    My husband could have lost his city job for taking more than a lunch worth $25 from anyone in the private sector. We both agreed the ethics protocol of his employer was a necessary mechanism to prevent corruption in local government. How is it that the highest court in our country that has lifetime appointments doesn’t even have an ethics protocol?

    I remember his confirmation hearings and believed Anita Hill. I felt sorry for her and what she had to go through. I would definitely like to see term limits and an actionable code of ethics that kept everybody in line.
    Edit: And take away the ability to "self pardon" for presidents. What were the founding fathers thinking on that one?

    I served on a city committee and I wasn’t allowed to take ANYTHING from anyone, even someone taking me to lunch, because it might be perceived as an impropriety of ethics. It is ridiculous that they are allowed to receive these “gifts”.

      Term limits are useless. We need AGE limits, mandatory retirement at 70, if for anything, as a check and balance to the obscene amounts of money that keep incumbent and careerist politicians in place. We need to level the proverbial field from time to time with a simple constitutional mechanism that removes the politician and their money at the same time.

If you make SCOTUS get out after 3 terms then you don't have people pushing 80 on the bench. Same thing with Congress, 3 terms and then you're out. Clarence Thomas has been on the bench since 1991, under my plan he would have been out in 2003. Not to mention I don't want our executive branch appointing anyone on the judicial branch. Those positions should be decided by the voters not POTUS.

    ProPublica RULES! Thanks for this reporting! Clarence and Ginni's snooty, entitled attitude pervaded their responses to these inquiries: 38 vacations, 26 private jet flights, yachts, countless sporting events give the impression of a hyper-entitled narcissistic, megalomaniac on the bench. About 32 years ago, as a then DC area musician, I played an event in Alexandria, VA that Clarence and Ginni attended. On a break, I found myself alone with the Roberts in a hallway outside of the event room. I politely said hello and congratulated them both on his recent appointment. In return, they gave me a chilly, condescending look of irritable incredulity. I felt like a lowly servant from a scene in "Jeeves. " Believe me, the Thomas's are the very embodiment of smug condescension. Believe me, these are not nice folks...not even a little.

    In my job, as a nurse in management, our policy doesn't let us accept gifts beyond cups, pens, and cheap novelty items. If we are invited anywhere by a client it must be a justifiable environment where business can be done in and not an extravagant place, must be a modest priced meal and location etc. So...this...being allowed for people who get to make national law precedents in UNACCEPTABLE!!!

    We are responsible for setting up a system where these supreme court justices can behave any way they choose. They are lifetime appointments with little oversight. Shame on us.

      Well, the system already includes a means of enforcing that. SCOTUS can be impeached (and have in the past). The problem is, our system is set up with the expectation that only one pillar at a time could become unethical/corrupted. I don't see McCarthy doing squat as he thinks the Speaker plaque on his desk is more important than anything. Others don't want the balance to shift because they are desperately ruling from the minority.
      The citizenry in general definitely needs a refresher on how it's all supposed to work because they are supporting candidates who want to work against or outside of the system and it's checks and balances.
      So I'd put the responsibility first on those who actively misuse power or their roles and those that vote for them.

      Congress has no power to pass laws regulating the Supreme Court. It does have the Constitutional Authority to impeach them for anything Congress wants to, even something as minor as habitually spitting on the sidewalk if Congress wants to. Congress needs to set out guidelines on what constitutes impeachable moral and ethical breaches for which a Supreme Court Justice will be impeached.       It’s distressing and sad the way the Supreme Court has become so politicized. I believe the original concept was to have an *impartial* panel of highly esteemed judges. They would render a final ruling on a legal case. Nowhere near impartiality now.
      EDIT FOR CLARITY : The judges were to render a final ruling on a legal case, using and based upon interpretation of existing law. *Not* based upon politics, as the Supreme Court is *not meant* to be a political entity. Historically, that has been what was done, certainly for the most part. More recently, rulings increasingly appear to represent political views, which aren’t impartial.

    I am a lawyer and was lucky enough as a young man to have cases before judge Fogel. A truly honorable man. It is utterly totally and completely unthinkable for him (or any other “normal” federal judge) to accept anything of any consequence. More or less even ONE of the things that have been listed with Thomas. Thomas is a crook. Simple.

    Need to make some rules for the Supreme Court Judges, holding them to the letter of the law. They have lifetime jobs, get to decide on important decisions, they should have bigger consequences than the general public and stricter scrutiny of their conduct. They are supposed to be the highest Court in the country and not just for the rich people who are buying them gifts. They give them gifts for favors, not because they like them. People aren't stupid, they know how the game is played.

