From a President to a lowly fisherman, law enforcement seems to be the bad guys these days. No one wants to be responsible for their own actions. All I want to know is, after he told you that he didn't have a license and went and got one, did he inform Sharelunker that his catch was not eligible for any prize? That would have solved the dumb mistake.
I’m not sure of those details but I don’t think he cares about the prizes considering quite a few prizes are from 6th sense and he’s a minority owner in the company. He also has caught a few share lunkers and doesn’t enter them because, once again I don’t think he cares.

The Sharelunker program takes the genetics of each fish to create more with the same genetics in an attempt to have more hearty fish within the state. Ben is by no means right by fishing without a license or signing the document. But I heard he gives a contribution to TPWD and the SHARELUNKER program. I think both sides are wrong here, Bens overlook and Texas overreach.
I am an East Texan and he is not our "Golden Boy". I get it he is your buddy but he not some kind of East Texas shining star we all look up to. That is ridiculous. See I am old enough to remember Nebraska Ben trashing Texas fisheries in chats and video comments then moving down here the first chance he got and then acting like he was the Godfather of Texas fishing. East Texas was known for great fishing long before Ben moved down here so let's not overstate his importance to Texas fisheries. Here is the difference between Ben and the average guy who forgot. He is a Pro. Not a weekend angler. The fishing license is the bare minimum of tasks to do his "job". As example a truck driver who drives on an expired CDL because he forgot can get a 200.00 fine, and (this is rare in the first offense but it happens) his CDL can be suspended meaning his literally loses his ability to work in his profession and yes they do enforce it. Sorry no excuses for the PRO who forget his license. Now, I don't think he should have been arrested. I don't believe he was trying win a bunch of prizes maliciously or purposely cheat the system. I think TPWD went too far on this one. No argument there. That said I hate how you spun this though because the Warden's in Texas are some of the very best people you will ever meet. I appreciate your defense of a buddy but seriously like, TPWD, you might have gone a bit overboard. At the end of the day a Pro fisherman broke the law and is being punished to the laws fullest extent. Is that justified in this case? No, probably not. Does he get a pass for being Milliken? I don't know this, but when were the entries entered into the 10,000 giveaway? If was months later than the incident that would likely explain why the charges didn't happen immediately.
@@Frostin_AustinI know when I was working, if I found someone fishing without a fishing license, I used to give them a choice: show proof of purchasing a fishing license within 24 hrs via mail, email, or bring to my office or I issue the citation, and seize all their gear used as evidence. If there was resource damage (i.e. dead fish) or of the individual was a repeat offender, then there wasn't a choice for them. If there wasn't resource damage (i.e. live fish, or no fish) then the choice was the option. By giving them a choice, I assured the moneys would go directly back into protecting the resource. Many states when you issue a citation, the money go into a general fund and disbursed throughout the government. I don't know what Texas is like...
From what I understand, the fraud occurred when Ben became eligible for the drawing for $10,000 prize from a fish that was illegally harvested (no license). Had he not entered it in the program, probably nothing happens but the monetary fine, which I understand is already paid.
He likely didn't know until he tried to enter before realizing he didn't have it. Nobody knows for sure, people make mistakes, people make assumptions, even about themselves, and it's not like he couldn't have afforded it or bought licenses there and across the country before. Near zero chance it was intentional. Doesn't make it right but also doesn't mean he needs crucified for it. Disqualify him, fine him, move on.

I can see Ben filling out the form before he realized his license was expired. And when program officials found the license issue they fined him and voided the catch that minute. Form should of been destroyed at that time.
Doesn’t need to be, it’s no different than entering a tournament with a prize. Over a certain dollar amount makes it a felony to cheat and once he falsified those documents, he got bent over accordingly.
So let's check this scenario, what if Ben is Fishing and the game Warden pulls up on him to inspect his boat and license? Oops, he has to pay a fine. Now Ben is fishing without a license, catches a Sharelunker and is familiar with the program, turns the fish in with an expired license where he signs paperwork for the program acknowledging he is aware of the rules and possible implications legal and monetary and when caught based on the letter of the law, you want to scream foul? I tried to renew my Texas fishing license before it expired as It expired the weekend I was going fishing and they had to write on it CANCELED before they would sell me a new license! What BS! I love Ben's RUclips and I enjoy his content!

