I am rereading the book by Mr. Wright so checked this out. The story is very sad and I feel bad for everyone concerned. I also remember my first marriage to a wealthy man and when things didn't work out, it got very nasty very quickly. I was just too young, naive and without my own resources to get any kind of help, so I just ended up homeless.
Von Bulow ...guilty. The thing speaks for itself. Why didn't he just divorce Sunny? Dershowitz is trying to make a name for himself and who does he think he is kidding?
The legal term res ipsa loquitur ("the thing speaks for itself") refers to a situation where the matter is settled by its very nature without additional evidence. It's actually used in civil, not criminal, law; an example is being injured when an office building elevator falls and crashes. The building owner/landlord has no defense against liability; it doesn't matter if he did every single thing right in maintaining and checking the elevator; it's on HIS property so he's liable. There's no real parallel with criminal law. Even when there's video of the alleged crime there's always a defense. But the von Bulow matter doesn't even come close to that; the prosecution's case was built on a lot of dubious circumstantial evidence that was mishandled, collected in murky ways, etc. Von Bulow might well have been guilty but there was more than enough "reasonable doubt".
Impossible to know what Klaus did or even whether he was guilty of anything. But since this case, Alan Dershowitz has shown himself to be a man without scruples.
All this anti-semitism is ignorant. So you don't like the man, fine. Do you have to claim his actions are because of his race or religion? That is far lower than the actions of the most corrupt lawyer.
