How does someone get an arrest warrant if they haven't been arrested? I'm pretty sure these people have already been processed in the system and are awaiting further processing. Basically, they aren't breaking the law by traveling or avoiding their warrant.

There are three ways someone can be arrested. 1. They can be arrested for committing a crime in the presence of the arresting officer, or 2. if they are in the presence of a responding officer who, through investigation, finds probable cause to make an arrest, or finally 3. through a warrant issued by a Judge when the suspected perpetrator is known but their location is unknown. So basically, a warrant is issued when there is probable cause to believe someone has committed a crime but they are not in the presence of an officer or they can not be located. Examples of each: 1. Guy hits his wife and the officer sees it, he can be immediately arrested. Or, 2. a guy hits his wife, but the officer did not see it, but responds to a domestic violence call, and through investigation the officer determines he has probable cause to believe the report is valid, the officer can make an arrest. Or scenario three, Guy hits his wife and takes off. wife calls the cops, they investigate and find probable cause but the guy can't be located, a warrant for arrest would be issued by a judge. Also evading a warrant IS actually a crime. if you know there is a warrant outstanding and you don't turn yourself in, you can be charged with evading arrest, although that is unlikely, since its difficult to prove a person KNEW they had an outstanding warrant.