Years ago, a good friend purchased his hunting license (after) he shot a massive buck. Long story short...the game warden showed up and had proof that the time on his hunting license didn't match with the time the deer was shot. Someone blew the whistle and the deer never made it to the taxidermist.

Got short story to tell: We hiked in 4 miles to hunt. Buddy tags out a deer near sunset. We waited for it to expire. We dragged it back to camp that night since it's almost some 1:1 deer to bear ratio. We got back at 3am. Went to sleep and didn't wake up until 11 am. Prepped breakfast and ate. Around 12-1, LEO shows up and talks to us. As they were about to leave, My buddy asked the LEO to authenticate the deer tag. We tell them the story and instead of authenticating the tag, they write my buddy a ticket for reporting it a "day" late. He got his license revoked for 3 years and hunting equipment taken away to be "burn"...meanwhile, our neighbor was illegally growing weed and selling it. When he was caught, he was fine some chump change and a small slap in the hand...The times we live in....

Texas is completely off base here…how many people has Ben brought to the sport of fishing just in that state? Fraud is the intentional deception for monetary gain. He was CHARGED not found guilty. I was 14 years old and had a one year expired fishing license that went through the wash...long story short I didn't realize it was expired but the game warden asked for it i handed it to her and she handed it back and did nothing
28 yrs Federal Game Warden (retired) here. What happened to Ben was wrong. It has happened to me while fishing tournaments (auto renew fiasco like yours) and I only fish a couple different states. I can't imagine managing the amount of licenses you guys have to deal with. However, when you start quoting the Bible about your interpretation of what dominion means you lose me. I've heard that excuse 1000 times, and everytime it just makes the person sound like a crazy person (and my skin crawl to see someone use the Bible in that way...btw I am not religious, but it represents something good for me). Bottom line is license fees pay for programs/regulations that control the harvesting of fish and wildlife. Without these programs/regulations, wildlife species would be decimated. Furthermore, when you say you pay our salaries, you are correct to a degree. You pay our salaries to serve the natural resources the public has entrusted is to protect (being a fed, my salary actually came from Congress). In other words, just because you pay those fees, it does not give you the right to take wildlife as you please (I heard that a lot during my career from poachers). I hope this was just you being upset about your friend being unjustly charged and does not really represent you. I like your channel and have learned a lot from you (and Ben)

