I think it's Valentina's mum, Jana that is going for custody of Leo. All season 2 she had been acting to nice, especially towards Luiza and has been very manipulative. She's been using Luiza's memory loss to her advantage by confusing and saying they used to be so close. And making Luiza and Valentina look like bad parents. There has got to be a season 3 coming.
I Think it was luiza who probably sign over her rights when she was going thru her post partum stage it to obvious for it to be the mom of valentina
