  • The plaintiff says it was her lifelong dream to own a horse, but claims that the animal she purchased from the defendants is ill and cannot stand up properly. She’s suing for her money back. The defendants refuse. They claim the plaintiff rode the horse for three days before purchasing him, and they say she has buyer’s remorse.

    Vetting a horse is usually standard procedure before a sale. That being said, if they knew of the condition and didn’t tell her, that was crappy of them. Also, the plaintiff constantly calling the horse “it” is really annoying. It really sounds like she doesn’t know a lot about horses.

    She should have done all that research and paid a vet before buying the horse. Any verbal agreements, she should have wrote it in the contract then they all initialed by it. Fair judgement

    poor Tank, he's a beauty! I hope the other fellow is really taking care of Tank and hasn't shipped him. He was tossing his head when he was at his own home.....i'm not surprised that he was nervous at his new place. Horses aren't cars...

    Lemon laws for cars only apply to new cars. But I floors me that people sign contracts without doing their due diligence. It doesn't cost that much to have a vet come out and take a look.

      Many horses enjoy being ridden. If you really know horses, you would be able to tell that. Certainly some don’t, but many do

    I like when the judge reminds her she's a grown ass woman and needs to own her decisions. A lot of adults can't except the fact that not every hand you're dealt will work out in your favor. Life favors us one day and not the next. Just own it and move on. Not everything is a lawsuit and someone else's fault.

    Plaintiff signs a contract that states "no other agreement will be adhered to except this written one"
    Plaintiff argues there was verbal agreement she could return the horse completely ignoring the return policy, as-is mentions and the fact there is only allowed one contract - the written one.

    When JM asked the plaintiff if she had a cell phone that takes pictures, she forgot to add her classic line, "it's not just for nasty pictures" 🙄

    I can't help but feel a horse's life is worth a lot more than $8,000 and that it doesn't deserve to be treated as a financial transaction.

    The defendants live in horse and livestock territory...of course there are going to be vets around. She just didn't want to pay that extra money, same as those who don't have a mechanic check out a used car prior to purchase.
    At the very least, she should have gotten permission to contact the poor horse's previous vet and gotten his records prior to finalizing the deal. She's way too old to cry foul after entering into a written contract on a $7500 horse about which she knew nothing.
    On the other hand, I'm not giving credit to the "no possum" claims of the defendant. There are plenty of them in the High Desert, so they may have been less innocent than they portrayed themselves to be. Regardless, "I had a horse 40 years ago", and "I was excited" are no reasons to impulse buy a large animal.

    So many different factors to this. I do somewhat believe the defendants knew the issue with the horse and didn't disclose, BUT this woman is gullible and trying to portray the situation differently from what it really was. She doesn't want to own up to the fact that she made several stupid decisions for the sale and put the blame of her stupidity on the defendants.

    So many issues with this... Yes, it takes time for a horse to become acclimated to a new environment, training or not. You say the horse fell, then you got on it AFTER THAT 🙄. Why would the defendants say you could exchange the horse if the contract says AS IS/FINAL? Also, lady, a verbal agreement was never agreed to by texts or emails or anything. There was not a meeting of the minds.

    "We stand by our horses" could mean anything. The woman clearly regrets losing the money - who wouldn't? But she made a hasty decision, as she said; she was afraid her husband would change his mind.. It's on her, sadly! She signed the contract. There was no guarantee. THAT SAID. I didn't see much concern for that poor horse from anyone ~ money aside ~ let's hope that poor horse has recovered, and is being looked after and appreciated now!

    The only horse she should be buying is a rocking horse. Does she have any idea that horses are animals with minds of their own? Behaviour can not be guaranteed no matter how calm the horse is or has been.

    EPM is tricky to diagnose. There can be months or years between symptoms and symptoms can be extremely varied. One horse can stumble occasionally, another horse can start walking like they are drunk. Some horses are affected temperamentally. A well broke horse that has never bucked can suddenly start bucking for no apparent reason. A kind horse can have bouts of aggression.
    Some horses get it and never show symptoms, and others get it and go down hill quickly.
    The only was to test for it is by doing a spinal tap and checking the spinal fluid for the protazoa.