Probably an honest mistake by Ben. However, laws are laws and negligence is not an excuse. Hopefully they don’t hit him too hard. I think there will be a fine which is appropriate. Up to 5 years loss of license is also on the table which would be insane.
We are subject to the authority of the Gov. Rom13. And every angler ought to gladly pay $30 a year for a fishing license because yiu spend thousands on tackle and gear every year. And we need to and want to support our DNR and hopefully improved fishing in our state. And there is no excuse for not having a current fishing license..
lesson learned don't make excuses for breaking the law just move forward and be a better person. thousands of people watch this kind of content and shouldn't be reassured that breaking the law because you are not responsible enough is acceptible. The arrest was for filling out the form and entering the fish in the share a lunker program knowing there are thousands of dollars he would have been elgible to win. Then he went and bought a license hoping no one would catch it instead of withdrawing from the contest when he realized he didn't legally qualify because he didn't have a license when he caught that fish. That is the crime he was arrested for.He knew he was cheating at that point.Yes that is cheating.
I'm not 100% sure but if Texas is like Louisiana that recently changed their fishing licenses from expiring on June 30th like it has for decades to now whatever day you buy your license you have 1 year from that day... I know for a fact I fished for a while without one and had to renew my license on the water when hit me. What made me check is I saw a game warden pass me on Toledo Bend. If I fished all over the country like Ben does I couldn't imagine trying to keep track of all my licenses. I have had the auto renew send me a notification of my renewal an I had forgotten all about it. Seems like possibly an honest mistake. I can’t imagine having to keep up with multiple states. He obviously forgot about it or he wouldn’t have even turned in the fish knowing the repercussions.
Only thing Ben should have done was withdrawn his submission. Texas should not make any allowance for anyone despite their status in the community. Ben is an influencer and received recognition for this respectable catch and posted a video about it of which he received monetary gain. I’m not sure if that program is necessarily a “tournament” by definition. It sounds more like a raffle of which he could receive prizes which may include money. If Ben renewed his license prior to receiving any rewards or monetary compensation then I don’t see where “fraud” was committed. Again, if the qualifying issue is having a valid fishing license then all Ben should have done was officially withdrawn his submission. I’m sure he’d have caught it again at a later date with a valid license.
If I had a CCW that expired and got caught forgetting to renew I’d literally go to jail. It’s not a big deal pay your crap and move on, it’s about the drama though for views. Sometimes, there’s actually men are out here trying to provide for our families and sometimes we forget to check if our DNR license is up to date. IT HAPPENS PERIOD. Ben must be doing something right because folks are envious of him and what he has accomplished. I am an East Texan and he is not our "Golden Boy". I get it he is your buddy but he not some kind of East Texas shining star we all look up to. That is ridiculous. See I am old enough to remember Nebraska Ben trashing Texas fisheries in chats and video comments then moving down here the first chance he got and then acting like he was the Godfather of Texas fishing. East Texas was known for great fishing long before Ben moved down here so let's not overstate his importance to Texas fisheries. Here is the difference between Ben and the average guy who forgot. He is a Pro. Not a weekend angler. The fishing license is the bare minimum of tasks to do his "job". As example a truck driver who drives on an expired CDL because he forgot can get a 200.00 fine, and (this is rare in the first offense but it happens) his CDL can be suspended meaning his literally loses his ability to work in his profession and yes they do enforce it. Sorry no excuses for the PRO who forget his license. Now, I don't think he should have been arrested. I don't believe he was trying win a bunch of prizes maliciously or purposely cheat the system. I think TPWD went too far on this one. No argument there. That said I hate how you spun this though because the Warden's in Texas are some of the very best people you will ever meet. I appreciate your defense of a buddy but seriously like, TPWD, you might have gone a bit overboard. At the end of the day a Pro fisherman broke the law and is being punished to the laws fullest extent. Is that justified in this case? No, probably not. Does he get a pass for being Milliken? No, he shouldn't anymore than he should be prosecuted more heavily because he is Milliken. If it happened to to anyone else would you know about it and care? No you wouldn't.
I have a lot of respect for Wardens. But just like in every profession there are a few bad apples. He may not be the “golden boy” but Ben has brought massive awareness and value to Texas.

I don't know this, but when were the entries entered into the 10,000 giveaway? If was months later than the incident that would likely explain why the charges didn't happen immediately.
@@Frostin_AustinI know when I was working, if I found someone fishing without a fishing license, I used to give them a choice: show proof of purchasing a fishing license within 24 hrs via mail, email, or bring to my office or I issue the citation, and seize all their gear used as evidence.
If there was resource damage (i.e. dead fish) or of the individual was a repeat offender, then there wasn't a choice for them.
If there wasn't resource damage (i.e. live fish, or no fish) then the choice was the option.
By giving them a choice, I assured the moneys would go directly back into protecting the resource. Many states when you issue a citation, the money go into a general fund and disbursed throughout the government. I don't know what Texas is like...

From what I understand, the fraud occurred when Ben became eligible for the drawing for $10,000 prize from a fish that was illegally harvested (no license). Had he not entered it in the program, probably nothing happens but the monetary fine, which I understand is already paid.

He likely didn't know until he tried to enter before realizing he didn't have it. Nobody knows for sure, people make mistakes, people make assumptions, even about themselves, and it's not like he couldn't have afforded it or bought licenses there and across the country before. I can see Ben filling out the form before he realized his license was expired. And when program officials found the license issue they fined him and voided the catch that minute. Form should of been destroyed at that time.
Doesn’t need to be, it’s no different than entering a tournament with a prize. Over a certain dollar amount makes it a felony to cheat and once he falsified those documents, he got bent over accordingly.
So let's check this scenario, what if Ben is Fishing and the game Warden pulls up on him to inspect his boat and license? Oops, he has to pay a fine. Now Ben is fishing without a license, catches a Sharelunker and is familiar with the program, turns the fish in with an expired license where he signs paperwork for the program acknowledging he is aware of the rules and possible implications legal and monetary and when caught based on the letter of the law, you want to scream foul? Why does the letter of the Law always see to only apply when it's someone you don't know? Then ignorance of the Law only matters when it's someone you know?

Years ago, a good friend purchased his hunting license (after) he shot a massive buck. Long story short...the game warden showed up and had proof that the time on his hunting license didn't match with the time the deer was shot. Someone blew the whistle and the deer never made it to the taxidermist.

