John, thanks for the great videos. Can you add more detail regarding the public disclosure clause. I have an idea that I believe is an excellent candidate for a patent. I built a prototype and published a RUclips video demonstrating the experimental use of that prototype in January 2023. It worked quite well. I have since made minor modifications and have a few more planned. Does the fact that I published the video in January mean that I have only until next January to file a patent application, even though the description of the video states "This is the first test..."?
Experimental use is considered a defense to the novelty requirement for patentability in the U.S. If you don’t file your patent application within one year of public disclosure, then you could argue experimental use to excuse this late filing. It’s better if you can file at least a provisional patent application before the one year deadline to avoid any doubt about loss of novelty. Arguing experimental use can be very complex and fact dependent. Hope this helps. --john