    Buyer's remorse on the fact she bought the horse without a vet check first. And then she sold it to someone else, who did not know about how the horse was health wise.

    If plaintiff would had won she would have had to give the horse back to the defendants. The fact that she don’t even have the horse to give back, the case should have been dismissed on that fact alone.

      That’s not exactly true lol A lot goes into the price of the horse such as breeding, age, training, talent, registration. You can get a wonderful grade horse for $1000 that wouldn’t hurt a fly

    There have been cases on the PC that involved the sale of a puppy who had an unknown disease and the seller was bound by certain laws and obligations there. I wonder how or if those apply here since it seems like a similar case.

    It just seems suspicious that they make sure to put all that no returns information in the contract while saying they stand by their horses. Also if it was a puppy and it turns out to have Pavo and you can prove it had it before you paid for it you are entitled to a refund. it seems like a neurological disorder would be something you’d know about and the fact that he knew exactly what it was and how horses catch it seems odd…

      You get a copy of the plaintiff’s complaint when they sue you. So if she accused them in that document, they’d know to look up the disorder before they came to court

    We have a HALF ACRE Horse Ranch"... You mean a house with horses in the backyard😂. They absolutely knew the horse had issues. Only one percent of horses get EPM(but he sure knew what it was, without reading the vet report). Aprox. 15 to 25 percent recover fully(with proper treatment). That horse had to have been ill for a long time. She's foolish, but they are kind of shady as well. At least the horse is being treated and will not be put down if the treatment fails, and that's the most important thing.

    I had a horse and you can’t control it 100%! It’s a giant dog lol and it’s a lot of work and costs big bucks to maintain especially if you have a horse that gets colicky and if it’s finicky about food.

    a horse would act differently, no matter how well trained, when moved to a new home, with new owners. they take a while to settle into their comfort zone again. She would have to prove that they knew about the cephalitis in advance. I would never buy a horse for that amount of money, or any horse over $3000 with out a vet check. The vet check is around $100 and saves you a lot of grief.

    Woman has no idea, seems to think horses need to be stabled, horse falls with no rider with no explanation, woman then rides the horse and horses shows signs of distress and yet no one has the horse checked or cares the horse is in some kind of distress. Says it all when they say woman had "lessons" during the process of buying a horse and then just ships the horse off when he needs care. She has no idea, just lives in a fantasy world of owning a horse.

    Having 8 horses in 2 1/2 acres of land is cruel to the animals. That's not enough acres for horses. You should have at minimum 2 acres per horse.

    She didn't do her due diligence, and wants to blame someone else. That's on her. I do not feel bad at all for her. She is like these kids that expect things right away and then doesn't want to pay the consequences for not making sure it is a good deal.

    Just like with a car, how on earth does a person expect a refund if they don't have the car or horse any more. She traded it in and so got her money back. And she conveniently 'lost' her contract, and she hoped they wouldn't have their copy because it proved that it was an AS IS sale and NO REFUNDS. And if she has a bad back, then she should NOT be riding a horse...

    She is what I call Strong and Wrong. She was so self assured she was was correct and she was totally wrong on every point, buying the horse because she was coerced and the drive was too long to bring a vet and even though I singed a no returns as is contract I was assured I could trade the horse…. None of that made sense

    She signed the lease. She cant win this one. Why didnt she have a vet check him out BEFORE she bought him? Her mistake.

    Lemon laws for horses is only in Florida. No other state. And lemon laws for cars is only on brand new ones

    How she think she only stayed with defendants for 1 day and they say it was 3 days? No reason not to have a vet look at the horse first.

    I'm against the verdict in this case. Epm is a very serious disease that's often deadly to the horses. Treatment is very very expensive. Hiring a vet to do a simple check of the horse wouldn't be able to detect EPM without a blood test. The defendants NEVER should have sold that horse.

    The horse was still sick give her half of her money back. the defendant guy has a strong presence I haven't watched the whole thing yet but I would go for him he has a look at me for leadership vibe