      4 year, 2 terms limit, like POTUS. Publically elected by the people, for the people. Preferably through Ranked Choice voting.
      ZERO campaign funding. Equal Free (not publically funded) ad time on every platform.
      Also, IMMEDIATE moratorium on ANY SCOTUS descisions the judge in question was part of, following impeachment from office.
      Impeachment hearing should only require a 51/49% majority vote from both houses AND the President and VP should each have a singlular vote.
      The impeachment should be like a election recall. The public votes again, every voting person has a say.
      The standard For All Fed Public Servants (All 4 rings) really should be a majority vote from two rings brings the impeachment hearing.
      Impeachment should mean permanent removal from office and future elections of that office. The public's recall Impeachment Vote acts as a jury decision regarding the office. Actual criminal charges are handled like every other citizen. With expectation that harsher sentencing occurs for abuse of public trust. Objective neutraility to a code of civil conduct is expectation.
      Color of law duty is credible function. At minimum granting pardon when majority believes it to be in the public trust/conscience.

    I need to take ethics training as a employee every year where I work. If I answered the final test questions per these justice’s actions, I would fail and be reprimanded. If I actually acted on something that simply looks inappropriate (like Thomas has done), I’d be punished, let go, or legal action taken against me. Since he’s at the top of the legal pole, I guess he doesn’t need to worry about being corrupt.

      Same here. I served in elected office and filed reports for 22 years, and total gifts received were about $100 - and that only because someone changed a report too late for me to write a personal check to reimburse. No sky boxes, no trips, though they were offered.
      I had a no gifts please sign on my office door.

      That's because you don't know the law. Read 5 USC 13104 (a)2(A) "...except that any food, lodging, or entertainment received as personal hospitality of an individual need not be reported." That is the language of the Ethics in Government Act of 1978. That same exemption from reporting would also hold true for members of Congress and the Executive branch UNLESS those branches chose to accept more stringent rules which they may well have. I only know that the Judicial Conference of the United States which administers the EGA for the judiciary, stuck with the original language up until March of this year -- 2023. Going forward, hospitality gifts are limited to food, lodging and entertainment received and consumed at the giver's personal residence or private resort properties. And private travel, most notably air travel, which clearly substitutes for commercial transportation is NOW explicitly excluded from the hospitality definition. These two major recent changes by the Judicial Conference promise to greatly curtail the future lavishness of hospitality showered upon Supreme Court justices. But the breathless media stories from the mainstream media concerning trips and entertainment enjoyed by justices IN PAST DECADES is almost certain to continue. After all, the fish in THAT investigative reporting barrel are far too easy to shoot.

      I said time and again, never trust a conservative to nominate a fellow conservative as a US Supreme Court jurist. Remember when Reagan nominated Robert Bork and others and the public gave a resounding NO to all of them. The way Thomas, Kavanagh, Barrett and Gorsuch have been behaving in the past prior to being justices and present disgusts me beyond measure and have the audacity to serve the public good with their uncouth college frat boy behaviors under an air of calling themselves 'self-righteous' in their respectable churches and communities by making it right to impose their personal brand of morality and beliefs as the laws of the land? I would rather hire a judge who worked as an attorney for the ACLU instead of some elitist member of the Federalist Society or some closeted conservative group because a number of them have such a limited worldview with quasi-fascist leanings and values.

    I remember being in San Miguel de Allende in Mexico during the Anita Hill testimony during his confirmation hearings. I watched every day, getting sicker and sicker to my stomach. This man was bad news from the beginning, dishonest and repugnant. He is an architect of the temple of wealth, regardless of how you acquire it.

      We’re talking about one judge here, not all of them. If one black man robs a Kmart or all black men bad? That being said, it’s obvious some kind of accountability needs to be put in place for all federal judges, particularly supreme court judges. Term limits is probably a good idea too. There must be some way to deal with Thomas. He is obviously not interested in impartiality, or ethics. He is a bottom feeder.

    I am a counselor who considers several factors important to my clients' health. Their support network is a key factor, because that network is essential for clients' values, beliefs, and sense of security. When a justice allies themselves with a lifestyle, they are making a decision to risk being corrupted toward that lifestyle. If that lifestyle is orchestrated regularly through relationships with the 0.1% richest people in the U.S., the receiver of that shared lifestyle will change their worldview more favorably toward their benefactors. As a result, Clarence Thomas has put himself under significant pressure to side with the ultra-rich. The fact that he has not reported these instances of corruption obviously reveals his favoritism.

    In the UK, all judges are expected to restrict their social life to family and a very small number of close friends. This is to ensure that they are beyond reproach in their behaviour and that there can be no possibility of favours being offered or received. It seems that similar ideas apply in the USA, but that there are people who didn't get the memo. The fact that Thomas claims that his salary is not worthy of the job should be sufficient to disqualify him from the Supreme Court; the latter is a job one does for the honour and for the privilege of being able to influence the law - it is not a job where the salary matters. If Thomas *really* does the job as a matter of principle (as he claims), then he would surely understand the principle of not accepting gifts from ANYONE. Poor boy rose to the top of the tree, then decided to get greedy.

