Hi Carrie, I'm back from farming (amen) and trying to play catch up. You are one brave woman attempting to tackle such a huge, complicated topic in 5 minutes that some lawyers have dedicated their careers to...lol. Hopefully, your disclaimer has clued people in that they need to do their own research & check every single time because of all the exceptions like Daphne's Diary, Edith Holden, copyright extensions, copyright held in trust by lawyers/art galleries etc. etc etc. All you & I did was raise the topic & issue the caution. I hope all is well in your life & that there are no natural disasters heading your way. Hugs my friend, H
Yes I thought about the implications after I filmed....hopefully I did provide enough of a disclaimer. Glad farming is done for this season! I'll catch up on your vids this weekend so I can hear about how it went. Big Hugs!
Peg I get it! There are so many things about junk journaling, heck about life that I don't know. Let me know if there is a subject that I can research for you and go a quick video on.
The copyright thing is definitely confusing, I know with daphne's diary magazines, you can create journals and crafts with them. You can gift them but not sell them. What's really confusing to me is books and old catalogs. If it says copyright but I see countless creators using the pages in their journals they sell, so my guess is they can use them in items they sell just not make a copy and then sell?! If you could clarify that, I would love to know, also with the ideals magazines. Thanks, Carrie!!❤️ 😊
Kathy let me give you an example of what you may be referring to. I sell Little Golden Books that I have made into junk journals. All of these books are under copy right law. However there is a law called "first sale doctrine". This doctrine allows you to resell, alter, or repurpose a physical item that you own, even if it's copyrighted. But there are some guidelines still that you have to follow. I'll put first sale doctrine on the list of "who knew" videos to do in the near future. Thank you for asking this!!!
The last time I looked up copyright for Stampin' Up rubber stamps, they allowed you, after you purchased a license that came with a stamp to add to the back of your cards, to create 100 hand stamped cards for resale. That's it! The license was something like $36.00 at that time. Now how much would you have to sell your cards for to make a profit after spending money for the license, the rubber stamp(s), the paper and your time?
Hi Carrie - I am curious as to whether we can show Magazines on our channel such as Daphnes Diary or the Uppercase Magazines for instance? Thank you for all of the info! xo Mary
Good Morning Mary, you can but you still have to be careful. Sharing magazines like Daphne's Diary or Uppercase on video can fall under the "fair use doctrine". Now let me do my little disclaimer here....I am no expert on this subject. However if you do a flip through of these magazines on your channel and you discuss how they inspire you and provide comments about how you would use the images in a project etc. then it could be considered "fair use". I hope you have a lovely week💖
How do they inforce this I've wondered? I know Daphnes Diary has this they make it clear so I would honor it. But, what if you don't know about an image. Music I get they have ASCAP. Or if you use a piece of paper that you did not know? Who will contact you? Just curious... I only sell my paintings at the moment.
Great questions and I really don't know. Copyright is a huge conversation. My friend Hazel said it best...there are thousands of lawyers that dedicate their career to this subject. It's not an easy subject to understand in its entirety. I'm sorry that's not an answer but I really appreciate you watching.
Not much but I am happy to do some research. Are you curious about the history or any other aspect? Just let me know and I will put a video together soon. Thank you!!!
@ThePaperMonkey I have some really old ones that are over 100 years but one that are not. I would like to know if they can made into digitals. Some are pretty awesome.
Glad for you to make this subject a bit more simple and informative at the same time.😊❤❤❤
