    What if you have no qualifying relative. Im alone by myself under A10 withholding if removal status 11 years now. I satisfy the other three requirements though.

    Hola abogado yo gane mi caso en agostos 2019 me dijo el juez que en 18 meses tendría mi residencia y no se nada aún? Escuché que solo hay visas de octubre a enero, entonces tendré que esperar hasta octubre de este año? Gracias de antemano.

      Hola Claudia. ¿Está diciendo que obtuvo una tarjeta verde o una visa? Son cosas diferentes. Me pondría en contacto con la oficina del fiscal del gobierno que estaba en su caso y hablaría con ellos. Ellos deberían poder asesorarle. Buena suerte.

      Les comento que Estamos en las mismas. Esperando desde noviembre 2019. Nos dijeron tambien ese día que se gano el caso que se demoraria de 1 año a 1 año1/2 recibir la tarjeta verde Pero Todavia no ha llegado nada.

      Hola Claudia yo gane mi caso en Mayo del 2019 y en Marzo del 2022 recivi la carta del juez autorizando mi residencia, justo hoy marzo 17 hable pa USCIS para agendar mi cita estoy esperando que me regresen la llamada para que me digan cuando voy a ir a mi cita según lo que e leido después de la cita sólo es esperar la tarjeta en el correo

      @@alexhernandez3346 hola Alex me da mucho gusto yo vivo en Ohio y sigo esperando mi caso se aprobó verbalmente en Agosto 2019, ojalá pronto se empiecen a aprobar caso en este estado.     What if the relative a US citizen is not here in usa? Can i still apply

      It may be possible to still apply even if the relative is temporarily away, but it may be necessary for them to be present further on the process.

    Hi Mr Mejer, my case was won in Massachusetts back in 2019 and the judge said they didn’t have available visa at that moment. It’s been almost 2 years and i haven’t received anything. What are the next steps and what should I expect?

    Very educational thank you for sharing! I have a question about the 4th requirements. Having under age kids between 2-6 years old is not enough to prove that they emotionally need you? Do they have to have any illness?

      Hi ZR, thanks for your comment. Its hard to say. It depends on your family circumstances. YES, having young kids MAY be part of the consideration but you also usually need additional items like a doctor or therapist has said this is impacting them emotionally or physically and will be worse if you can't stay. Perhaps your partner can't care for them without you - that may be a factor. If they have health issues that will be considered. Also, if you had to move to your home country how would that impact your children if they moved with you...there are so many parts that should be argued by a good immigration attorney for you in this process.     Hi Andres, if you applied for Cancellation of removal, are you eligible for Work Authorization? And what happend if your Notice to Appear doesn’t have date on in? Simply said NTA. Thanks

      Harry - Yes, you are *usually* eligible to apply for work authorization once you have applied for CoR. I would contact the agency over and over until you get someone who can give you a date. USCIS is notorious for sending them without dates and then you miss it and they issue a deportation order. If you need assistance with your NTA, please call us or another qualified immigration attorney - you may have options that allow you to stay here.

    How do you make sure none of your clients become victims of immigration fraud?

      Well, we don't commit fraud. If you hire an attorney you have more protection because they have to keep their license active through the state bar association who will investigate fraud allegations. No attorney wants to lose their license. But we can't protect them 100% because they make choices about who they work with, that is on them. If you hire a notario there is no protection because they don't have a license.

      @@stevenroshni1228 Oh, I misunderstood. Hmmm, you know we hope everyone is honest with each other. But we also don't think someone should stay in an unhappy situation. Hopefully, no one commits fraud and only marries to get a legal status. How to protect from that? Not sure anyone can except get to know your partner well before getting married? What do you think?

      @@ElGreenCardAbogado I think a big indicator would be how the non resident reacts to planning things that would make a marriage more difficult (or costly) to end, such as buying a house or starting a business together. Depending on the person's status and cultural norms some of those things can be started pre marriage.
      It rough for people whom simply don't have the luxury of spending a lot of time getting to know someone, not knowing for sure that they will get married.