    I’ve worked as a journalist and for public institutions, non-profits and private companies. We were not allowed to accept gifts in any of these places and rightly so. At the very least, it gives the appearance of possible bribery. The highest legal institution in the country must be held to the highest standards. The current practice is obviously anything but.

      The gift stuff makes me livid, the behavior of Thomas and Alito in particular. I served 14 years in the California Legislature, and 8 as CA Secretary of State, and I believe the total value of gifts I accepted was under 100 bucks. I was aiming at zero, but sometimes there is a belated claim that a gift was given, like food at an event, when it's no longer possible to write a personal check for reimbursement. (You can tell it was some years ago. Who writes checks?)
      Anyway, their excuses are, well, inexcusable. It isn't hard to comply with the reporting requirements, and Thomas responded to criticism about the largess he was receiving from Harlan Crow by choosing never to report again! 😠😡😡
      The citizens deserve honesty and accountability from their government, and especially from Supreme Court justices.

      It already has been. Effective March of 2023, the Judicial Conference of the United States limited non-reportable "hospitality gifts" (per 5 USC 13104 (a)(2)(A)) to food, lodging and entertainment received and consumed at the giver's PERSONAL RESIDENCE or PRIVATE resort properties. And private travel, most notably air travel, which clearly substitutes for commercial transportation is NOW explicitly excluded from the hospitality definition. These two major recent changes by the Judicial Conference promise to greatly curtail the future lavishness of hospitality showered upon Supreme Court justices. But the breathless media stories from the mainstream media concerning trips and entertainment enjoyed by justices IN PAST DECADES is almost certain to continue. After all, the fish in THAT investigative reporting barrel are far too easy to shoot -- as long as no mention is made of the new rules that effectively end judicial globetrotting. And why should they tell you when pursuing that juicy scandalous narrative, right?

      Not exactly true. The Code of Conduct for United States Judges DOES NOT apply to the Supreme Court. That's what most people are familiar with. But for that matter the Code doesn't provide much in the way of sanctions for lower court federal judges either. Basically, it's either a private sanction (slap on the wrist), public sanction (harder slap), "official suggestions" (varying in intensity) to "retire," or referral to Congress for impeachment (pretty serious). No criminal charges at play anywhere. Existing concurrently with the Code of Conduct for BOTH judges AND Supreme Court justices is the codification under the United States Code of the Ethics in Government Act of 1978. No criminal charges here either, but we ARE talking about Congressional legislation that governs the financial reporting requirements that the federal judiciary has VOLUNTARILY followed since the Act's inception. SCOTUS has never officially ruled on the AUTHORITY of the statutes in Title 5 Chapter 131, but it has adhered to the requirement to file annual financial reports as stipulated in various sections like Sec. 13104 "Contents of Reports." Sec. 13102 of the statute assigns specific administration of judicial employees and officers under the law to the Judicial Conference of the United States. As a result, things like lack of proper reporting (i.e. Clarence Thomas failure to report sale of his mother's house in which he had a financial interest) tended to get handled internally, even years after the fact. Given that the reporting is primarily to ensure proper recusal in potential conflicts of interest in pending cases, the presumption is that justices are not intentionally looking to avoid recusal for the CLEARLY unethical purpose to favor friends or visit revenge on political rivals. Again, any blatant failures to recuse would first be handled internally, but if need be the Judicial Conference could make a referral to DOJ and a civil lawsuit -- Title 5 is administrative law -- could ensue.
      The point here is that as long as the Judicial Conference chooses to follow Title 5, it wants to make a good faith effort to do so. Thus, when it became obvious that the judiciary was not technically following a restrictive interpretation by the statute that air travel was NOT truly an element of a "hospitality gift" that did not require inclusion in a justice's annual report, the Judicial Conference made the change in March of this year. Same was true of the idea that a "hospitality gift" from an "individual" meant more than merely an "individual" who worked for a major corporation and was improperly glad handing a judge or justice. If that was going to be done, it should only be allowed (if at all) by a personal friend of the judge or justice who could be counted on to maintain some ethical distance no matter how expensive the caviar that was had for lunch -- or in which Mediterranean port lunch was had. So....the new rules passed by the Judicial Conference last March have at least a few more teeth than the impotent Code of Conduct. Private transportation (i.e. private jets) can still be used by members of the Court -- however, those trips must now be reported. "Hospitality gifts" of food, lodging and entertainment from an "individual" must now be consumed and enjoyed at the residence or private resort OWNED by that individual. These aren't exactly suggestions no matter how lackadaisical it may appear they are enforced. They are aligned with administrative (civil) statutory law. Hope that helps clarify things a bit.

    The idea that he is in charge of making judgment calls regarding the moral and ethical standards of others is extremely disturbing! How can he be expected to oversee a case involving, say, a person who accepted bribes? And after all of this has surfaced, he continues to sit in that position?
