumers choice. This is what drives the virtues of capitalism. Innovation, competition, and the marketing self balancing itself. These spiritual monopolies has for decades now been becoming increasingly the ruin of capitalism. I am not a capitalist, I am anti capitalist, but I understand its virtues when it applies. And the law is supposed to be in line with those with those virtues for healthy economy. Making breaking these things unlawful. So at a MUCH more core level, Nintendo is already unlawful. This is where I'd like to see the change. Which would make Nintendos complaints become a non issue. You could even go so far as applying abelism to companies participating in the walled garden / ecosystem / exclusivity features.

    I’m okay with buying digital when the price makes sense to risk not owning it forever. In that sense, I don’t mind buying steam games when they’re on sale, but I do not understand why people would buy digital titles when they are the same or more than physical copies. It’s only a negative trade off at that point. I buy 90% of my Nintendo Switch games physically and I wouldn’t buy any PS5 or XSX games digitally when the console remains at home right next to my physical games.

    The Retrotink 4K is absolute one hundred percent worth the money IF you are a retro enthusiast who wants the best quality. You don't even have to use all original hardware, you could get a MiSTer FPGA and connect that up too.

    I'm like rich, I like retro games and have fond memories of them but most of them did not age well and I find myself playing for 5 minutes and moving on to modern gaming...
    however, I do tend to appreciate modern games that remind you of the older games like bloodstained, ori, axiom verge, etc.
    Oddly enough, I can't play a handheld game while sitting on my couch. If I'm on my couch I'm looking for a console to play on...I can't have a TV on and play a handheld game during commercials...I know some people do that but I like to have my undivided attention when gaming...but that's just me.

    That donkey Kong game is a lot of fun, you can play it in Game & Watch Gallery 3 for Gameboy Color, it has most of the games and they include a remake version

    Yuzu need to create a crowd support legal fund, so we can all stand up to this corruption and greed, makes me sad to be honest, I grew up with Miyamoto and co., to see Nintendo slowly turn into EA, and just a company that puts out a tiny handful of AAA games every few years, they used to put out such a diverse and gameplay rich roster of games each year, even the Switch had Snipper Clip at launch, to never be seen again or anything like it on the Switch, BOTW and TOTK are incredible works of art, but does a good Zelda & Mario game every 7-8 years really compare to Nintendo of old, we don't even have those delightful pick up & play traditional handheld games they used to make any more, the comfort fun games.
    The gaming market is really missing so much of what made games fun just 10 years ago, to think we once had the likes of Sega & Nintendo in their prime, Rareware, Valve, Blizzard North, Creative Assembly, Rock* North, LucasArts, Sierra, Factor5, Ubisoft Montréal & Ubisoft Montpellier in their prime (they were legends once), Westwood Studios (miss these guys, no one makes good RTS games like them any more ), Illusion Softworks (Mafia), Rocksteady, we were spoilt, now all of these great dev houses are pretty much dead, or close to it, I just want to see a game dev like Sega or Rareware make an appearance, to put out those really high quality gameplay rich games we used to get, games like Pilot Wings, Crazy Taxi, Chibi Robo, F-Zero, Space Channel 5, Tetris, kuru Kuru Kururin, the AA Arcade type games, that was the core of video games imo, also bring back decent video game audio and music, MIDI 2.0 is incredible and should be made use of in video games.

    🎉I think it's actually a big win for emulation! To not need to go to court with Nintendo by Yuzu's negligence is a big win. Yuzu should have been making it abundantly clear that they are not interested in illegally promoting their site/program to where it would seem actually laughable for Nintendo to direct lawsuits against them. Perhaps they would have needed to change the way you use Yuzu with prodkeys and such but still, they could have been covering their a🌞🌟es way better than they did.
    Moving forward I think if console companies are going to be using developer's games, they will need to embrace emulation, because people need to be inevitably and unabashedly free! Ownership of games is important, but gaming is first and foremost about people and creativity. If people cannot feel connected and free to use games in ways that advance and build upon them, then the sovereignty of people and the world at large will be proven to be in jeopardy (as our reality at this very moment).
    Perhaps gaming needs a union!? The revolution of gaming can have fresh air breathed into it, and people can really ENGAGE with the games like never imagined! Right now, I see Nintendo as a bully who does not think they can play well with others and find emulation to be an enemy. It is far from it! But if this mega corporation is going to view it like a threat.. then they will have to go through lawsuit after lawsuit to preserve this monopoly over the rights of games and their creators. So many people put their talent into these interactive works of art, and I'm sure they could have more to say than what we hear from Nintendo, the big dog. If everything is gravy for them, then they don't need to say much, but if there are some out there that see a brighter and expansive future for the games they create and play - well make it known!
    When I paid for a game from Nintendo over 20 years ago, I have no remorse for them not charging me again in 2024 for the same exact game. If they can double charge millions of people, then we have a right to replay what we own on newer technology. This isn't a one way street and this IS A DEMOCRACY, at least that's THE IDEA anyway. Nintendo may be too big to keep up with the changing times, but don't worry, something better will take it's place that understands where our technology and interests as a whole are headed. ❤ All will be made right as we move into a new age of many innovations and added freedoms. It will be a struggle to reclaim our rights and separate ourselves from authority and capitalism/cronyism but IT WILL HAPPEN! Power to THE PEOPLE!