Got short story to tell:
We hiked in 4 miles to hunt. Buddy tags out a deer near sunset. We waited for it to expire. We dragged it back to camp that night since it's almost some 1:1 deer to bear ratio. We got back at 3am. Went to sleep and didn't wake up until 11 am. Prepped breakfast and ate. Around 12-1, LEO shows up and talks to us. As they were about to leave, My buddy asked the LEO to authenticate the deer tag.
We tell them the story and instead of authenticating the tag, they write my buddy a ticket for reporting it a "day" late. He got his license revoked for 3 years and hunting equipment taken away to be "burn"...meanwhile, our neighbor was illegally growing weed and selling it. When he was caught, he was fine some chump change and a small slap in the hand...The times we live in....

They have to prove he intended to deceive, which once again an expired license is something that has accidentally happened to everyone. 28 yrs Federal Game Warden (retired) here. What happened to Ben was wrong. It has happened to me while fishing tournaments (auto renew fiasco like yours) and I only fish a couple different states. I can't imagine managing the amount of licenses you guys have to deal with.
However, when you start quoting the Bible about your interpretation of what dominion means you lose me. I've heard that excuse 1000 times, and everytime it just makes the person sound like a crazy person (and my skin crawl to see someone use the Bible in that way...btw I am not religious, but it represents something good for me).
Bottom line is license fees pay for programs/regulations that control the harvesting of fish and wildlife. Without these programs/regulations, wildlife species would be decimated.
Furthermore, when you say you pay our salaries, you are correct to a degree. You pay our salaries to serve the natural resources the public has entrusted is to protect (being a fed, my salary actually came from Congress).
In other words, just because you pay those fees, it does not give you the right to take wildlife as you please (I heard that a lot during my career from poachers).
I hope this was just you being upset about your friend being unjustly charged and does not really represent you. I like your channel and have learned a lot from you (and Ben)

Probably an honest mistake by Ben. However, laws are laws and negligence is not an excuse. Hopefully they don’t hit him too hard. I think there will be a fine which is appropriate. Up to 5 years loss of license is also on the table which would be insane.

The arrest was for filling out the form and entering the fish in the share a lunker program knowing there are thousands of dollars he would have been elgible to win. Then he went and bought a license hoping no one would catch it instead of withdrawing from the contest when he realized he didn't legally qualify because he didn't have a license when he caught that fish. That is the crime he was arrested for.He knew he was cheating at that point.Yes that is cheating.
I'm not 100% sure but if Texas is like Louisiana that recently changed their fishing licenses from expiring on June 30th like it has for decades to now whatever day you buy your license you have 1 year from that day... I know for a fact I fished for a while without one and had to renew my license on the water when hit me. What made me check is I saw a game warden pass me on Toledo Bend. If I fished all over the country like Ben does I couldn't imagine trying to keep track of all my licenses. Only thing Ben should have done was withdrawn his submission. Texas should not make any allowance for anyone despite their status in the community. Ben is an influencer and received recognition for this respectable catch and posted a video about it of which he received monetary gain. I’m not sure if that program is necessarily a “tournament” by definition. It sounds more like a raffle of which he could receive prizes which may include money. If Ben renewed his license prior to receiving any rewards or monetary compensation then I don’t see where “fraud” was committed. Again, if the qualifying issue is having a valid fishing license then all Ben should have done was officially withdrawn his submission. I’m sure he’d have caught it again at a later date with a valid license.

Well said brother. I can’t blame Ben for doing that. I’m a father, husband, provider, and an angler and I sometimes forget to renew my fishing license. Sometimes, there’s actually men are out here trying to provide for our families and sometimes we forget to check if our DNR license is up to date. IT HAPPENS PERIOD. Ben must be doing something right because folks are envious of him and what he has accomplished. Perhaps if those “men” stop being envious keyboard warriors, their spouses won’t bang their neighbors and they’ll accomplish a few awesome things in life as well? 🤷♂️

Obviously u have no clue the reason he was arrested, and it's not for "fishing without a license"...$$$ is involved & qualified a fish without a license...it's pretty self explanatory...it's technically fraud, with $$$ involved...every angler would get that same thing...moral of the story...get a fishing license...I've done it for 40 years & haven't "forgot"
