Porsha Williams of The Real Housewives of Atlanta and her ongoing divorce battle is heating up. Simon Guobadia has filed a response to Porsha's plea to enforce the prenuptial agreement, claiming he paid her a 5-figure allowance because she quit all of her jobs to be a stay-at-home wife & mother. He also claims that Porsha blind-sided him with the divorce filing and is disputing the pre-nuptial agreement based on fraud.

Sounds like Simon is screwed! He signed a prenup and now saying it’s not valid. Porsha doesn’t have to respond to anything that has nothing to do with the bottom line. Simon is playing media games with the judicial system to throw dirt on her name but it looks like Porsha has the upper hand! But I will assume that the online business/projects did not supplement the income earned (1M+) from her FULL TIME JOB (RHOA/Dish Nation).
You are arguing against a point that has already been verified. Please go look up her departure announcement on dish nation. She quit her full time jobs to be a stay at home wife. And he is arguing that he gave her an allowance in exchange for her leaving her full time jobs.
Prenups are very hard to break I do agree. But I do agree with Simon - prenups are meant to be fair. And is not fair that Porsha has a multi million dollar employment contract with one of the biggest media conglomerates in the world, and also still expect to receive the same financial support as if she wasn’t employed. I can see the judge making adjustments accordingly.

Many people have it all wrong. GA is NOT a Community Property state.
When a couple gets married, any property that they owned prior to the marriage is considered separate property. This means that each spouse owns half of that real property as his or her separate property it belongs solely to the individual spouse, not the marital estate.
A simple google search.
@@continuouslyevolving7955 the house won’t be “divided.” And yes ordinarily the house would have been treated as “equitable division” as per GA law. But Simon added stipulations in the prenup that 1) Porsha will have exclusive use of the house post divorce (for a period of time), 2) will receive a portion of equity on the house upon sale, 3) in addition will receive a settlement.
Here is the verbiage from the latest court filing:
““It is wholly unfair and shocking to the conscience for [Porsha] to be able to take [Simon’s] $7,000,000 pre-marital home, collect a substantial amount of the home equity, and receive an exorbitant financial pay out from [Simon] under the terms of the prenuptial agreement, after [Porsha] entered into the marriage under fraudulent pretenses and failed to disclose and/or misrepresented material facts,” Simon’s lawyer said.”

So Michelle, to me this means even at the time Porsha announced her RHOA return, she hadn't discussed it with Simon or she had and they argued about it but she thought if she forced it on Simon by signing the contract and announcing it , she thought Simon would give in under the pressure of her being the "beloved housewife and everyone demanding" her return. But Simon stuck to his guns clearly which is why she tried to find a way out by leaking the immigration issues.