    I think I mentioned it before but I think Carey would love Scarlet Nexus, that game is like on the verge of being a devil may cry action game but with light JRPG elements without the grind.

    Nintendo just won 2.4 million dollars and got Yuzu to close operations. But hear my words, the harder the console is to jailbreak, the harder the console is to sell. And nintendo will find this the hard way on their next console if if cannot be hacked like the switch was, and that's when nintendo is gonna lose more than the 2.4 million dollars they just won plus a low console sales. This was what made the PS2 and the switch to sale this much. I saw this video form another guy who mentioned this and it makes perfect sense.

    To my understanding, the legal terms that apply to any software are the ones from the time when they released the software. So a company cannot come up with newer terms and conditions for old software media unless they did a remaster or new media.

    I also already had TotK preordered when I downloaded the leak and played it on Switch. Checked it a bit then I put it down and waited a few days to pick up the actual game. Then two weeks ago I traded it in towards Final Fantasy. The lifecycle of a $70 purchase.

    Horizon zero dawn, days gone...
    Those games I am currently playing on my steam deck legally.
    We want PC as a first citizen platform.
    If you sell Pokemon 5 years later for pc, I will still buy It.
    Sony understand that PC ports are double money. Money on release and money 2 years later. Everyone Happy.
    I would wait 2-5 years for a Zelda breath of the wild pc port.

    Separately from video games and Nintendo, I think encryption breaking will first be litigated in prescident setting trials due to quantum computing and ML concerns. This ruling will trickle down to video games.

    Decryption will just now have to happen externally from the emulator. Roms will be decrypted and then played decrypted on an emulator.

    If the switch 2 is digital only, I won't buy it, honestly Nintendo really has not been hitting it home with me in terms of gameplay anyway. So I will be done period as a long time Nintendo fan.

    I think it's fair to debate why Nintendo has a piracy issue, but I don't think it has much to do with the difficulty. Over the years, Nintendo emulation has actually been some of the toughest to get right. They do however have some stake in the why. I am 45 and even I can't afford the prices of the games. 5 to 10 year old games they still want 59 to 89 bucks is stupid. I have a Switch and I have not played it in over 12 months. Why would I by the 10 or so games you can't get anywhere but on Switch when I can take that money and get many 100's of games including an entire library of stuff I already bought.

    If Emulation is so detrimental to Nintendo, their best bet for the future is not only a super closed secure system, but one very very powerful. Even if the console is jailbroken, an emulator that could run its games could take a long time before becoming possible tu run games. Look at how long it took RPSC3 before it could comfortably run a vast majority of games.

    I truly believe if Nintendo put as much money into their hardware and software os features as they do their legal team, pirating wouldn't be such a big issue for them. I'm on the side of what Gabe Newell had to say about piracy. It's more of a question of services than it is a person just trying to get a free game.
    Just take a few seconds to think about it. Let's imagine the Switch as a much better console than it currently is now. When the games are running smoothly and you have all the features of Xbox and PlayStation consoles. Less people will go through the headache of trying to make their games run on a different platform.
    Too many Nintendo games have a hard time trying to stay at 30 frames and it's been that way since the system released. You can play a Zelda game on a moderate PC with all the added bells and whistles with mods and you don't need top tier PC hardware to do it. It's much easier to buy a PS5 or Series X|S game compared to the headache of emulating those systems. And you miss out on features those consoles give you if you emulate them.

      I agree with you, and have another reason for doing so. What about my save files? You have to pay for a reoccurring subscription for cloud backups, but not for all games. Games like Pokemon or Animal Crossing. You know, the games you spend a lot of time in and probably would want a backup of saved data for.
