A requirement is that damages are difficult to estimate at time of contract execution or difficult to estimate after breach? I believe the latter.

Thanks Steve for this video.just one quick clarification. In the case of liquidated damages do we need to prove(plaintiff) the actual loss or can claim the entire money mentioned in the contract as liquidated damages..thanks.

Thank you for your video. It's been very informative but I have a question in mind: Is there any possibility that a penalty clause and a liquidated damages clause are applied concurrently in the contract? I would be very thankful if you can respond to my question. Thank you a lot!

Is there any difference between liquidity damage clause & perormance security clause ?In construction contract can liquidity damage clause can be included just considering the factor of time e.g contractor fails to complete the project in specified period of time as mentioned in contract so client/owner can envoke this clause?

I believe you can include a "time is of the essence" clause for this particular example.
