How dare she only attempt to limit your art because you sent fees. Gross. 2nd. Her patent only mentions TWO walls, the natural nail and acrylic attachment. You use THREE, natural, base, and gel that you formed yourself. Further, her patent mentions the liquid opening to be at the BASE of the nail, you use your tip. In conclusion...she can shove her aquarium nails..well you know. Any good lawyer would tear her dumb email apart, do your thing girl.
Me and my twin started doing aquarium nails back in the 90s, when we first discovered it, you had to put 2 nail tips together,and we put everything in there from sailboats to sand sparkles all that. so that lady trying to Sue you, she needs to knock it off.

However the other lady’s patent requires an “opaque decorative element”, i.e., glitters, etc. to be included in the liquid so using ONLY liquid would not infringe upon her patent. Not necessarily true. Since she is teaching the method, she could be considered an infringer by “actively inducing” others to infringe the patent. A really good attorney could argue that.

If she does sue you, you should talk to a patent attorney and see if it's something you can fight. You should talk to one anyway and see if there's any danger in actually being sued. I work for a patent attorney and most do free consultations. I think it's worth looking into.

If she sues you, you’d actually have a counter case on the basis of Conflict of interest and “cyber threatening” depending on your state. She’s only threatening you with a lawsuit because you have rates which means she can’t get free promotion off of your review. She has to pay for the service of promotion and did not want to. It’s pretty much threatening you through harassment into free services and if you don’t accept then you can’t use the style which is where the conflict of interest comes in. She can’t say review this or you can’t use that style anymore-she can say she’d like for her name to be noted when the style is done or mentioned as the creator (only due to the patent not because of actually creating it) but not by stating you can’t do it because you won’t review for free. If she had said something about a law suit prior to contacting you for the review that’d be different but she didn’t have a problem with you doing aquarium nails before you denied her free promotion only after you gave her rates so the problem isn’t the nails it’s the audacity to not pay you for your job 💅 I’d also look up her sales and how much she’s made because I have never ever heard of this product before patent or not. A brand that is unpopular regardless of a patent is unknown. I’ve seen aquarium nails for years on RUclips it’s not like you are the only one doing them.

Yes, and I think if she doesn't attempt to enforce her patent equally she can loose the rights to it altogether. Maintaining a patent includes enforcing it when you know of infringement. If she is only going after one channel, obviously knowing other channels do tutorials on the exact same thing, she's going to have a really hard time in court.

Um... She does not have a patent on the concept of aquarium nails, her patent does not extend beyond the very specific product she's selling. I found a 2018 article about her product, she only won the patent because she does aquarium nails differently than ANYONE ELSE, she said so herself, otherwise I don't think she could have patented something that so many others had done at that point. You haven't infringed on her patent by doing aquarium nails, the only way you could do that is by creating and selling nail tips with a well for liquid and seperate cork. So no, you haven't infringed on her patent (which she didn't get until 2010, not 04) and she can't sue you for doing something that is completely different to her patented product.
Bottom line is I smell a hater. Being that your talent is well known she is trying to take advantage of that. Especially, since she never went after anyone else who does this same technique ....🧐🤔. Anyway, I love watching your work and I pray many blessings for you!!❤️

It takes a very long time to get a patent granted, especially went they are poorly written (like hers). She has terribly written claims and terrible drawings. She’s lucky it was granted. She probably couldn’t get away with that now.

If she sues you, you’d actually have a counter case on the basis of Conflict of interest and “cyber threatening” depending on your state. She’s only threatening you with a lawsuit because you have rates which means she can’t get free promotion off of your review. She has to pay for the service of promotion and did not want to. It’s pretty much threatening you through harassment into free services and if you don’t accept then you can’t use the style which is where the conflict of interest comes in. She can’t say review this or you can’t use that style anymore-she can say she’d like for her name to be noted when the style is done or mentioned as the creator (only due to the patent not because of actually creating it) but not by stating you can’t do it because you won’t review for free. If she had said something about a law suit prior to contacting you for the review that’d be different but she didn’t have a problem with you doing aquarium nails before you denied her free promotion only after you gave her rates so the problem isn’t the nails it’s the audacity to not pay you for your job 💅 I’d also look up her sales and how much she’s made because I have never ever heard of this product before patent or not. A brand that is unpopular regardless of a patent is unknown. I’ve seen aquarium nails for years on RUclips it’s not like you are the only one doing them.

Yes, and I think if she doesn't attempt to enforce her patent equally she can loose the rights to it altogether. Maintaining a patent includes enforcing it when you know of infringement. Um... She does not have a patent on the concept of aquarium nails, her patent does not extend beyond the very specific product she's selling. I found a 2018 article about her product, she only won the patent because she does aquarium nails differently than ANYONE ELSE, she said so herself, otherwise I don't think she could have patented something that so many others had done at that point. You haven't infringed on her patent by doing aquarium nails, the only way you could do that is by creating and selling nail tips with a well for liquid and seperate cork. So no, you haven't infringed on her patent (which she didn't get until 2010, not 04) and she can't sue you for doing something that is completely different to her patented product.

I hope more nail artist speak out about this, Evie! I imagine the only reason the patent was approved was because no one knew about it; and could not challenge the application. I also believe she is misusing this patent to control and intimidate artists. Thanks for always speaking up and letting the community know what's going on. Are we sure the patent is not specifically for the aquarium tips she sells? Btw, you cannot pick and choose when to enforce a patent, so save those emails!
More info: Ok, I had to re-read through the documents. She claims she invented the nails in 2002 and filed an patent application in 2004. She was not granted the patent until 2010. I honestly find the dates very confusing.
Also, the only reason she got a patent is because of how different her product is to normal aquarium nails, by her own admission. Her patent is for nail tips with seperate stoppers, she doesn't have a patent for the concept of aquarium nails.

@Hannah Brown When I say the concept of aquarium nails, I mean any nail with a well for liquid no matter how it's formed, which she is claiming she "owns". Pretty sure we're both on the same page, but wanted to clarify that just in case haha.
It takes a very long time to get a patent granted, especially went they are poorly written (like hers). She has terribly written claims and terrible drawings. She’s lucky it was granted. She probably couldn’t get away with that now.
That is so ridiculous that she’s trying to come after you! She can stay mad, you have the real talent!
I've never watched a nail video in my life, but YoutTube recommended this and I'm really glad it did! Nails might not be my thing, but now I'm curious about the artistry and work behind different looks. Like I had no idea of the work behind them or how creative they could be! I'll definitely be checking out more videos from you. :)

1st off, nobody has ever heard of her nail company. 2nd even during the pandemic, she still was a ghost in the market. Like there are girls left and right making a name for themselves during the pandemic for their nail innovations. Where is she ... Exactly. Smh 3rd, so many celebrity nail techs have done this method. I think Nuni was the 1st person I saw do this. So she needs to back off because it's not her idea. It belongs to the community of creatives, and she belongs to the streets.

It is free to use. The patent only means that other people can’t copy your product and then sell it. The lady doesn’t actually have a case, she’s just bananas.
